باب النهي عن المثلةProhibition of mutilation
Hadith 1056
حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى ، قَالَ : ثني عَبْدُ الرَّزَّاقِ ، قَالَ : أنا مَعْمَرٌ ، عَنْ قَتَادَةَ ، عَنِ الحَسَنِ ، عَنِ الْهَيَّاجِ ، أَنَّ غُلامًا ، لَعَلَّهُ قَالَ لأَبِيهِ : أَبَقَ ، فَجَعَلَ عَلَيْهِ نَذْرًا لَئِنْ قَدَرَ عَلَيْهِ لَيَقْطَعَنَّ مِنْهُ طَائِفًا ، فَلَمَّا قَدِمَ عَلَيْهِ أَرْسَلَنِي إِلَى عِمْرَانَ بْنِ حُصَيْنٍ ، فِسَأَلْتُهُ ، فَقَالَ عِمْرَانُ رَضِيَ اللَّهُ عَنْهُ : مَنْ أَرَادَ أَنْ يُعْتِقَ غُلامَهُ ، أَوْ يُكَفِّرَ عَنْ يَمِينِهِ فَإِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ " يَحُثُّنَا عَلَى الصَّدَقَةِ ، وَيَنْهَى عَنِ الْمُثْلَةِ " ، قَالَ : فَأَتَيْتُ سَمُرَةَ ، فَقَالَ مثل قَوْلِ عِمْرَانَ .
Hiyaj bin Imran (may Allah be pleased with him) narrates that the slave of his father ran away. He made a vow against him that if he came under his control, he would cut off one of his limbs. When the slave returned to him, he sent me to Sayyiduna Imran bin Husain (may Allah be pleased with him). I asked him (about this matter), so Sayyiduna Imran (may Allah be pleased with him) said: If you wish, free your slave or give the expiation for your oath. Indeed, the Messenger of Allah (peace and blessings be upon him) used to encourage us to give charity and forbade us from mutilation. Hiyaj (may Allah be pleased with him) says: I went to Sayyiduna Samurah bin Jundub (may Allah be pleased with him), and he also said the same thing as Sayyiduna Imran bin Husain (may Allah be pleased with him).
