Hazrat Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (peace and blessings be upon him) gave a verdict regarding two women from the tribe of Huzail who had a dispute, until one of the women (Umm ‘Atiyyf bint Marwah) struck the other (whose name was Maleekah bint ‘Uwaymir) with a stone. The stone hit the woman in her abdomen. The woman was pregnant, so the child in her womb died due to the blow of the stone. Both parties brought the matter to the Prophet (peace and blessings be upon him), so he ruled that the blood money (diyah) for the child in the womb was to free a male or female slave. The guardian of the woman upon whom the compensation was obligatory (Haml bin Malik bin Nabighah) said: O Messenger of Allah! How can I pay blood money for one who neither ate nor drank, neither spoke nor was his cry heard at birth? In such a case, there should be no blood money. The Prophet (peace and blessings be upon him) said to him: This man seems to be the brother of soothsayers (kahins). (That is why he speaks in rhymed and measured phrases like the soothsayers.)
