Hadith 7527
عَنْ يَحْيَى بْنِ غَسَّانَ التَّيْمِيِّ عَنْ أَبِيهِ قَالَ كَانَ أَبِي فِي الْوَفْدِ الَّذِينَ وَفَدُوا عَلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مِنْ عَبْدِ قَيْسٍ فَنَهَاهُمْ عَنْ هَذِهِ الْأَوْعِيَةِ قَالَ فَأَتْخَمْنَا ثُمَّ أَتَيْنَاهُ الْعَامَ الْمُقْبِلَ قَالَ فَقُلْنَا يَا رَسُولَ اللَّهِ إِنَّكَ نَهَيْتَنَا عَنْ هَذِهِ الْأَوْعِيَةِ فَأَتْخَمْنَا قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ انْتَبِذُوا فِيمَا بَدَا لَكُمْ وَلَا تَشْرَبُوا مُسْكِرًا فَمَنْ شَاءَ أَوْكَأَ سِقَاءَهُ عَلَى إِثْمٍ
Yahya bin Ghassan Taymi narrates, he says: My father was among the delegation from Abd al-Qais who came to the Prophet Muhammad (peace and blessings be upon him). He forbade them from using those four types of vessels. He says: We stopped using those vessels, but we were afflicted by an epidemic. When we came to the Prophet (peace and blessings be upon him) the following year, we said: O Messenger of Allah! You forbade us from using those vessels, and our area is plagued by an epidemic, and we have been afflicted. The Prophet (peace and blessings be upon him) said: Now you may prepare nabidh in any vessel you wish, just do not drink anything intoxicating, and whoever wishes may seal the mouth of his waterskin.
Hadith 7528
عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ لَمَّا قَدِمَ وَفْدُ عَبْدِ قَيْسٍ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ كُلُّ امْرِئٍ حَسِيبُ نَفْسِهِ لِيَشْرَبْ كُلُّ قَوْمٍ فِيمَا بَدَا لَهُمْ
Syedna Abu Hurairah (may Allah be pleased with him) narrates that when the delegation of Abdul Qais came, the Noble Prophet (peace and blessings be upon him) said: Every person is responsible for himself, every nation may drink from whichever vessel it wishes, but it should not be intoxicating.
Hadith 7529
(وَعَنْهُ أَيْضًا) قَالَ إِنِّي لَشَاهِدٌ لِوَفْدِ عَبْدِ الْقَيْسِ قَدِمُوا عَلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ فَنَهَاهُمْ أَنْ يَشْرَبُوا فِي هَذِهِ الْأَوْعِيَةِ الْحَنْتَمِ وَالدُّبَّاءِ وَالْمُزَفَّتِ وَالنَّقِيرِ قَالَ فَقَامَ إِلَيْهِ رَجُلٌ مِنَ الْقَوْمِ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ النَّاسَ لَا ظُرُوفَ لَهُمْ قَالَ فَرَأَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ كَأَنَّهُ يَرْثِي لِلنَّاسِ قَالَ فَقَالَ اشْرَبُوا مَا طَابَ لَكُمْ فَإِذَا خَبُثَ فَذَرُوهُ
Narrated from Sayyiduna Abu Hurairah (may Allah be pleased with him), he says: When the delegation of Abdul Qais came, I was also present at that time. The Prophet (peace and blessings be upon him) forbade them from drinking from these vessels: vessels made from gourds, pitch-coated jars, and those made from palm trunks. A man stood up and said: O Messenger of Allah! People do not have any other vessels. Sayyiduna Abu Hurairah says: I saw that the Prophet (peace and blessings be upon him) felt compassion for the people's condition and he said: Drink from these vessels as much as you wish, but when intoxication is produced, then stop.
Hadith 7530
عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُمَا قَالَ لَمَّا نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ عَنِ الْأَوْعِيَةِ فَقَالَتِ الْأَنْصَارُ فَلَا بُدَّ لَنَا قَالَ فَلَا إِذَنْ
Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) narrates that when the Noble Prophet (peace and blessings be upon him) prohibited drinking from those vessels, the Ansar said: We have no alternative except to use them. The Prophet (peace and blessings be upon him) said: Then there is no harm, use them.
Hadith 7531
عَنْ عَبْدِ اللَّهِ بْنِ بُرَيْدَةَ الْأَسْلَمِيِّ عَنْ أَبِيهِ بُرَيْدَةَ بْنِ حُصَيْبٍ رَضِيَ اللَّهُ عَنْهُ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنَّهُ قَالَ كُنْتُ نَهَيْتُكُمْ عَنْ ثَلَاثٍ عَنْ زِيَارَةِ الْقُبُورِ فَزُورُوهَا فَإِنَّ فِي زِيَارَتِهَا عِظَةً وَعِبْرَةً وَنَهَيْتُكُمْ عَنْ لُحُومِ الْأَضَاحِي فَوْقَ ثَلَاثٍ فَكُلُوا وَادَّخِرُوا وَنَهَيْتُكُمْ عَنِ النَّبِيذِ فِي هَذِهِ الْأَسْقِيَةِ فَاشْرَبُوا وَلَا تَشْرَبُوا حَرَامًا (وَفِي لَفْظٍ وَنَهَيْتُكُمْ عَنْ نَبِيذِ الْجَرِّ فَانْتَبِذُوا فِي كُلِّ وِعَاءٍ وَاجْتَنِبُوا كُلَّ مُسْكِرٍ)
Sayyiduna Buraidah bin Husaib (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: I had forbidden you from three things: I had forbidden you from visiting graves, but now I command you to visit them, for visiting them brings admonition and lesson. And I had forbidden you from eating the meat of sacrificial animals for more than three days, now eat and store it. And I had forbidden you from making nabidh (fermented drink) in certain vessels, now drink from any kind of vessel, just do not drink what is unlawful. In another narration: I had forbidden you from making nabidh in pitchers, now you may make nabidh in any vessel, just avoid every intoxicating drink.
