Hadith 6742
عَنْ أَبِي هُرَيْرَةَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ: ((إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ (زَادَ فِي رِوَايَةٍ: فَتَبَيَّنَ زِنَاهَا) فَلْيَجْلِدْهَا وَلَا يُعَيِّرْهَا، فَإِنْ عَادَتْ فَلْيَجْلِدْهَا وَلَا يُعَيِّرْهَا، فَإِنْ عَادَتْ فَلْيَجْلِدْهَا وَلَا يُعَيِّرْهَا، فَإِنْ عَادَتْ فِي الرَّابِعَةِ فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعْرٍ أَوْ ضَفِيرٍ مِنْ شَعْرٍ))
Narrated from Sayyiduna Abu Huraira (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: When any of you has a slave-girl who commits adultery and her adultery becomes evident, he should impose the prescribed punishment on her and not disgrace her. Then if she commits the same crime again, he should flog her, but not disgrace her. If she commits adultery again, he should impose the prescribed punishment on her and not disgrace her. If she commits adultery a fourth time, then he should sell that slave-girl, even if he has to sell her for a rope of hair or a few braided hairs.
Hadith 6743
عَنْ أَبِي عَبْدِ الرَّحْمَنِ السُّلَمِيِّ قَالَ: خَطَبَ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ قَالَ: يَا أَيُّهَا النَّاسُ! أَقِيمُوا عَلَى أَرِقَّائِكُمُ الْحُدُودَ، مَنْ أُحْصِنَ مِنْهُمْ وَمَنْ لَمْ يُحْصَنْ، فَإِنَّ أَمَةً لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ زَنَتْ فَأَمَرَنِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنْ أُقِيمَ عَلَيْهَا الْحَدَّ فَأَتَيْتُهَا فَإِذَا هِيَ حَدِيثُ عَهْدٍ بِنِفَاسٍ فَخَشِيتُ إِنْ أَنَا جَلَدْتُهَا أَنْ تَمُوتَ فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ: ((أَحْسَنْتَ))
It is narrated from Abu Abdur Rahman Salmi, he says: Sayyiduna Ali (may Allah be pleased with him) addressed and said: O people! Establish the prescribed punishments on your slave women and slaves, whether they are married or unmarried, because a slave woman of the Noble Prophet (peace and blessings be upon him) committed adultery, and he (peace and blessings be upon him) ordered me to establish the prescribed punishment on her. But when I went to her, I found her in such a state that her postnatal bleeding had just started, so I feared that if I flogged her, she might die. So I presented myself before the Noble Prophet (peace and blessings be upon him) and informed him of these details. He (peace and blessings be upon him) said: You did well.
Hadith 6744
عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ وَشَبْلٍ قَالُوا: سُئِلَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ عَنِ الْأَمَةِ تَزْنِي قَبْلَ أَنْ تُحْصَنَ؟ قَالَ: ((اجْلِدُوهَا، فَإِنْ عَادَتْ فَاجْلِدُوهَا، فَإِنْ عَادَتْ فَاجْلِدُوهَا، فَإِنْ عَادَتْ فَبِيعُوهَا وَلَوْ بِضَفِيرٍ))
It is narrated from Sayyiduna Abu Hurairah, Sayyiduna Zaid bin Khalid, and Sayyiduna Shibl (may Allah be pleased with them) that the Noble Prophet (peace and blessings be upon him) was asked about a slave-girl who commits fornication before marriage. He (peace and blessings be upon him) said: Impose the hadd (prescribed punishment) on her; if she commits the evil again, then impose the hadd again; if she commits the crime a third time, then impose the hadd again; and if she commits fornication after that, then sell her, even if it is in exchange for a rope.
Hadith 6745
عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ: ((إِذَا زَنَتِ الْأَمَةُ فَاجْلِدُوهَا، وَإِذَا زَنَتْ فَاجْلِدُوهَا، وَإِذَا زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ)) وَالضَّفِيرُ الْحَبْلُ
Narrated by Sayyidah Aisha (may Allah be pleased with her) that the Noble Prophet (peace and blessings be upon him) said: When a slave-girl commits adultery, flog her; if she commits adultery a second time, then flog her again; and if she falls into this crime again, then flog her and sell her, even if you have to sell her for a rope. The meaning of "dhafeer" is rope.
Hadith 6746
حَدَّثَنَا يَعْقُوبُ ثَنَا ابْنُ أَخِي ابْنِ شِهَابٍ عَنْ عَمِّهِ قَالَ: أَخْبَرَنِي عُبَيْدُ اللَّهِ بْنُ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ أَنَّ شِبْلَ بْنَ حَامِدٍ الْمُزَنِيَّ أَخْبَرَهُ أَنَّ عَبْدَ اللَّهِ بْنَ مَالِكٍ الْأَوْسِيَّ أَخْبَرَهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ لِلْوَلِيدَةِ: ((إِنْ زَنَتْ فَاجْلِدُوهَا، ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا، ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا، ثُمَّ إِنْ زَنَتْ فَبِيعُوهَا وَلَوْ بِضَفِيرٍ (وَالضَّفِيرُ الْحَبْلُ) فِي الثَّالِثَةِ أَوْ فِي الرَّابِعَةِ))
It is narrated from Sayyiduna Abdullah bin Malik Awsi (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) said regarding a slave-girl: If she commits adultery, then flog her; if she commits adultery again, then flog her again; if she commits adultery a third time, then enforce the prescribed punishment on her; if she commits adultery even after that, then sell her, even if you have to sell her for a rope. The mention of selling was for the third or fourth time.
