Hadith 978
978 صحيح حديث عَبْدِ اللهِ بْنِ عُمَرَ، أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ ، قَالَ: الْمُتَبَايِعَانِ كُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ عَلَى صَاحِبِهِ مَا لَمْ يَتَفَرَّقَا إِلاَّ بَيْعَ الْخِيَارِ
Sayyiduna Abdullah bin Umar (may Allah be pleased with them) narrated that the Messenger of Allah (peace and blessings be upon him) said: The buyer and the seller both have the option (to cancel the transaction) as long as they have not separated from each other, except in the case of a sale with a stipulated option.
Hadith 979
979 صحيح حديث ابْنِ عُمَرَ، عَنْ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ ، أَنَّهُ قَالَ: إِذَا تَبَايَعَ الرَّجُلاَنِ فَكُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا، وَكَانَا جَمِيعًا؛ أَوْ يُخَيِّرُ أَحَدُهُمَا الآخَرَ فَتَبَايَعَا عَلَى ذلِكَ فَقَدْ وَجَبَ الْبَيْعُ، وَإِنْ تَفَرَّقَا بَعْدَ أَنْ يَتَبَايَعَا وَلَمْ يَتْرُكْ وَاحِدٌ مِنْهُمَا الْبَيْعَ فَقَدْ وَجَبَ الْبَيْعُ
Sayyiduna Ibn Umar (may Allah be pleased with them) narrated that the Messenger of Allah (peace and blessings be upon him) said: When two people engage in a sale, both of them have the option (to cancel the sale) as long as they do not separate. This is in the case when both remain in the same place. However, if one says to the other to choose (i.e., decide), and the sale is made on this condition, and both make a final decision regarding the sale, then the sale is concluded at that very moment. Similarly, if both parties separate after the sale and neither of them rejects the sale, then the sale also becomes binding.
