Hadith 7253
عَنْ عَامِرٍ قَالَ قَدِمْتُ الْمَدِينَةَ فَأَتَيْتُ فَاطِمَةَ بِنْتَ قَيْسٍ رَضِيَ اللَّهُ عَنْهَا فَحَدَّثَتْنِي أَنَّ زَوْجَهَا طَلَّقَهَا عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَبَعَثَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فِي سَرِيَّةٍ فَقَالَ لِي أَخُوهُ اخْرُجِي مِنَ الدَّارِ فَقُلْتُ إِنَّ لِي نَفَقَةً وَسُكْنَى حَتَّى يَحِلَّ الْأَجَلُ قَالَ لَا قَالَتْ فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقُلْتُ إِنَّ فُلَانًا طَلَّقَنِي وَإِنَّ أَخَاهُ أَخْرَجَنِي وَمَنَعَنِي السُّكْنَى وَالنَّفَقَةَ فَأَرْسَلَ إِلَيْهِ فَقَالَ مَا لَكَ وَلِابْنَةِ آلِ قَيْسٍ قَالَ يَا رَسُولَ اللَّهِ إِنَّ أَخِي طَلَّقَهَا ثَلَاثًا جَمِيعًا قَالَتْ فَقَالَ لِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ انْظُرِي أَيْ بِنْتَ آلِ قَيْسٍ إِنَّمَا النَّفَقَةُ وَالسُّكْنَى لِلْمَرْأَةِ عَلَى زَوْجِهَا مَا كَانَتْ لَهُ عَلَيْهَا رَجْعَةٌ فَإِذَا لَمْ يَكُنْ لَهُ عَلَيْهَا رَجْعَةٌ فَلَا نَفَقَةَ وَلَا سُكْنَى اخْرُجِي فَانْزِلِي عَلَى فُلَانَةَ ثُمَّ قَالَ إِنَّهُ يُتَحَدَّثُ إِلَيْهَا انْزِلِي عِنْدَ ابْنِ أُمِّ مَكْتُومٍ فَإِنَّهُ أَعْمَى لَا يَرَاكِ ثُمَّ قَالَ لَا تَنْكِحِي حَتَّى أَكُونَ أَنَا أُنْكِحُكِ قَالَتْ فَخَطَبَنِي رَجُلٌ مِنْ قُرَيْشٍ فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَسْتَأْمِرُهُ فَقَالَ أَلَا تَنْكِحِينَ مَنْ هُوَ أَحَبُّ إِلَيَّ مِنْهُ فَقُلْتُ بَلَى يَا رَسُولَ اللَّهِ فَأَنْكِحْنِي مَنْ أَحْبَبْتَ قَالَتْ فَأَنْكَحَنِي مِنْ أُسَامَةَ بْنِ زَيْدٍ زَادَ فِي رِوَايَةٍ فَنَكَحْتُهُ فَجَعَلَ اللَّهُ فِيهِ خَيْرًا كَثِيرًا هَذَا تَقَدَّمَ فِي الْبَابِ السَّابِقِ فِي حَدِيثِ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لَمْ يَأْذَنْ لِفَاطِمَةَ بِنْتِ قَيْسٍ بِالنَّفَقَةِ إِلَّا أَنْ تَكُونَ حَامِلًا
It is narrated from Amir Sha’bi, may Allah have mercy on him, who says: I came to Madinah Munawwarah and presented myself before Sayyidah Fatimah bint Qais, may Allah be pleased with her. She stated that my husband divorced me during the blessed era of the Messenger of Allah, peace and blessings be upon him. The Prophet, peace and blessings be upon him, had sent my husband with a military detachment. Later, my husband’s brother said: Now you must leave our house. I said: No, until my waiting period (‘iddah) is over, it is your responsibility to provide for my expenses and residence. He said: No, we are no longer responsible for anything. I presented myself before the Prophet, peace and blessings be upon him, and mentioned my husband by name, saying that he had divorced me and his brother had turned me out and stopped my maintenance and residence. The Prophet, peace and blessings be upon him, sent a message to him: Why do you not let the daughter of Al-Qais, i.e., Fatimah, stay? He said: O Messenger of Allah! My brother has given her a complete three divorces. The Prophet, peace and blessings be upon him, addressing Fatimah, said: O daughter of Al-Qais! Now see, maintenance and residence are the responsibility of that husband for the woman for whom he has the right to take her back (revocable divorce), and when the husband no longer has the right to take her back, then that husband is not responsible for her maintenance or residence. The Prophet, peace and blessings be upon him, said: Fatimah, now you leave this house and move to the house of such-and-such woman, i.e., Umm Sharik. But then the Prophet, peace and blessings be upon him, said: People sit and talk at her place, so you move to the house of Ibn Umm Maktum; he is a blind man, he will not be able to see you. Then the Prophet, peace and blessings be upon him, said: Do not marry, I myself will choose a companion for your journey. Sayyidah Fatimah, may Allah be pleased with her, says: A man from the Quraysh sent me a marriage proposal, and I presented myself before the Prophet, peace and blessings be upon him, to consult about him. The Prophet, peace and blessings be upon him, said: Why do you not marry the one who is dearer to me than this Quraysh man? I said: Why not, O Messenger of Allah! Marry me to whomever you love. Then the Prophet, peace and blessings be upon him, married me to Sayyiduna Usamah bin Zaid, may Allah be pleased with them both. In one narration, it is added that when I married Usamah, Allah Almighty created much goodness for me in it. In the hadith of Ubaydullah bin Abdullah, it has already been mentioned that the Prophet, peace and blessings be upon him, did not permit maintenance for Sayyidah Fatimah bint Qais, may Allah be pleased with her, and said that if she had been pregnant, then there would have been maintenance for her.