Hadith 7532
((وَعَنْهُ مِنْ طَرِيقٍ ثَانٍ) بِنَحْوِهِ) وَفِيهِ وَنَهَيْتُكُمْ عَنْ زِيَارَةِ الْقُبُورِ وَإِنَّ مُحَمَّدًا أُذِنَ لَهُ فِي زِيَارَةِ قَبْرِ أُمِّهِ وَنَهَيْتُكُمْ عَنِ الظُّرُوفِ وَإِنَّ الظُّرُوفَ لَا تُحَرِّمُ شَيْئًا وَلَا تُحِلُّهُ
(Second chain) The Prophet (peace and blessings be upon him) said: I had forbidden you from visiting graves, but now Muhammad (peace and blessings be upon him) has been permitted to visit his mother's grave. And I had forbidden you from using certain vessels, whereas vessels themselves cannot make anything lawful or unlawful (so you may use them).
Hadith 7533
وَعَنْ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ نَحْوُهُ وَفِيهِ وَنَهَيْتُكُمْ عَنِ الْأَوْعِيَةِ فَاشْرَبُوا فِيهَا وَاجْتَنِبُوا كُلَّ مَا أَسْكَرَ
A similar hadith is narrated from Sayyiduna Ali (may Allah be pleased with him), except that it states: I had forbidden you from (using) utensils, so now you may drink from them, but abstain from every intoxicating thing.
Hadith 7534
وَعَنْ أَنَسِ بْنِ مَالِكٍ رَضِيَ اللَّهُ عَنْهُ نَحْوَ حَدِيثِ عَلِيٍّ وَفِيهِ وَنَهَيْتُكُمْ عَنِ النَّبِيذِ فِي هَذِهِ الْأَوْعِيَةِ فَاشْرَبُوا بِمَا شِئْتُمْ وَلَا تَشْرَبُوا مُسْكِرًا فَمَنْ شَاءَ أَوْكَأَ سِقَاءَهُ عَلَى إِثْمٍ
Sayyiduna Anas (may Allah be pleased with him) also narrates similarly to Sayyiduna Ali, except that in it is: I had forbidden you from making nabidh in those vessels, now you may drink any lawful beverage as you wish, but do not drink anything intoxicating, and whoever wishes to store sin in his waterskin, surely let him keep an intoxicating drink.
Hadith 7535
عَنْ عَبْدِ اللَّهِ بْنِ مُغَفَّلٍ الْمُزَنِيِّ رَضِيَ اللَّهُ عَنْهُ قَالَ أَنَا شَهِدْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ حِينَ نَهَى عَنْ نَبِيذِ الْجَرِّ وَأَنَا شَهِدْتُ حِينَ رَخَّصَ فِيهِ قَالَ وَاجْتَنِبُوا الْمُسْكِرَ
It is narrated from Sayyiduna Abdullah bin Mughaffal Muzani, may Allah be pleased with him, who says: When the Prophet Muhammad, peace and blessings be upon him, forbade the use of nabidh (fermented drink) in pitchers, I was present with him at that time, and when he permitted it, I was also present. And the Prophet, peace and blessings be upon him, said: However, avoid anything that is intoxicating.
Hadith 7536
عَنْ عَبْدِ الرَّحْمَنِ بْنِ صُحَارٍ الْعَبْدِيِّ عَنْ أَبِيهِ رَضِيَ اللَّهُ عَنْهُ قَالَ قُلْتُ يَا رَسُولَ اللَّهِ إِنِّي رَجُلٌ مِسْقَامٌ فَأْذَنْ لِي فِي جَرِيرَةٍ أَنْتَبِذُ فِيهَا قَالَ فَأَذِنَ لَهُ فِيهَا
It is narrated from Sayyiduna Sahar Abdi (may Allah be pleased with him), he says: I said, O Messenger of Allah! I am a person who remains very ill, grant me permission to prepare nabidh in my jug. The Prophet (peace and blessings of Allah be upon him and his family) granted him permission.
Hadith 7537
حَدَّثَنَا عَاصِمٌ ذَكَرَ أَنَّ الَّذِي يُحَدِّثُ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَذِنَ فِي النَّبِيذِ بَعْدَ مَا نَهَى عَنْهُ مُنْذِرٌ أَبُو حَسَّانَ ذَكَرَهُ عَنْ سَمُرَةَ بْنِ جُنْدُبٍ رَضِيَ اللَّهُ عَنْهُ وَكَانَ يَقُولُ مَنْ خَالَفَ الْحَجَّاجَ فَقَدْ خَالَفَ
Asim narrated that the one who has stated that the Prophet Muhammad (peace be upon him) permitted the drinking of nabidh after having prohibited it, that narrator is Mundhir Abu Hassan. He narrated this from Samurah bin Jundub (may Allah be pleased with him). And he used to say that whoever opposed Hajjaj, then he has opposed.
