894 صحيح حديث عُقْبَةَ بْنِ عَامِرٍ رضي الله عنه، قَالَ: قَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ : أَحَقُّ الشُّرُوطِ أَنْ تُوفُوا بِهِ مَا اسْتَحْلَلْتُمْ بِهِ الْفُرُوجَ
Sayyiduna Uqbah bin Amir (may Allah be pleased with him) narrated that the Messenger of Allah (peace and blessings be upon him) said: The conditions by which you have made the private parts of women lawful for yourselves are the most deserving to be fulfilled.
Brief Explanation
In which the conditions of proposal and acceptance (ijab wa qubul) and dowry (mahr) hold great importance. If a person, at the time of fixing the dowry (mahr), harbors in his heart the intention of not paying it, then in the sight of Allah, his marriage will not be lawful. (Raaz)
Narrator of the Hadith: The kunyah of Sayyiduna Uqbah bin Amir al-Juhani radi Allahu anhu was Abu Abas. He was a scholar, a reciter (muqri), eloquent in speech, a jurist (faqih), an expert in the science of inheritance (ilm al-fara’id), and a person of great stature. During the conquest of Damascus, he used to bring messages and mail on behalf of Sayyiduna Umar radi Allahu anhu. He was among the Ashab al-Suffah. He passed away in 58 Hijri. He was buried at the foot of the Muqattam mountain in Cairo.
