Hadith 7175
عَنْ زُرَارَةَ بْنِ أَوْفَى عَنْ سَعْدِ بْنِ هِشَامٍ رَضِيَ اللَّهُ عَنْهُ أَنَّهُ طَلَّقَ امْرَأَتَهُ ثُمَّ ارْتَحَلَ إِلَى الْمَدِينَةِ لِيَبِيعَ عَقَارًا لَهُ بِهَا وَيَجْعَلَهُ فِي السِّلَاحِ وَالْكُرَاعِ ثُمَّ يُجَاهِدَ الرُّومَ حَتَّى يَمُوتَ فَلَقِيَ رَهْطًا مِنْ قَوْمِهِ فَحَدَّثُوهُ أَنَّ رَهْطًا مِنْ قَوْمِهِ سِتَّةً أَرَادُوا ذَلِكَ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ أَلَيْسَ لَكُمْ فِيَّ أُسْوَةٌ حَسَنَةٌ فَنَهَاهُمْ عَنْ ذَلِكَ فَأَشْهَدَهُمْ عَلَى رَجْعَتِهَا ثُمَّ رَجَعَ إِلَيْنَا فَأَخْبَرَنَا أَنَّهُ أَتَى ابْنَ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا فَسَأَلَهُ عَنِ الْوِتْرِ فَذَكَرَ حَدِيثًا طَوِيلًا جِدًّا
Narrated from Sayyiduna Sa'd bin Hisham (may Allah be pleased with him) that he divorced his wife, then traveled towards Madinah in order to sell his property there and spend it on buying weapons and horses, and to be martyred fighting against the Romans. During this time, he met some people from his tribe, who informed him that during the time of the Noble Prophet (peace and blessings be upon him), six individuals had expressed a similar intention, but the Prophet (peace and blessings be upon him) said to them, "Is there not an excellent example for you in me?" Then the Prophet (peace and blessings be upon him) forbade them from doing so. Upon hearing this, Sayyiduna Sa'd (may Allah be pleased with him) made them witnesses and said that he had taken his wife back. Then he came to us and informed us that he went to Sayyiduna Ibn Abbas (may Allah be pleased with them both) and asked him about Witr, then narrated a lengthy hadith.
Hadith 7176
عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا قَالَ سُئِلَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ عَنِ الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ ثَلَاثًا فَيَتَزَوَّجُهَا آخَرُ فَيُغْلِقُ الْبَابَ وَيُرْخِي السِّتْرَ ثُمَّ يُطَلِّقُهَا قَبْلَ أَنْ يَدْخُلَ بِهَا هَلْ تَحِلُّ لِلْأَوَّلِ قَالَ لَا حَتَّى يَذُوقَ الْعُسَيْلَةَ
It is narrated from Sayyiduna Abdullah bin Umar, may Allah be pleased with them both, that the Noble Prophet, peace and blessings be upon him, was asked about a man who has given his wife three divorces, then another man marries her, closes the door, and hangs the curtain (i.e., takes her into seclusion), but then divorces her without intercourse. Can this woman become lawful for her first husband? He, peace and blessings be upon him, said: No, she cannot become lawful until the second husband has intercourse with her and enjoys her.
Hadith 7177
عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا قَالَتْ سُئِلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ أَبِي وَلَمْ يَرْفَعْهُ يَعْلَى عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ فَتَزَوَّجَتْ زَوْجًا غَيْرَهُ فَدَخَلَ بِهَا ثُمَّ طَلَّقَهَا قَبْلَ أَنْ يُوَافِقَهَا أَتَحِلُّ لِزَوْجِهَا الْأَوَّلِ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لَا تَحِلُّ لِلْأَوَّلِ حَتَّى يَذُوقَ الْآخَرُ عُسَيْلَتَهَا وَتَذُوقَ عُسَيْلَتَهُ
Lady Aisha (may Allah be pleased with her) narrates that the Noble Prophet (peace and blessings be upon him) was asked about a man who gave his wife (three) divorces, then that woman married another man, then he went to her but divorced her before having intercourse. Can she now remarry her first husband? The Prophet (peace and blessings be upon him) said: That woman cannot remarry her first husband until the second husband and she mutually enjoy sexual relations.
