بَابُ النَّهْي عَنِ الطَّلَاقِ فِي الْحَيْضِ وَفِي الظُّهْرِ بعد أنْ يُجَامِعَهَا مَالَمْ بَين حَمْلُهَا

Chapter: Prohibition of Divorce During Menstruation and in Tuhr After Intercourse Unless She Is Pregnant

Hadith 7152
عَنْ أَنَسِ بْنِ سِيرِينَ عَنِ ابْنِ عُمَرَ قَالَ سَأَلْتُهُ عَنْ امْرَأَتِهِ الَّتِي طَلَّقَ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ طَلَّقْتُهَا وَهِيَ حَائِضٌ فَذَكَرْتُ ذَلِكَ لِعُمَرَ فَذَكَرَهُ عُمَرُ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((مُرْهُ فَلْيُرَاجِعْهَا فَإِذَا طَهُرَتْ طَلَّقَهَا فِي طُهْرِهَا لِلسُّنَّةِ)) قَالَ: فَفَعَلْتُ، قَالَ أَنَسٌ: فَسَأَلْتُهُ هَلْ اعْتَدَدْتَّ بِالَّتِي طَلَّقْتَهَا وَهِيَ حَائِضٌ؟ قَالَ وَمَا لِي لَا أَعْتَدُّ بِهَا إِنْ كُنْتُ عَجَزْتُ وَاسْتَحْمَقْتُ
It is narrated from Anas bin Sirin, he says: I asked Sayyiduna Ibn Umar (may Allah be pleased with them both) about his wife whom he had divorced during the time of the Messenger of Allah (peace and blessings be upon him). He said: I divorced her while she was in her menstrual period, then I informed Sayyiduna Umar (may Allah be pleased with him), and he mentioned this matter before the Noble Prophet (peace and blessings be upon him). The Prophet (peace and blessings be upon him) said: Order him to take her back, then when she becomes pure from her menstruation, he may divorce her in accordance with the Sunnah during a period of purity. I did exactly that. Anas bin Sirin said: I asked Ibn Umar (may Allah be pleased with them both) whether the divorce you gave during menstruation was counted. He said: Why would I not count it? If I became helpless and acted foolishly, (do you think that divorce would not be counted)?

Hadith 7153
عَنْ سَلَامٍ يَعْنِي ابْنَ عَبْدِ اللَّهِ عَنِ ابْنِ عُمَرَ أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَسَأَلَ عُمَرُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ: ((مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيُطَلِّقْهَا طَاهِرًا أَوْ حَامِلًا))
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that he divorced his wife while she was in her menstrual period. When Sayyiduna Umar (may Allah be pleased with him) asked the Noble Prophet (peace and blessings be upon him) about this, he (peace and blessings be upon him) said: Tell Ibn Umar to take her back, and then divorce her when she is in a state of purity or is pregnant.

Hadith 7154
عَنْ نَافِعٍ أَنَّ عَبْدَ اللَّهِ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ تَطْلِيقَةً وَاحِدَةً عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ، فَقَالَ عُمَرُ: يَا رَسُولَ اللَّهِ! إِنَّ عَبْدَ اللَّهِ طَلَّقَ امْرَأَتَهُ تَطْلِيقَةً وَاحِدَةً وَهِيَ حَائِضٌ فَأَمَرَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنْ يُرَاجِعَهَا وَيُمْسِكَهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ عِنْدَهُ حَيْضَةً أُخْرَى ثُمَّ يُمْهِلَهَا حَتَّى تَطْهُرَ مِنْ حَيْضَتِهَا، فَإِنْ أَرَادَ أَنْ يُطَلِّقَهَا فَلْيُطَلِّقْهَا حِينَ تَطْهُرُ قَبْلَ أَنْ يُجَامِعَهَا فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ تَعَالَى أَنْ يُطَلَّقَ لَهَا النِّسَاءُ، وَكَانَ عَبْدُ اللَّهِ إِذَا سُئِلَ عَنْ ذَلِكَ فَقَالَ لِأَحَدِهِمْ: أَمَّا أَنْتَ طَلَّقْتَ امْرَأَتَكَ مَرَّةً أَوْ مَرَّتَيْنِ، فَإِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَمَرَنِي بِهَا، فَإِنْ كُنْتَ طَلَّقْتَهَا ثَلَاثًا فَقَدْ حَرُمَتْ عَلَيْكَ حَتَّى تَنْكِحَ زَوْجًا غَيْرَكَ وَعَصَيْتَ اللَّهَ تَعَالَى فِيمَا أَمَرَكَ مِنْ طَلَاقِ امْرَأَتِكَ
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that he gave his wife a divorce while she was in her menstrual period. The Noble Prophet (peace and blessings be upon him) ordered him to take her back and keep her with him until she becomes pure, then when she gets her next period, and then becomes pure from it, then if he intends to divorce her, he should divorce her before having intercourse with her. This is the waiting period (iddah) regarding which Allah Almighty has commanded to give divorce. When Sayyiduna Abdullah (may Allah be pleased with him) was asked about this, he would say: Have you given your wife one or two divorces? As for me, the Noble Prophet (peace and blessings be upon him) ordered me to take her back. And if you have given your wife three divorces, then she has become unlawful for you. Now, for her to become lawful for you again, she must marry another man besides you. Yes, you have disobeyed Allah Almighty by giving divorce in an incorrect manner.

