Hadith 6877
حَدَّثَنَا إِسْمَاعِيلُ ثَنَا ابْنُ جُرَيْجٍ قَالَ: أَخْبَرَنِي سُلَيْمَانُ بْنُ مُوسَى عَنِ الزُّهْرِيِّ عَنْ عُرْوَةَ عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا قَالَتْ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((إِذَا نَكَحَتِ الْمَرْأَةُ بِغَيْرِ أَمْرِ مَوْلَاهَا فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ، فَإِنْ أَصَابَهَا فَلَهَا مَهْرُهَا بِمَا أَصَابَ مِنْهَا، فَإِنِ اشْتَجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ)) قَالَ ابْنُ جُرَيْجٍ: فَلَقِيتُ الزُّهْرِيَّ فَسَأَلْتُهُ عَنْ هَذَا الْحَدِيثِ فَلَمْ يَعْرِفْهُ قَالَ: وَكَانَ سُلَيْمَانُ بْنُ مُوسَى وَكَانَ فَأَثْنَى عَلَيْهِ، قَالَ عَبْدُ اللَّهِ: قَالَ أَبِي: السُّلْطَانُ الْقَاضِي لِأَنَّ إِلَيْهِ أَمْرَ الْفُرُوجِ وَالْأَحْكَامِ
Narrated from Sayyidah Aisha (may Allah be pleased with her) that the Noble Prophet (peace and blessings be upon him) said: When a woman marries without the permission of her guardian, her marriage is invalid, her marriage is invalid, her marriage is invalid. If the man has had intercourse with the woman, then due to that intercourse, he must give her the dowry. If they fall into dispute, then whoever has no guardian, the Sultan will be her guardian. Ibn Jurayj says: I met Imam Zuhri and asked him about this hadith, but he did not recognize this hadith. He said: And Sulaiman bin Musa, then he praised him. Abdullah says: My father, Imam Ahmad, said: By Sultan is meant the judge, because matters and rulings related to protection (of honor) are only presented in the court of the judge.
Hadith 6878
عَنِ ابْنِ عَبَّاسٍ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ: ((لَا نِكَاحَ إِلَّا بِوَلِيٍّ وَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ))
Narrated by Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both): The Noble Prophet (peace and blessings be upon him) said: There is no marriage without a guardian, and whoever has no guardian, the Sultan will be her guardian.
Hadith 6879
عَنْ أَبِي بُرْدَةَ عَنْ أَبِيهِ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((لَا نِكَاحَ إِلَّا بِوَلِيٍّ))
Narrated by Sayyiduna Abu Musa Ash'ari (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him and his family) said: There is no marriage except with a guardian.
Hadith 6880
عَنِ ابْنِ عَبَّاسٍ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ خَطَبَ مَيْمُونَةَ بِنْتَ الْحَارِثِ، فَجَعَلَتْ أَمْرَهَا إِلَى الْعَبَّاسِ فَزَوَّجَهَا النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ
Narrated by Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both): The Prophet Muhammad (peace and blessings be upon him) sent a proposal of marriage to Sayyida Maymunah bint Harith (may Allah be pleased with her). She entrusted the matter of her marriage to Sayyiduna Abbas (may Allah be pleased with him), and Sayyiduna Abbas (may Allah be pleased with him) married her to the Prophet (peace and blessings be upon him).
Hadith 6881
عَنْ عُقْبَةَ بْنِ عَامِرٍ رَضِيَ اللَّهُ عَنْهُ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ إِذَا أَنْكَحَ الْوَلِيَّانِ فَهُوَ لِلْأَوَّلِ مِنْهُمَا وَإِذَا بَاعَ مِنْ رَجُلَيْنِ فَهُوْ لِلْأَوَّلِ مِنْهُمَا قَالَ أَبِي وَقَالَ يُونُسُ وَإِذَا بَاعَ الرَّجُلُ بَيْعًا مِنْ رَجُلَيْنِ
It is narrated from Sayyiduna Uqbah bin Amir (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) said: When a woman is married off by two guardians, the marriage of the first guardian will be considered valid. Similarly, when a man sells an item to two men, it will belong to the first one. The words of the narrator Yunus are: When a man sells to two slaves.
Hadith 6882
عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُمَا أَيُّمَا عَبْدٍ تَزَوَّجَ بِغَيْرِ إِذْنِ مَوَالِيهِ أَوْ أَهْلِهِ فَهُوَ عَاهِرٌ
Narrated by Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them) that any slave who marries without the permission of his master or household will be considered an adulterer.
