بَابُ مَا جَاءَ فِي إِرَاقَةِ الْخَمْرِ وَكَسْرِ أَوَانِيهِ وَالنَّهْي عَنْ تَخْلِيلِهِ
Chapter on What Has Been Reported Regarding Pouring Out Wine, Breaking Its Vessels, and the Prohibition of Trying to Purify It
Hadith 7569
عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُمَا قَالَ لَمَّا كَانَ يَوْمُ فَتْحِ مَكَّةَ أَهْرَاقَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ الْخَمْرَ وَكَسَّرَ جِرَارَهُ وَنَهَى عَنْ بَيْعِهِ وَبَيْعِ الْأَصْنَامِ
Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) narrates that when Makkah was conquered, the Noble Prophet (peace and blessings be upon him and his family) poured out the wine, broke its containers, and forbade the buying and selling of it and of idols.
Hadith 7570
عَنْ أَنَسِ بْنِ مَالِكٍ رَضِيَ اللَّهُ عَنْهُ أَنَّ أَبَا طَلْحَةَ سَأَلَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ عَنْ أَيْتَامٍ وَرِثُوا خَمْرًا فَقَالَ أَهْرِقْهَا قَالَ أَفَلَا نَجْعَلُهَا خَلًّا قَالَ لَا
Sayyiduna Anas bin Malik (may Allah be pleased with him) narrates that Sayyiduna Abu Talhah (may Allah be pleased with him) asked the Noble Prophet (peace and blessings be upon him): There are some orphans who have inherited wine. The Prophet (peace and blessings be upon him) said: Pour it away. He said: Should we not make it into vinegar? The Prophet (peace and blessings be upon him) said: No.
Hadith 7571
(وَعَنْهُ مِنْ طَرِيقٍ ثَانٍ) قَالَ كَانَ فِي حِجْرِ أَبِي طَلْحَةَ يَتَامَى فَابْتَاعَ لَهُمْ خَمْرًا فَلَمَّا حُرِّمَتِ الْخَمْرُ أَتَى رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ أَصْنَعُهُ خَلًّا قَالَ لَا قَالَ فَأَهْرَاقَهُ
(Second chain) There were some orphan children under the care of Sayyiduna Abu Talhah (may Allah be pleased with him). He bought wine for them, (but before it was used) wine became forbidden. He came to the Noble Prophet (peace and blessings be upon him) and asked, "Shall I turn it into vinegar?" The Prophet (peace and blessings be upon him) said: "No." So he poured out the wine.
Hadith 7572
عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا أَمَرَنِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنْ آتِيَهُ بِمُدْيَةٍ وَهِيَ الشَّفْرَةُ فَأَتَيْتُهُ بِهَا فَأَرْسَلَ بِهَا فَأُرْهِفَتْ ثُمَّ أَعْطَانِيهَا وَقَالَ اغْدُ عَلَيَّ بِهَا فَفَعَلْتُ فَخَرَجَ بِأَصْحَابِهِ إِلَى أَسْوَاقِ الْمَدِينَةِ وَفِيهَا زِقَاقُ خَمْرٍ قَدْ جُلِبَتْ مِنَ الشَّامِ فَأَخَذَ الْمُدْيَةَ مِنِّي فَشَقَّ مَا كَانَ مِنْ تِلْكَ الزِّقَاقِ بِحَضْرَتِهِ ثُمَّ أَعْطَانِيهَا وَأَمَرَ أَصْحَابَهُ الَّذِينَ كَانُوا مَعَهُ أَنْ يَمْضُوا مَعِي وَأَنْ يُعَاوِنُونِي وَأَمَرَنِي أَنْ آتِيَ الْأَسْوَاقَ كُلَّهَا فَلَا أَجِدُ فِيهَا زِقَّ خَمْرٍ إِلَّا شَقَقْتُهُ فَفَعَلْتُ فَلَمْ أَتْرُكْ فِي أَسْوَاقِهَا زِقًّا إِلَّا شَقَقْتُهُ
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates that the Noble Prophet (peace and blessings be upon him) ordered me to bring him a knife. I brought the knife, and the Prophet (peace and blessings be upon him) sent it to be sharpened. So it was sharpened, then given to me, and he said: Take this knife and come to me in the morning. So I did as instructed. The Prophet (peace and blessings be upon him) went out with his companions into the markets of Madinah. There were wineskins in the markets, which had been brought from Syria. The Prophet (peace and blessings be upon him) took the knife from me and cut open all the wineskins that were present, then returned the knife to me. He ordered all his companions who were with him to go with me and assist me, and he ordered me to go into the markets and tear open any wineskin of wine that I found. So I did as instructed; I did not leave a single wineskin of wine in the markets without tearing it open.