Hadith 7178
وَعَنْ أَنَسِ بْنِ مَالِكٍ رَضِيَ اللَّهُ عَنْهُ بِنَحْوِهِ وَفِيهِ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لَا حَتَّى يَكُونَ الْآخَرُ ذَاقَ مِنْ عُسَيْلَتِهَا وَذَاقَتْ مِنْ عُسَيْلَتِهِ
Sayyiduna Anas bin Malik (may Allah be pleased with him) has also narrated a similar hadith, except that in it: The Noble Prophet (peace and blessings be upon him) said: No! Not until both of them establish sexual relations with each other and enjoy it.
Hadith 7179
عَنْ عُبَيْدِ اللَّهِ بْنِ الْعَبَّاسِ رَضِيَ اللَّهُ عَنْهُمَا قَالَ جَاءَتِ الْغُمَيْصَاءُ أَوِ الرُّمَيْصَاءُ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ تَشْكُو زَوْجَهَا وَتَزْعَمُ أَنَّهُ لَا يَصِلُ إِلَيْهَا فَمَا كَانَ إِلَّا يَسِيرًا حَتَّى جَاءَ زَوْجُهَا فَزَعَمَ أَنَّهَا كَاذِبَةٌ وَلَكِنَّهَا تُرِيدُ أَنْ تَرْجِعَ إِلَى زَوْجِهَا الْأَوَّلِ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لَيْسَ لَكِ ذَلِكَ حَتَّى يَذُوقَ عُسَيْلَتَكِ رَجُلٌ غَيْرُهُ
It is narrated from Sayyiduna Ubaydullah bin Abbas (may Allah be pleased with them both) that Ghamisa or Ramisa came to the Noble Prophet (peace and blessings be upon him) and complained about her husband, and she also gave the impression that her husband was unable to reach her (i.e., he was not capable of intercourse). After a short while, her husband also arrived and stated that she was being untruthful; her intention was to somehow return to her previous husband. The Noble Prophet (peace and blessings be upon him) said to the woman: You are not permitted to do so until another man enjoys you through marriage.
Hadith 7180
عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ الْعُسَيْلَةُ هِيَ الْجِمَاعُ
It is narrated from Sayyida Aisha (may Allah be pleased with her) that the Noble Prophet (peace and blessings be upon him) said: By "al-‘usaylah" is meant intercourse.
Hadith 7181
وَعَنْهَا أَيْضًا قَالَتْ دَخَلَتِ امْرَأَةُ رِفَاعَةَ الْقُرَظِيِّ وَأَنَا وَأَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ عِنْدَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَتْ إِنَّ رِفَاعَةَ طَلَّقَنِيَ الْبَتَّةَ وَإِنَّ عَبْدَ الرَّحْمَنِ بْنَ الزُّبَيْرِ تَزَوَّجَنِي وَإِنَّمَا عِنْدَهُ مِثْلُ هُدْبَةٍ وَأَخَذَتْ هُدْبَةً مِنْ جِلْبَابِهَا وَخَالِدُ بْنُ سَعِيدٍ بِالْبَابِ لَمْ يُؤْذَنْ لَهُ فَقَالَ يَا أَبَا بَكْرٍ أَلَا تَنْهَى هَذِهِ عَمَّا تَجْهَرُ بِهِ بَيْنَ يَدَيْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَمَا زَادَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ عَلَى التَّبَسُّمِ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ كَأَنَّكِ تُرِيدِينَ أَنْ تَرْجِعِي إِلَى رِفَاعَةَ لَا حَتَّى تَذُوقِي عُسَيْلَتَهُ وَيَذُوقَ عُسَيْلَتَكِ
Narrated from Sayyidah Aisha (may Allah be pleased with her) that the wife of Sayyiduna Rifa’ah Qarzi (may Allah be pleased with him) came while I and Sayyiduna Abu Bakr (may Allah be pleased with him) were also sitting with the Noble Prophet (peace and blessings be upon him). She said that Rifa’ah has given me an irrevocable divorce and I have married Sayyiduna Abdur Rahman bin Zubair (may Allah be pleased with him), but his private part is like the fringe of this garment of mine. Then she took hold of the fringe of her sheet to clarify. Meanwhile, Sayyiduna Khalid bin Sa’id (may Allah be pleased with him) was standing at the door; he had not yet been granted permission to enter. He said from outside: O Abu Bakr! Why do you not stop this woman? How can she speak in such an open manner before the Messenger of Allah (peace and blessings be upon him)? Upon this, the Noble Prophet (peace and blessings be upon him) merely smiled slightly and said nothing. Then he (peace and blessings be upon him) said: Is it your intention to return to Rifa’ah? No, absolutely not. You cannot go back to him until you have enjoyed intimacy with this husband and he has enjoyed intimacy with you.
