Hadith 11

11 صحيح حَدْيث ابْنِ عَبَّاسٍ أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ لَمَّا بَعَثَ مُعَاذاً رضي الله عنه عَلى الْيَمنِ قَالَ: إِنَّكَ تَقْدَمُ عَلى قَوْمِ أَهْلِ كِتَابٍ، فَلْيَكُنْ أَوَّلَ مَا تَدْعُوهُمْ إِلَيْهِ عِبادَةُ اللهِ، فَإِذَا عَرَفُوا اللهَ فَأَخْبِرْهُمْ أَنَّ اللهَ قَدْ فَرَضَ عَلَيْهِمْ خَمْسَ صَلَواتٍ في يَوْمِهِمْ وَلَيْلَتِهِمْ، فَإِذا فَعَلُوا فَأَخْبِرْهُمْ أَنَّ اللهَ فَرَضَ عَلَيْهِمْ زَكاةً مِنْ أَمْوالِهِمْ وَتَردُّ عَلى فُقَرائِهِمْ فَإِذا أَطَاعُوا بِها فَخُذْ مِنْهُمْ وَتَوَقَّ كَرائِم أَمْوالِ النَّاسِ
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrated that when the Messenger of Allah (peace and blessings be upon him) sent Sayyiduna Mu'adh (may Allah be pleased with him) to Yemen, he said to him: "Behold, you are going to a people from among the People of the Book (Christians and Jews), so the first thing you should invite them to is the worship of Allah. When they recognize Allah (i.e., accept Islam), then inform them that Allah has made five prayers obligatory upon them during the day and night. When they perform them, then inform them that Allah has made zakat obligatory upon them, which is to be taken from their wealthy (those who possess the nisab) and distributed among their poor. When they accept that, then take zakat from them, but avoid taking their best possessions (as zakat)."

Brief Explanation
Hadith Narrator: ... The kunyah of Sayyiduna Abdullah ibn Abbas radi Allahu anhu is Abu Abdullah. He was the cousin of the Noble Prophet sallallahu alayhi wa sallam. He was born in Sha‘b Bani Hashim three years before the Hijrah. He enjoyed the company of the Noble Prophet sallallahu alayhi wa sallam for one and a half years. The Noble Prophet sallallahu alayhi wa sallam made supplication for him: “O Allah, grant him the knowledge of the Qur’an and endow him with the understanding of its interpretation (tafsir).” He narrated 1,770 ahadith, of which 75 are agreed upon (muttafaqun alayh). He established a school for the dissemination of the knowledge of tafsir. He passed away in 68 AH.

* Mawlana Abdur Rahman Mubarakpuri rahimahullah states in Tuhfat al-Ahwadhi: “In my view, the apparent position is that zakat should only be transferred from there to another place if there are no deserving (mustahiq) people there, or if there is some benefit in transferring it which is very important and brings greater advantage, such that this benefit would not be achieved if it were not sent. In such a situation, zakat may be transferred to another place.” (Raaz)