Hadith 7573
(وَعَنْهُ أَيْضًا) عَنْ ثَابِتٍ وَقَتَادَةَ عَنْ أَنَسٍ رَضِيَ اللَّهُ عَنْهُ قَالَ لَمَّا حُرِّمَتِ الْخَمْرُ قَالَ إِنِّي يَوْمَئِذٍ لَأَسْقِيهِمْ لَأَسْقِي أَحَدَ عَشَرَ رَجُلًا فَأَمَرُونِي فَكَفَأْتُهَا وَكَفَأَ النَّاسُ آنِيَتَهُمْ بِمَا فِيهَا حَتَّى كَادَتِ السِّكَكُ أَنْ تُمْتَنَعَ مِنْ رِيحِهَا قَالَ أَنَسٌ وَمَا خَمْرُهُمْ يَوْمَئِذٍ إِلَّا الْبُسْرُ وَالتَّمْرُ مَخْلُوطَيْنِ قَالَ فَجَاءَ رَجُلٌ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ إِنَّهُ كَانَ عِنْدِي مَالُ يَتِيمٍ فَاشْتَرَيْتُ بِهِ خَمْرًا أَفَتَأْذَنُ لِي أَنْ أَبِيعَهُ فَأَرُدَّ عَلَى الْيَتِيمِ مَالَهُ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَاتَلَ اللَّهُ الْيَهُودَ حُرِّمَتْ عَلَيْهِمُ الثُّرُوبُ فَبَاعُوهَا وَأَكَلُوا أَثْمَانَهَا وَلَمْ يَأْذَنْ لَهُمُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فِي بَيْعِ الْخَمْرِ
. Sayyiduna Ibn Umar (may Allah be pleased with them) narrates that when alcohol was prohibited, Sayyiduna Anas says: On that day, I was serving alcohol to my companions, there were a total of eleven people to whom I served alcohol. After it was prohibited, they ordered me to pour out the alcohol, so I poured it out and the people also poured out their own vessels. The streets were filled with the smell of alcohol, making it difficult to walk. In those days, their alcohol was mostly prepared by mixing fresh dates and dry dates. A man came to the Prophet Muhammad (peace and blessings be upon him) and said: I had the wealth of orphans with me, and I bought alcohol with it (but now alcohol has become prohibited), so do you permit me to sell it and save their wealth? The Prophet Muhammad (peace and blessings be upon him) said: May Allah destroy the Jews, fat was forbidden to them, so they sold it and consumed its price. Thus, the Prophet Muhammad (peace and blessings be upon him) did not permit him to sell the alcohol.
Hadith 7574
عَنْ أَبِي سَعِيدٍ رَضِيَ اللَّهُ عَنْهُ قَالَ قُلْنَا لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لَمَّا حُرِّمَتِ الْخَمْرُ إِنَّ عِنْدَنَا خَمْرًا لِيَتِيمٍ لَنَا فَأَمَرَنَا فَأَهْرَقْنَاهَا
Syedna Abu Saeed Khudri (may Allah be pleased with him) narrates that when alcohol was prohibited, we submitted to the Noble Prophet (peace and blessings be upon him) that we have the alcohol of orphans with us, what should we do with it? The Prophet (peace and blessings be upon him) commanded us, and we poured out that alcohol.
Hadith 7575
عَنْ أَنَسٍ رَضِيَ اللَّهُ عَنْهُ قَالَ كُنْتُ أَسْقِي أَبَا عُبَيْدَةَ بْنَ الْجَرَّاحِ وَأُبَيَّ بْنَ كَعْبٍ وَسُهَيْلَ ابْنَ بَيْضَاءَ وَنَفَرًا مِنْ أَصْحَابِهِ عِنْدَ أَبِي طَلْحَةَ وَأَنَا أَسْقِيهِمْ حَتَّى كَادَ الشَّرَابُ أَنْ يَأْخُذَ فِيهِمْ فَأَتَى آتٍ مِنَ الْمُسْلِمِينَ فَقَالَ أَوَمَا شَعَرْتُمْ أَنَّ الْخَمْرَ قَدْ حُرِّمَتْ فَمَا قَالُوا حَتَّى نَنْظُرَ وَنَسْأَلَ فَقَالُوا يَا أَنَسُ اكْفِ مَا بَقِيَ فِي إِنَائِكَ قَالَ فَوَاللَّهِ مَا عَادُوا فِيهَا وَمَا هِيَ إِلَّا التَّمْرُ وَالْبُسْرُ وَهِيَ خَمْرُهُمْ يَوْمَئِذٍ
It is narrated from Sayyiduna Anas (may Allah be pleased with him), he says: I was serving wine to Sayyiduna Abu Ubaidah bin Jarrah, Sayyiduna Ubayy bin Ka'b, Sayyiduna Suhail bin Bayda, and a group of the noble Companions at the house of Sayyiduna Abu Talhah (may Allah be pleased with him). The wine had almost begun to show its effect on them when a Muslim came and said: Do you not know that wine has been made forbidden? In response, they did not say, "Alright, we will see," or "We will ask someone else," rather, they immediately ordered: O Anas! Whatever is left in the vessel, pour it out. By Allah! After that, they never even looked at wine. In those days, wine was generally made from dried dates and unripe dates.
