بَابُ مَا جَاءَ فِي صَيْدِ الْكَلْبِ الْمُعَلَّم وَالْبَازِى وَنَحْوِهِمَا
Chapter on What Has Been Reported Regarding Hunting with a Trained Dog, Falcon, and the Like
Hadith 7578
عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو رَضِيَ اللَّهُ عَنْهُمَا أَنَّ أَبَا ثَعْلَبَةَ الْخُشَنِيَّ رَضِيَ اللَّهُ عَنْهُ أَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ لِي كِلَابًا مُكَلَّبَةً فَأَفْتِنِي فِي صَيْدِهَا فَقَالَ إِنْ كَانَتْ لَكَ كِلَابٌ مُكَلَّبَةٌ فَكُلْ مِمَّا أَمْسَكَتْ عَلَيْكَ فَقَالَ يَا رَسُولَ اللَّهِ ذَكِيٌّ وَغَيْرُ ذَكِيٍّ قَالَ ذَكِيٌّ وَغَيْرُ ذَكِيٍّ قَالَ وَإِنْ أَكَلَ مِنْهُ قَالَ وَإِنْ أَكَلَ مِنْهُ قَالَ يَا رَسُولَ اللَّهِ أَفْتِنِي فِي قَوْسِي قَالَ كُلْ مَا أَمْسَكَتْ عَلَيْكَ قَوْسُكَ قَالَ ذَكِيٌّ وَغَيْرُ ذَكِيٍّ قَالَ ذَكِيٌّ وَغَيْرُ ذَكِيٍّ قَالَ وَإِنْ تَغَيَّبَ عَنِّي قَالَ وَإِنْ تَغَيَّبَ عَنْكَ مَا لَمْ يَصِلَّ يَعْنِي يَتَغَيَّرْ أَوْ تَجِدْ فِيهِ أَثَرًا غَيْرَ سَهْمِكَ قَالَ يَا رَسُولَ اللَّهِ أَفْتِنَا فِي آنِيَةِ الْمَجُوسِ إِذَا اضْطُرِرْنَا إِلَيْهَا قَالَ إِذَا اضْطُرِرْتُمْ إِلَيْهَا فَاغْسِلُوهَا بِالْمَاءِ وَاطْبُخُوا فِيهَا
Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) narrates that Sayyiduna Abu Tha’labah al-Khushani (may Allah be pleased with him) came to the Noble Prophet (peace and blessings be upon him) and said: O Messenger of Allah! I have trained dogs, tell me in detail about their hunting. The Prophet (peace and blessings be upon him) said: If you have hunting dogs, then whatever game they restrain for you, it is permissible to eat. He said: O Messenger of Allah! Whether I am able to slaughter it or not? The Prophet (peace and blessings be upon him) said: Yes, whether you are able to slaughter it or not, in both cases it will be permissible. He said: Even if the dog has eaten from it? The Prophet (peace and blessings be upon him) said: Even if the dog has eaten from it. He said: O Messenger of Allah! Tell me about the animal hunted with a bow. The Prophet (peace and blessings be upon him) said: Whatever you hunt with a bow, eat it. He said: Whether I am able to slaughter it or not? The Prophet (peace and blessings be upon him) said: Yes, whether you are able to slaughter it or not. He said: If the game becomes hidden from sight, will it still be permissible? The Prophet (peace and blessings be upon him) said: If it becomes hidden, it is permissible as long as it does not develop a foul smell due to change or there is no mark of any arrow other than your own. He said: O Messenger of Allah! When we are compelled, give a ruling regarding eating from the vessels of the Magians. The Prophet (peace and blessings be upon him) said: When you are compelled to eat from their vessels, wash them with water and then cook food in them.
Hadith 7579
عَنْ أَبِي ثَعْلَبَةَ الْخُشَنِيِّ رَضِيَ اللَّهُ عَنْهُ أَنَّهُ قَالَ أَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقُلْتُ يَا رَسُولَ اللَّهِ إِنَّا بِأَرْضِ أَهْلِ كِتَابٍ أَفَنَأْكُلُ فِي آنِيَتِهِمْ وَإِنَّا فِي أَرْضِ صَيْدٍ أَصِيدُ بِقَوْسِي وَأَصِيدُ بِكَلْبِي الْمُعَلَّمِ وَأَصِيدُ بِكَلْبِي الَّذِي لَيْسَ بِمُعَلَّمٍ فَأَخْبِرْنِي مَاذَا يَصْلُحُ قَالَ أَمَّا مَا ذَكَرْتَ أَنَّكُمْ بِأَرْضِ أَهْلِ كِتَابٍ تَأْكُلُونَ فِي آنِيَتِهِمْ فَإِنْ وَجَدْتُمْ غَيْرَ آنِيَتِهِمْ فَلَا تَأْكُلُوا فِيهَا وَإِنْ لَمْ تَجِدُوا غَيْرَ آنِيَتِهِمْ فَاغْسِلُوهَا ثُمَّ كُلُوا فِيهَا وَأَمَّا مَا ذَكَرْتَ أَنَّكُمْ بِأَرْضِ صَيْدٍ فَإِنْ صِدْتَ بِقَوْسِكَ وَذَكَرْتَ اسْمَ اللَّهِ فَكُلْ وَمَا صِدْتَ بِكَلْبِكَ الْمُعَلَّمِ فَاذْكُرْ اسْمَ اللَّهِ ثُمَّ كُلْ وَمَا صِدْتَ بِكَلْبِكَ الَّذِي لَيْسَ بِمُعَلَّمٍ فَأَدْرَكْتَ ذَكَاتَهُ فَكُلْ
Narrated from Sayyiduna Abu Tha’labah al-Khushani (may Allah be pleased with him), he says: I said, “O Messenger of Allah! We live in the land of the People of the Book. Can we eat from their utensils? And we are in a land suitable for hunting. I hunt with my bow or with my trained dog, and I also hunt with my dog that is not trained. Now, please tell me about these matters.” The Prophet (peace and blessings be upon him) said: “As for what you have said, that you are in the land of the People of the Book and what is the ruling about eating from their utensils, the verdict is that if you find utensils other than theirs, then do not eat from theirs. If you do not find utensils other than theirs, then wash them and eat from them. As for what you have said, that you are in a land of hunting: if you recited ‘Bismillah’ when hunting with your bow, then eat that game. And when you recited ‘Bismillah’ before sending your trained dog for hunting, then eat that game as well. And if you hunted with an untrained dog, if you slaughter it (the animal) then eat it, and if it dies before being slaughtered, then do not eat it.”
