بَابُ مَا جَاءَ فِي قَتْلِ الشَّارِبِ فِي الرَّابِعَةِ وَبَيَانِ نَسْخِهِ
Chapter: What Has Been Reported Regarding Killing the Drinker on the Fourth Time and Clarifying Its Abrogation
Hadith 6787
عَنْ عَبْدِ اللَّهِ بْنِ عَمْرِو بْنِ الْعَاصِ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ، فَإِنْ عَادَ فَاجْلِدُوهُ، فَإِنْ عَادَ فَاجْلِدُوهُ، فَإِنْ عَادَ فَاقْتُلُوهُ))، قَالَ وَكِيعٌ فِي حَدِيثِهِ: قَالَ عَبْدُ اللَّهِ: ائْتُونِي بِرَجُلٍ قَدْ شَرِبَ الْخَمْرَ فِي الرَّابِعَةِ فَلَكُمْ عَلَيَّ أَنْ أَقْتُلَهُ
Narrated by Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him) said: Whoever drinks alcohol, flog him. If he drinks again, then flog him again. If he drinks a third time, then flog him again. And if he drinks a fourth time, then kill him. Waki’ in his narration said that Abdullah said: Bring to me the man who has drunk alcohol a fourth time, it will be my responsibility to kill him.
Hadith 6788
عَنْ مُعَاوِيَةَ يَعْنِي ابْنَ أَبِي سُفْيَانَ قَالَ: سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ: ((مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ، فَإِنْ عَادَ فَاجْلِدُوهُ، فَإِنْ عَادَ فَاجْلِدُوهُ، فَإِنْ عَادَ الرَّابِعَةَ فَاقْتُلُوهُ))
Narrated by Sayyiduna Muawiyah bin Abi Sufyan (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him) said: Whoever drinks alcohol, administer the prescribed punishment to him. If he drinks again, then administer the punishment again. If he drinks yet again, then administer the punishment again. But if he drinks alcohol a fourth time, then kill him.
Hadith 6789
عَنْ شُرَحْبِيلَ بْنِ أَوْسٍ وَكَانَ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنَّهُ، قَالَ: قَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ، فَإِنْ عَادَ فَاجْلِدُوهُ، فَإِنْ عَادَ فَاجْلِدُوهُ، فَإِنْ عَادَ فَاقْتُلُوهُ))
It is narrated from the Companion of the Messenger, Sayyiduna Shurahbil bin Aws (may Allah be pleased with him), that the Noble Prophet (peace and blessings be upon him and his family) said: Whoever drinks alcohol, flog him; if he drinks again, then flog him again; if he drinks yet again, then enforce the prescribed punishment upon him; but if he still continues to drink alcohol, then you should kill him.
Hadith 6790
عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنَّهُ، قَالَ: ((مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ، فَإِنْ شَرِبَهَا فَاجْلِدُوهُ، فَإِنْ شَرِبَهَا فَاجْلِدُوهُ)) فَقَالَ فِي الرَّابِعَةِ أَوِ الْخَامِسَةِ: ((فَاقْتُلُوهُ))
Narrated by Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him) said: Whoever drinks alcohol, flog him. If he drinks again, then impose the hadd on him. If he drinks again, then impose the hadd on him. On the fourth or fifth time, he said: If he drinks again, then kill him.
Hadith 6791
عَنْ عَمْرِو بْنِ الشَّرِيدِ حَدَّثَهُ أَنَّ أَبَاهُ حَدَّثَهُ أَنَّهُ سَمِعَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ إِذَا شَرِبَ الرَّجُلُ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فَاجْلِدُوهُ أَرْبَعَ مِرَارٍ أَوْ خَمْسَ مِرَارٍ ثُمَّ إِذَا شَرِبَ فَاقْتُلُوهُ
It is narrated from Sayyiduna Shuraid (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: When a man drinks alcohol, flog him. If he drinks again, then flog him again. If he drinks again, then flog him again. The Prophet (peace and blessings be upon him) said this four or five times, and then said: If he drinks alcohol again, then kill him.
Hadith 6792
عَنْ أَبِي بِشْرٍ قَالَ سَمِعْتُ يَزِيدَ بْنَ أَبِي كَبْشَةَ يَخْطُبُ بِالشَّامِ قَالَ سَمِعْتُ رَجُلًا مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يُحَدِّثُ عَبْدَ الْمَلِكِ بْنَ مَرْوَانَ فِي الْخَمْرِ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ فِي الْخَمْرِ إِنْ شَرِبَهَا فَاجْلِدُوهُ ثُمَّ إِنْ عَادَ فَاجْلِدُوهُ ثُمَّ إِنْ عَادَ فَاجْلِدُوهُ ثُمَّ إِنْ عَادَ الرَّابِعَةَ فَاقْتُلُوهُ
Abu Bishr says: I heard Yazid bin Abi Kabsha, he was delivering a sermon in Syria, during which he said: I heard from a companion of the Noble Prophet (peace and blessings be upon him), he was telling Abdul Malik bin Marwan about wine that the Noble Prophet (peace and blessings be upon him) said regarding wine: If a man drinks wine, then flog him; if he drinks again, then flog him again; if he drinks a third time, then flog him; if he drinks a fourth time, then kill him.
Hadith 6793
عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فِي الرَّابِعَةِ فَاقْتُلُوهُ
It is narrated from Sayyiduna Abu Hurairah, may Allah be pleased with him, that the Messenger of Allah, peace and blessings be upon him, said: Whoever drinks alcohol, flog him. Then if he drinks alcohol again, flog him. Then if he drinks alcohol again, flog him. If he drinks alcohol a fourth time, then kill him.
Hadith 6794
عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِنْ سَكِرَ فَاجْلِدُوهُ ثُمَّ إِنْ سَكِرَ فَاجْلِدُوهُ فَإِنْ عَادَ فِي الرَّابِعَةِ فَاضْرِبُوا عُنُقَهُ قَالَ الزُّهْرِيُّ فَأُتِيَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِرَجُلٍ سَكْرَانَ فِي الرَّابِعَةِ فَخَلَّى سَبِيلَهُ
(Second chain) The Noble Prophet, peace and blessings be upon him, said: If someone drinks alcohol, administer the prescribed punishment to him; then if he drinks again, administer the prescribed punishment to him; if he drinks a fourth time, then behead him. Imam Zuhri says that a man was brought to the Messenger of Allah, peace and blessings be upon him, for the fourth time, and he was intoxicated, but you let him go.
