Hadith 6759
عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ فِي الْحَرِيسَةِ الَّتِي تُوجَدُ فِي مَرَاتِعِهَا وَقَدْ سُئِلَ عَنْهَا قَالَ فِيهَا ثَمَنُهَا مَرَّتَيْنِ وَضَرْبُ نَكَالٍ وَمَا أُخِذَ مِنْ عَطَنِهِ فَفِيهِ الْقَطْعُ إِذَا بَلَغَ مَا يُؤْخَذُ مِنْ ذَلِكَ ثَمَنَ الْمِجَنِّ قَالَ يَا رَسُولَ اللَّهِ فَالثِّمَارُ وَمَا أُخِذَ مِنْهَا فِي أَكْمَامِهَا قَالَ مَنْ أَخَذَ بِفِيهِ وَلَمْ يَتَّخِذْ خُبْنَةً فَلَيْسَ عَلَيْهِ شَيْءٌ وَمَنِ احْتَمَلَ فَعَلَيْهِ ثَمَنُهُ مَرَّتَيْنِ وَضَرْبٌ نَكَالٌ وَمَا أُخِذَ مِنْ أَجْرَانِهِ فَفِيهِ الْقَطْعُ إِذَا بَلَغَ مَا يُؤْخَذُ مِنْ ذَلِكَ ثَمَنَ الْمِجَنِّ
It is narrated from Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him) was asked about a protected animal that was in its pasture. He (peace and blessings be upon him) said: In its theft, double the price will be taken and the thief will also be punished. And if an animal is stolen from the enclosure, the hand will be cut off, provided that it is equal to the price of a shield. The questioner said: O Messenger of Allah! What is the ruling regarding those fruits that are stolen from the cluster or the bud? He (peace and blessings be upon him) said: Whoever only eats and does not take it away in his garment, there is no punishment upon him. And whoever takes it away in his garment, he will have to pay double its price and will also be beaten and punished. And if dates are stolen from a protected place like a threshing floor, the hand will be cut off, provided that it reaches the price of a shield.
Hadith 6760
عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُمَا قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لَيْسَ عَلَى الْمُنْتَهِبِ قَطْعٌ وَمَنِ انْتَهَبَ نُهْبَةً مَشْهُورَةً فَلَيْسَ مِنَّا وَقَالَ لَيْسَ عَلَى الْخَائِنِ قَطْعٌ
It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them) that the Noble Prophet (peace and blessings be upon him) said: There is no punishment of cutting the hand for a bandit, and whoever commits highway robbery openly is not from among us. Also, the Prophet (peace and blessings be upon him) said: There is no punishment of cutting the hand for the one who commits treachery.
Hadith 6761
عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا قَالَ كَانَتْ مَخْزُومِيَّةٌ تَسْتَعِيرُ الْمَتَاعَ وَتَجْحَدُهُ فَأَمَرَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِقَطْعِهَا
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that a woman from the Makhzum tribe used to borrow goods and then deny it. The Noble Prophet (peace and blessings be upon him) ordered her hand to be cut off.
Hadith 6762
عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ رَضِيَ اللَّهُ عَنْهُ قَالَ سَرَقَ غُلَامٌ لِنُعْمَانَ الْأَنْصَارِيِّ نَخْلًا صِغَارًا فَرُفِعَ إِلَى مَرْوَانَ فَأَرَادَ أَنْ يَقْطَعَهُ فَقَالَ رَافِعُ بْنُ خَدِيجٍ رَضِيَ اللَّهُ عَنْهُ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لَا يُقْطَعُ فِي الثَّمَرِ وَلَا فِي الْكَثَرِ قَالَ قُلْتُ لِيَحْيَى مَا الْكَثَرُ قَالَ الْجُمَّارُ
Muhammad bin Yahya bin Haban narrates that a slave of Sayyiduna Nu'man Ansari (may Allah be pleased with him) stole some small dates. When his case was presented in the court of Marwan, he intended to cut off the thief's hand. But Sayyiduna Rafi' bin Khadij (may Allah be pleased with him) said that the Noble Prophet (peace and blessings be upon him) said: "The hand will not be cut off for stealing fruit and the gum of the date palm tree." I asked Yahya: What is meant by "kathar"? He said: "Jummar" (the gum of the date palm tree).
