Hadith 1108
1108 صحيح حديث أَنَسٍ، قَالَ: جَلَدَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ ، فِي الْخَمْرِ، بِالْجَرِيدِ وَالنِّعَالِ؛ وَجَلَدَ أَبُو بَكْرٍ أَرْبَعِينَ
Hazrat Anas (may Allah be pleased with him) narrated that the Prophet Muhammad (peace and blessings be upon him) beat (the offender) with a stick and shoes for drinking alcohol, and Abu Bakr (may Allah be pleased with him) administered forty lashes.
Hadith 1109
1109 صحيح حديث عَلِيِّ بْنِ أَبِي طَالِبٍ رضي الله عنه، قَالَ: مَا كُنْتُ لاِقِيمَ حَدًّا عَلَى أَحَدٍ فَيمُوتَ، فَأَجِدَ فِي نَفْسِي، إِلاَّ صَاحِبَ الْخَمْرِ، فَإِنَّهُ لَوْ مَاتَ وَدَيْتُهُ؛ وَذلِكَ أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ لَمْ يَسُنَّهُ
Hazrat Ali bin Abi Talib (may Allah be pleased with him) narrated that I would not like to inflict such a punishment on anyone in enforcing a hadd (prescribed punishment) that he dies and then I feel regret over it, except for the drunkard; if he dies, I will pay his blood money, because the Messenger of Allah (peace and blessings be upon him) did not prescribe any fixed hadd for him.
