بَابُ مَا جَاءَ فِي رَجْمِ الزَّانِي الْمُحْصَنِ مِنْ أَهْلِ الْكِتَابِ وَأَنَّ الْإِسْلَامَ لَيْسَ بِشَرْطٍ فِي الْإِحْصَانِ

Chapter: What Has Been Reported Regarding Stoning the Married Adulterer from the People of the Book and That Islam Is Not a Condition for Ihsan

Hadith 6735
عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ الْيَهُودَ أَتَوْا النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِرَجُلٍ وَامْرَأَةٍ مِنْهُمْ قَدْ زَنَيَا فَقَالَ مَا تَجِدُونَ فِي كِتَابِكُمْ فَقَالُوا نُسَخِّمُ وُجُوهَهُمَا وَيُخْزَيَانِ قَالَ كَذَبْتُمْ إِنَّ فِيهَا الرَّجْمَ فَأْتُوا بِالتَّوْرَاةِ فَاتْلُوهَا إِنْ كُنْتُمْ صَادِقِينَ فَجَاءُوا بِالتَّوْرَاةِ وَجَاءُوا بِقَارِئٍ لَهُمْ أَعْوَرَ يُقَالُ لَهُ ابْنُ صُورِيَا فَقَرَأَ حَتَّى إِذَا انْتَهَى إِلَى مَوْضِعٍ مِنْهَا وَضَعَ يَدَهُ عَلَيْهِ فَقِيلَ لَهُ ارْفَعْ يَدَكَ فَرَفَعَ يَدَهُ فَإِذَا هِيَ تَلُوحُ فَقَالَ أَوْ قَالُوا يَا مُحَمَّدُ إِنَّ فِيهَا الرَّجْمَ وَلَكِنَّا كُنَّا نَتَكَاتَمُهُ بَيْنَنَا فَأَمَرَ بِهِمَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَرُجِمَا قَالَ فَلَقَدْ رَأَيْتُهُ يَجَانِئُ عَلَيْهَا يَقِيهَا الْحِجَارَةَ بِنَفْسِهِ
Narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Jews brought a man and a woman to the Prophet Muhammad (peace and blessings be upon him); they had committed adultery. The Prophet (peace and blessings be upon him) asked: "What ruling do you find in your Book regarding this?" They said: "We blacken their faces and disgrace them." The Prophet (peace and blessings be upon him) said: "You are lying; in it there is the command of stoning. Bring the Torah and read it, if you are truthful." So they brought the Torah and a reader; the reader was one-eyed and was called Ibn Suriya. He read the Torah and continued reading until he reached the mention of stoning. When he reached that place, he placed his hand over that verse. He was told: "Lift your hand." When he lifted his hand, the verse regarding stoning was shining forth. Then they admitted and said: "O Muhammad! The punishment of stoning is present in it, but we were concealing it among ourselves." Then the Prophet (peace and blessings be upon him) ordered both of them to be stoned, so they were stoned. Ibn Umar (may Allah be pleased with them both) said: "I saw that Jew leaning over the woman, shielding her with his own body from the stones."

Hadith 6736
عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا قَالَ أَمَرَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِرَجْمِ الْيَهُودِيِّ وَالْيَهُودِيَّةِ عِنْدَ بَابِ مَسْجِدٍ فَلَمَّا وَجَدَ الْيَهُودِيُّ مَسَّ الْحِجَارَةِ قَامَ عَلَى صَاحِبَتِهِ فَحَنَا عَلَيْهَا يَقِيهَا مَسَّ الْحِجَارَةِ حَتَّى قُتِلَا جَمِيعًا فَكَانَ مِمَّا صَنَعَ اللَّهُ عَزَّ وَجَلَّ لِرَسُولِهِ فِي تَحْقِيقِ الزِّنَا مِنْهُمَا
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him) ordered a Jewish man and a Jewish woman to be stoned near the door of his mosque. When the Jew felt the pain of the stones, he stood up and leaned over his companion in order to shield her from the pain of the stones, until both of them were killed. Whatever Allah Almighty did for His Messenger was to establish the proof of adultery against both of them.

Hadith 6737
عَنِ الْبَرَاءِ بْنِ عَازِبٍ رَضِيَ اللَّهُ عَنْهُ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ رَجَمَ يَهُودِيًّا وَقَالَ اللَّهُمَّ إِنِّي أُشْهِدُكَ أَنِّي أَوَّلُ مَنْ أَحْيَا سُنَّةً قَدْ أَمَاتُوهَا
Narrated by Sayyiduna Bara’ bin Azib (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) stoned a Jew and then said: O Allah! I make You a witness that I am the first person who revived this Sunnah which these people had obliterated.

حَدَّثَنَا عَبْدُ اللَّهِ حَدَّثَنِي عُثْمَانُ بْنُ مُحَمَّدِ بْنِ أَبِي شَيْبَةَ ثَنَا شَرِيكُ بْنُ عَبْدِ اللَّهِ عَنْ سِمَاكِ بْنِ حَرْبٍ عَنْ جَابِرِ بْنِ سَمُرَةَ رَضِيَ اللَّهُ عَنْهُ وَابْنِ أَبِي لَيْلَى عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا قَالَا رَجَمَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَهُودِيًّا وَيَهُودِيَّةً
It is narrated from Sayyiduna Jabir bin Samurah and Sayyiduna Ibn Umar (may Allah be pleased with them) that the Noble Prophet (peace and blessings be upon him) stoned a Jewish man and a Jewish woman.

Hadith 6739
حَدَّثَنَا هُشَيْمٌ قَالَ الشَّيْبَانِيُّ أَخْبَرَنِي قَالَ قُلْتُ لِابْنِ أَبِي أَوْفَى رَضِيَ اللَّهُ عَنْهُ رَجَمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ نَعَمْ يَهُودِيًّا وَيَهُودِيَّةً قَالَ قُلْتُ بَعْدَ نُزُولِ النُّورِ أَوْ قَبْلَهَا قَالَ لَا أَدْرِي
It is narrated from Shaibani, he says: I asked Sayyiduna Ibn Abi Awfa (may Allah be pleased with him): Did the Noble Prophet (peace and blessings be upon him) ever carry out stoning (rajm)? He said: Yes, the Prophet (peace and blessings be upon him) stoned a Jewish man and a Jewish woman. I asked: Was it before or after the revelation of Surah An-Nur? He replied: I do not know about that.