Hadith 7580
عَنْ عَدِيِّ بْنِ حَاتِمٍ رَضِيَ اللَّهُ عَنْهُ قَالَ أَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَعَلَّمَنِي الْإِسْلَامَ وَنَعَتَ لِي الصَّلَاةَ وَكَيْفَ أُصَلِّي كُلَّ صَلَاةٍ لِوَقْتِهَا ثُمَّ قَالَ لِي كَيْفَ أَنْتَ يَا ابْنَ حَاتِمٍ إِذَا رَكِبْتَ مِنْ قُصُورِ الْيَمَنِ لَا تَخَافُ إِلَّا اللَّهَ حَتَّى تَنْزِلَ قُصُورَ الْحِيرَةِ قَالَ قُلْتُ يَا رَسُولَ اللَّهِ فَأَيْنَ مَقَانِبُ طَيِّئٍ وَرِجَالُهَا قَالَ يَكْفِيكَ اللَّهُ طَيِّئًا وَمَنْ سِوَاهَا قَالَ قُلْتُ يَا رَسُولَ اللَّهِ إِنَّا قَوْمٌ نَتَصَيَّدُ بِهَذِهِ الْكِلَابِ وَالْبُزَاةِ فَمَا يَحِلُّ لَنَا مِنْهَا قَالَ يَحِلُّ لَكُمْ {مَا عَلَّمْتُمْ مِنَ الْجَوَارِحِ مُكَلِّبِينَ تُعَلِّمُونَهُنَّ مِمَّا عَلَّمَكُمُ اللَّهُ فَكُلُوا مِمَّا أَمْسَكْنَ عَلَيْكُمْ وَاذْكُرُوا اسْمَ اللَّهِ عَلَيْهِ} [المائدة ٤] فَمَا عَلَّمْتَ مِنْ كَلْبٍ أَوْ بَازٍ ثُمَّ أَرْسَلْتَ وَذَكَرْتَ اسْمَ اللَّهِ عَلَيْهِ فَكُلْ مِمَّا أَمْسَكَ عَلَيْكَ قُلْتُ وَإِنْ قَتَلَ قَالَ وَإِنْ قَتَلَ وَلَمْ يَأْكُلْ مِنْهُ شَيْئًا فَإِنَّمَا أَمْسَكَهُ عَلَيْكَ قُلْتُ أَفَرَأَيْتَ إِنْ خَالَطَ كِلَابَنَا كِلَابٌ أُخْرَى حِينَ نُرْسِلُهَا قَالَ لَا تَأْكُلْ حَتَّى تَعْلَمَ أَنَّ كَلْبَكَ هُوَ الَّذِي أَمْسَكَ عَلَيْكَ قُلْتُ يَا رَسُولَ اللَّهِ إِنَّا قَوْمٌ نَرْمِي بِالْمِعْرَاضِ فَمَا يَحِلُّ لَنَا قَالَ لَا تَأْكُلْ مَا أَصَبْتَ بِالْمِعْرَاضِ إِلَّا مَا ذَكَّيْتَ
It is narrated from Sayyiduna ‘Adi bin Hatim (may Allah be pleased with him), he says: I came to the Messenger of Allah (peace and blessings be upon him), and he taught me about Islam and explained to me how I should perform every prayer at its appointed time. Then he said to me: O Ibn Hatim! What will be your condition when you will ascend the forts of Yemen, and you will fear none except Allah, until you will descend into the forts of Hira? He says, I asked: Where will the horsemen and footmen (criminals) of the tribe of Tayy be? He said: Allah Almighty will suffice you against Tayy and other people. I said: O Messenger of Allah! We hunt with dogs and hawks, what is lawful for us from their catch? The Prophet (peace and blessings be upon him) said: The hunting dogs which you have trained, with the training Allah has given you, you may eat what they catch for you, provided you have mentioned the name of Allah over it. And if you release a dog or a hawk and mention the name of Allah, then whatever they catch and hold for you, eat it. I said: Even if they kill the prey? The Prophet (peace and blessings be upon him) said: Even if they kill it, as long as they have not eaten from it themselves, then they have caught it for you. I said: Now tell me, if when we release our dog, other dogs join it, then what is the ruling? The Prophet (peace and blessings be upon him) said: Do not eat the prey until you know that your dog alone caught it. I said: O Messenger of Allah! We hunt with the middle thick part of the arrow, what is lawful for us from it? The Prophet (peace and blessings be upon him) said: Whatever prey dies from that part of the arrow, do not eat it, unless you slaughter it yourself.
