بيان موانع النكاحExplanation of Impediments to Marriage
بَاب مَا جَاءَ فِي الزَّوْجَيْنِ الْكَافِرِين يُسْلِمُ أَحَدُهُمَا قبل الآخر
Chapter: What Has Been Reported Regarding Two Disbelieving Spouses, One of Whom Accepts Islam Before the Other
Hadith 7017
عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا قَالَ رَدَّ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ زَيْنَبَ ابْنَتَهُ عَلَى زَوْجِهَا أَبِي الْعَاصِ بْنِ الرَّبِيعِ رَضِيَ اللَّهُ عَنْهُ بِالنِّكَاحِ الْأَوَّلِ وَلَمْ يُحْدِثْ شَيْئًا
It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him and his family) entrusted his daughter Sayyida Zainab (may Allah be pleased with her) to her husband Sayyiduna Abu Al-As bin Rabi’ with the first marriage itself, and no new marriage was conducted.
Hadith 7018
(وَعَنْهُ مِنْ طَرِيقٍ ثَانٍ) أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ رَدَّ ابْنَتَهُ زَيْنَبَ عَلَى أَبِي الْعَاصِ بْنِ الرَّبِيعِ رَضِيَ اللَّهُ عَنْهُ وَكَانَ إِسْلَامُهَا قَبْلَ إِسْلَامِهِ بِسِتِّ سِنِينَ عَلَى النِّكَاحِ الْأَوَّلِ وَلَمْ يُحْدِثْ شَهَادَةً وَلَا صَدَاقًا
(Second chain) The Noble Prophet (peace and blessings be upon him and his family) returned his daughter, Sayyida Zainab (may Allah be pleased with her), to her husband, Sayyiduna Abu al-As ibn al-Rabi', with the original marriage contract, even though Sayyida had embraced Islam six years before her husband. The Prophet (peace and blessings be upon him and his family) neither required new witnesses nor demanded a new dowry.
Hadith 7019
عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ رَدَّ ابْنَتَهُ إِلَى أَبِي الْعَاصِ بْنِ الرَّبِيعِ رَضِيَ اللَّهُ عَنْهُ بِمَهْرٍ جَدِيدٍ وَنِكَاحٍ جَدِيدٍ
It is narrated from Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him and his family) returned his daughter to Sayyiduna Abu al-As with a new dowry and a new marriage contract.
