Chapter: Drawing Lots for the Child and Giving Him Choice If He Is Discerning When Parents Dispute Over Custody
Hadith 7277
عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ جَاءَتْ امْرَأَةٌ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَدْ طَلَّقَهَا زَوْجُهَا فَأَرَادَتْ أَنْ تَأْخُذَ وَلَدَهَا فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ اسْتَهِمَا فِيهِ فَقَالَ الرَّجُلُ مَنْ يَحُولُ بَيْنِي وَبَيْنَ ابْنِي فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لِلْابْنِ وَفِي لَفْظٍ يَا غُلَامُ هَذَا أَبُوكَ وَهَذِهِ أُمُّكَ اخْتَرْ أَيَّهُمَا شِئْتَ فَاخْتَارَ أُمَّهُ فَذَهَبَتْ بِهِ
Syedna Abu Hurairah (may Allah be pleased with him) narrates that a woman came to the Noble Prophet (peace and blessings be upon him), her husband had divorced her and the woman wanted to take her child. The Noble Prophet (peace and blessings be upon him) said: Draw lots regarding this child. But the man said: Who can come between me and my child? The Messenger of Allah (peace and blessings be upon him) said: O child! This is your father and this is your mother, you may choose whichever of them you wish. He chose his mother, so she took him and left.
Hadith 7278
حَدَّثَنَا عَبْدُ الْحَمِيدِ بْنُ جَعْفَرٍ أَخْبَرَنِي أَبِي عَنْ جَدِّي رَافِعِ بْنِ سِنَانٍ رَضِيَ اللَّهُ عَنْهُ أَنَّهُ أَسْلَمَ وَأَبَتْ امْرَأَتُهُ أَنْ تُسْلِمَ فَأَتَتِ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَتْ ابْنَتِي وَهِيَ فَطِيمٌ أَوْ شَبَهُهُ وَقَالَ رَافِعٌ ابْنَتِي فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ اقْعُدْ نَاحِيَةً وَقَالَ لَهَا اقْعُدِي نَاحِيَةً فَأَقْعَدَ الصَّبِيَّةَ بَيْنَهُمَا ثُمَّ قَالَ ادْعُوَاهَا فَمَالَتْ إِلَى أُمِّهَا فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ اللَّهُمَّ اهْدِهَا فَمَالَتْ إِلَى أَبِيهَا فَأَخَذَهَا
It is narrated from Sayyiduna Rafi' bin Sinan (may Allah be pleased with him) that he accepted Islam, but his wife refused to become Muslim. She came to the Noble Prophet (peace and blessings be upon him) and said: This is my daughter, she has been weaned. The Noble Prophet (peace and blessings be upon him) said to Rafi': Sit on one side, and said to his wife: You sit on the other side. And the Prophet (peace and blessings be upon him) seated the girl between them and said: Both of you call her. The girl inclined towards her mother. The Prophet (peace and blessings be upon him) prayed: O my Allah! Guide this girl. Then she leaned towards her father and he took her.
