بَابُ اسْتِثْمَارِ النِّسَاءِ فِي بَنَاتِهِنَّ
Chapter: Seeking the Consent of Women Regarding Their Daughters
Hadith 6896
حَدَّثَنَا يُونُسُ بْنُ مُحَمَّدٍ ثَنَا لَيْثٌ عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ عَنْ إِبْرَاهِيمَ بْنِ صَالِحٍ وَاسْمُهُ الَّذِي يُعْرَفُ بِهِ نُعَيْمُ بْنُ النَّحَّامِ وَكَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ سَمَّاهُ صَالِحًا أَخْبَرَهُ أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا قَالَ لِعُمَرَ بْنِ الْخَطَّابِ اخْطُبْ عَلَى ابْنَةِ صَالِحٍ فَقَالَ إِنَّ لَهُ يَتَامَى وَلَمْ يَكُنْ لِيُؤْثِرَنَا عَلَيْهِمْ قَالَ فَانْطَلَقَ عَبْدُ اللَّهِ إِلَى عَمِّهِ زَيْدِ بْنِ الْخَطَّابِ لِيَخْطُبَ فَانْطَلَقَ زَيْدٌ إِلَى صَالِحٍ فَقَالَ إِنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ أَرْسَلَنِي إِلَيْكَ يَخْطُبُ ابْنَتَكَ فَقَالَ لِي يَتَامَى وَلَمْ أَكُنْ لِأَتْرِبَ لَحْمِي وَأَرْفَعَ لَحْمَكُمْ أُشْهِدُكُمْ أَنِّي قَدْ أَنْكَحْتُهَا فُلَانًا وَكَانَ هَوَى أُمِّهَا إِلَى عَبْدِ اللَّهِ بْنِ عُمَرَ فَأَتَتْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَتْ يَا نَبِيَّ اللَّهِ خَطَبَ عَبْدُ اللَّهِ بْنُ عُمَرَ ابْنَتِي فَأَنْكَحَهَا أَبُوهَا يَتِيمًا فِي حَجْرِهِ وَلَمْ يُؤَامِرْهَا فَأَرْسَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِلَى صَالِحٍ فَقَالَ أَنَكَحْتَ ابْنَتَكَ وَلَمْ تُؤَامِرْهَا فَقَالَ نَعَمْ فَقَالَ أَشِيرُوا عَلَى النِّسَاءِ فِي أَنْفُسِهِنَّ وَهِيَ بِكْرٌ فَقَالَ صَالِحٌ فَإِنَّمَا فَعَلْتُ هَذَا لِمَا يُصْدِقُهَا ابْنُ عُمَرَ فَإِنَّ لَهُ فِي مَالِي مِثْلَ مَا أَعْطَاهَا
Narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both), he says: I said to my father, Sayyiduna Umar (may Allah be pleased with him), “Send a proposal for the daughter of Salih.” Salih was known by the name Nu‘aim bin Nahham; the Messenger of Allah (peace and blessings be upon him) had named him Salih. He said, “There are orphan children under Salih’s care; he will not be willing to leave them, he will give them preference for marriage.” Hearing this, Sayyiduna Abdullah went to his uncle Zayd bin Khattab so that he could send the proposal. Thus, Zayd went to Salih and said, “Abdullah bin Umar (may Allah be pleased with them both) has sent me to you; he intends to marry your daughter.” He said, “There are orphan children under my care; I do not wish to dishonor myself and honor you. I make you a witness that I have married so-and-so to so-and-so.” However, the mother of that woman inclined towards Sayyiduna Abdullah bin Umar (may Allah be pleased with them both); she came to the Messenger of Allah (peace and blessings be upon him) and said, “O Messenger of Allah! Abdullah bin Umar (may Allah be pleased with them both) had sent a marriage proposal for my daughter, but Salih married her to an orphan under his care and did not consult me.” The Noble Prophet (peace and blessings be upon him) sent for Salih. When he came, the Prophet (peace and blessings be upon him) asked him, “Did you marry your daughter off without even consulting her mother?” He said, “Yes.” The Prophet (peace and blessings be upon him) said, “Consult these women.” While the girl is a virgin. Salih said, “I did this because the amount Ibn Umar (may Allah be pleased with them both) set for the dowry was equal to the orphan’s share from my wealth, so I gave preference to him.”
Hadith 6897
عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا أَنَّهُ خَطَبَ إِلَى نَسِيبٍ لَهُ ابْنَتَهُ قَالَ فَكَانَ هَوَى أُمِّ الْمَرْأَةِ فِي ابْنِ عُمَرَ وَكَانَ هَوَى أَبِيهَا فِي يَتِيمٍ لَهُ قَالَ فَزَوَّجَهَا الْأَبُ يَتِيمَهُ ذَلِكَ فَجَاءَتْ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَذَكَرَتْ ذَلِكَ لَهُ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ آمِرُوا النِّسَاءَ فِي بَنَاتِهِنَّ
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that he sent a marriage proposal for his close relative’s daughter through her lineage. The mother of the girl inclined towards Ibn Umar (may Allah be pleased with them both), but the father wished to marry her to an orphan under his care, so he married her to that orphan. Her mother came to the Noble Prophet (peace and blessings be upon him) and mentioned this matter to him. The Prophet (peace and blessings be upon him) said: Consult your women regarding the marriage of your daughters.
