حَدَّثَنَا
مَحْمُودُ بْنُ آدَمَ ، قَالَ : ثنا
وَكِيعٌ ، عَنْ
أُسَامَةَ بْنِ زَيْد ، قَالَ : ثنا
عَبْدُ اللَّهِ بْنُ رَافِعٍ مَوْلَى أُمِّ سَلَمَةَ ، عَنْ
أُمِّ سَلَمَةَ رَضِيَ اللَّهُ عَنْهَا ، قَالَتْ : جَاءَ رَجُلانِ مِنَ الأَنْصَارِ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَخْتَصِمَانِ فِي مَوَارِيثَ بَيْنَهُمَا قَدْ دَرَسَتْ لَيْسَ بَيْنَهُمَا بَيِّنَةٌ ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِنَّكُمْ تَخْتَصِمُونَ إِلَيَّ ، وَإِنَّمَا أَنَا بَشَرٌ وَلَعَلَّ بَعْضَكُمْ أَنْ يَكُونَ أَلْحَنَ بِحُجَّتِهِ مِنْ بَعْضٍ ، وَإِنَّمَا أَقْضِي بَيْنَكُمْ عَلَى نَحْو مِمَّا أَسْمَعُ مِنْكُمْ فَمَنْ قَضَيْتُ لَهُ مِنْ أَخِيهِ شَيْئًا فَلا يَأْخُذْهُ ، فَإِنَّمَا أَقْطَعُ لَهُ قِطْعَةً مِنَ النَّارِ يَأْتِي بِهِ إِسْطَامًا فِي عُنُقِهِ يَوْمَ الْقِيَامَةِ " قَالَ : فَبَكَى الرَّجُلانِ وَقَالَ كُلُّ وَاحِدٍ مِنْهُمَا : حَقِّي لأَخِي ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَمَّا إِذْ فَعَلْتُمَا هَذَا ، فَاذْهَبَا فَاقْتَسِمَا وَتَوَخَّيَا الْحَقَّ ، ثُمَّ اسْتَهِمَا ، ثُمَّ لِيَحْلِلْ كُلُّ وَاحِدٍ مِنْكُمَا صَاحِبَهُ " .
Lady Umm Salamah (may Allah be pleased with her) narrates that two Ansari men came to the Messenger of Allah (peace and blessings be upon him), between whom there was an old dispute over inheritance. Neither of them had any evidence. The Prophet (peace and blessings be upon him) said: "You bring your disputes to me, but I am only a human being. It is possible that one of you may be more eloquent in presenting his case than the other, so I decide in his favor according to what I hear. So, if I grant someone a right that belongs to his brother, he should not take it, for I am actually cutting a piece of fire for him, which he will carry around his neck on the Day of Resurrection as a burning brand." The narrator says: Both men began to weep and said, "I give my right to my brother." The Messenger of Allah (peace and blessings be upon him) said: "If you wish to do so, then go and divide the property into two parts with justice and fairness, then draw lots between yourselves, and both of you forgive each other."
