Hadith 1004
حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى ، قَالَ : ثنا مُوسَى بْنُ إِسْمَاعِيلَ ، قَالَ : ثنا أَبُو عَوَانَةَ ، قَالَ : ثنا عَبْدُ الْمَلِكِ يَعْنِي ابْنَ عُمَيْرٍ ، عَنْ عَلْقَمَةَ بْنِ وَائِلٍ ، عَنْ أَبِيهِ وَائِلِ بْنِ حُجْرٍ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : كُنْتُ عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَتَاهُ رَجُلانِ يَخْتَصِمَانِ فِي أَرْضٍ ، قَالَ أَحَدُهُمَا : إِنَّ هَذَا افْتَرَى عَلَى أَرْضِي يَا رَسُولَ اللَّهِ فِي الْجَاهِلِيَّةِ ، وَهُوَ امْرُؤُ الْقَيْسِ بْنُ عَابِسٍ الْكِنْدِيُّ ، وَخَصْمُهُ رَبِيعَةُ بْنُ عِيدَانَ ، فَقَالَ لَهُ : بَيِّنَتُكَ ، قَالَ : لَيْسَ لِي ، قَالَ : يَمِينُهُ ، قَالَ : إِذًا يَذْهَبُ بِهَا ، قَالَ : لَيْسَ لَكَ إِلا ذَلِكَ ، قَالَ : فَلَمَّا قَامَ يَحْلِفُ ، قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنِ اقْتَطَعَ أَرْضًا ظُلْمًا لَقِيَ اللَّهَ يَوْمَ الْقِيَامَةِ وَهُوَ عَلَيْهِ غَضْبَانُ " .
Sayyiduna Wa'il bin Hujr (may Allah be pleased with him) narrates that I was with the Messenger of Allah (peace and blessings be upon him) when two men came to him with a dispute over land. One of them, whose name was Amr ibn Qais bin Abis Kindi, said: O Messenger of Allah! He seized my land during the time of ignorance. His opponent was Rabi'ah bin 'Idan. The Prophet (peace and blessings be upon him) asked him: Do you have any evidence? He said: No! The Prophet (peace and blessings be upon him) said: Then he will be made to swear an oath. He said: Then he will take the land! The Prophet (peace and blessings be upon him) said: This is the only option you have. The narrator says: When he stood up to take the oath, the Messenger of Allah (peace and blessings be upon him) said: Whoever seizes land unjustly from someone, on the Day of Resurrection he will meet Allah while Allah will be angry with him.