Hadith 7182
عَنْ عَطَاءِ الْخُرَاسَانِيِّ عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا نَحْوَهُ وَزَادَ ثُمَّ جَاءَتْهُ بَعْدُ فَأَخْبَرَتْهُ أَنْ قَدْ مَسَّهَا فَمَنَعَهَا أَنْ تَرْجِعَ إِلَى زَوْجِهَا الْأَوَّلِ وَقَالَ اللَّهُمَّ إِنْ كَانَ إِيمَانُهُ أَنْ يُحِلَّهَا لِرِفَاعَةَ فَلَا يَتِمُّ لَهُ نِكَاحُهَا مَرَّةً أُخْرَى ثُمَّ أَتَتْ أَبَا بَكْرٍ وَعُمَرَ فِي خِلَافَتِهِمَا فَمَنَعَاهَا كِلَاهُمَا
A similar hadith is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both), except that it contains these additional words: Then that woman again came to the service of the Noble Prophet (peace and blessings be upon him) and said that her husband had intercourse with her, but even then the Prophet (peace and blessings be upon him) forbade her from returning to her first husband, and the Prophet (peace and blessings be upon him) prayed: O Allah! If the intention of this woman is only to make herself lawful for Rifa’ah, then do not let her second marriage be fulfilled. Afterwards, during the caliphate of Sayyiduna Abu Bakr Siddiq and Sayyiduna Umar bin Khattab (may Allah be pleased with them both), the woman came to them (for the same purpose), and both of them also forbade her.
Hadith 7183
عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا قَالَتْ طَلَّقَ رَجُلٌ امْرَأَتَهُ فَتَزَوَّجَتْ زَوْجًا غَيْرَهُ فَدَخَلَ بِهَا وَكَانَ مَعَهُ مِثْلُ الْهُدْبَةِ فَلَمْ يَقْرُبْهَا إِلَّا هَبَّةً وَاحِدَةً لَمْ يَصِلْ مِنْهَا إِلَى شَيْءٍ فَذَكَرَتْ ذَلِكَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَتْ أَحِلُّ لِزَوْجِي الْأَوَّلِ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لَا تَحِلِّينَ لِزَوْجِكِ الْأَوَّلِ حَتَّى يَذُوقَ الْآخَرُ عُسَيْلَتَكِ وَتَذُوقِي عُسَيْلَتَهُ
Narrated from Sayyida Aisha (may Allah be pleased with her) that a man gave his wife (three) divorces, she married another husband, he came to her, but his private part was like the fringe of a garment, he came near her only once and even then intercourse could not take place. That woman mentioned this matter to the Noble Prophet (peace and blessings be upon him) and said: Am I lawful for my first husband? The Noble Prophet (peace and blessings be upon him) said: You cannot be lawful for your first husband until the second husband enjoys you and you enjoy him.