Hadith 7155
حَدَّثَنَا ابْنُ لَهِيعَةَ حَدَّثَنَا أَبُو الزُّبَيْرِ قَالَ سَأَلْتُ جَابِرًا عَنِ الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ وَهِيَ حَائِضٌ، فَقَالَ طَلَّقَ عَبْدُ اللَّهِ بْنُ عُمَرَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَأَتَى عُمَرُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَأَخْبَرَهُ ذَلِكَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((لِيُرَاجِعْهَا فَإِنَّهَا امْرَأَتُهُ))
Abu Zubair says: I asked Sayyiduna Jabir (may Allah be pleased with him) about the man who divorces his wife during her menstrual period. He said: Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) divorced his wife during her menstrual period, and Sayyiduna Umar (may Allah be pleased with him) came to the Prophet Muhammad (peace and blessings be upon him) and informed him about this divorce. The Prophet Muhammad (peace and blessings be upon him) said: Ibn Umar should take her back, because she is still his wife.

Hadith 7156
عَنِ ابْنِ جُرَيْجٍ أَخْبَرَنِي أَبُو الزُّبَيْرِ أَنَّهُ سَمِعَ عَبْدَ الرَّحْمٰنِ بْنَ أَيْمَنَ يَسْأَلُ ابْنَ عُمَرَ وَأَبُو الزُّبَيْرِ يَسْمَعُ فَقَالَ: كَيْفَ فِي رَجُلٍ طَلَّقَ إِمْرَأَتَهُ حَائِضًا؟ فَقَالَ: إِنَّ ابْنَ عُمَرَ طَلَّقَ إِمْرَأَتَهُ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ عُمَرُ: يَا رَسُولَ اللَّهِ! إِنَّ عَبْدَ اللَّهِ طَلَّقَ إِمْرَأَتَهُ وَهِيَ حَائِضٌ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((لِيُرَاجِعْهَا)) (عَلَيَّ وَلَمْ يَرَهُ شَيْئًا وَقَالَ فَرَدَّهَا) إِذَا طَهُرَتْ فَلْيُطَلِّقْ أَوْ يُمْسِكْ)) قَالَ ابْنُ عُمَرَ: وَقَرَأَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: {يَا أَيُّهَا النَّبِيُّ إِذَا طَلَّقْتُمُ النِّسَاءَ فَطَلِّقُوهُنَّ فِي قُبُلِ عِدَّتِهِنَّ} [الطلاق: 1] قَالَ ابْنُ جُرَيْجٍ: وَسَمِعْتُ مُجَاهِدًا يَقْرَؤُهَا كَذٰلِكَ
It is narrated from Abu Zubair, he says: Abdur Rahman bin Aiman was asking Sayyiduna Ibn Umar (may Allah be pleased with them both), while I was listening. He said: What is your opinion about the man who divorces his wife during her menstrual period? He said: I, Ibn Umar (may Allah be pleased with them both), divorced my wife in the same way during the time of the Prophet (peace and blessings be upon him). Sayyiduna Umar (may Allah be pleased with him) said: O Messenger of Allah! Abdullah has divorced his wife during her menstrual period. The Prophet (peace and blessings be upon him) said: He should take her back, then when she becomes pure, if he wishes he may divorce her or if he wishes he may keep her. In this way, the Prophet (peace and blessings be upon him) returned her to me and did not consider it anything. Then Sayyiduna Ibn Umar said that the Noble Prophet (peace and blessings be upon him) recited this verse: {یَا أیُّھَا النَّبِیُّ إِذَا طَلَقَّتُمُ النِّسَائَ فَطَلِّقُوْھُنَّ فِیْ قُبُلِ عِدَّتِہِنَّ} … O Prophet! When you divorce women, divorce them at the commencement of their waiting period. Ibn Jurayj says: I heard Mujahid recite this verse in the same way.
