Hadith 1009

1009 صحيح حديث أَبِي هُرَيْرَةَ رضي الله عنه، أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ ، قَالَ: لاَ يُمْنَعُ فَضْلُ الْمَاءِ لِيُمْنَعَ بِهِ الْكَلأُ
Hazrat Abu Huraira (may Allah be pleased with him) narrated that the Messenger of Allah (peace and blessings be upon him) said: Do not prevent anyone from the leftover water so that the grass which is more than needed may also not be withheld.

Brief Explanation
The meaning of the hadith is that if a person’s land in the desert collects water or a spring gushes forth, and there is grass growing around it, then livestock can only come to graze on that grass if the owner of the water does not prevent them from drinking the water. Therefore, the Shari‘ah has prohibited the owner of the water from withholding the use of surplus and excess water, because by withholding the water, he is in effect preventing access to the grass. Preventing access to the grass causes hardship and harm to people. (Murattib rahimahullah)
