بَاب مَا جَاءَ فِي مَنْ وَطِئَ جَارِيَةَ امْرَأَتِهِ
Chapter: What Has Been Reported Regarding One Who Had Intercourse with His Wife's Slave Girl
Hadith 6726
حَدَّثَنَا بَهْزٌ ثَنَا أَبَانُ بْنُ يَزِيدَ وَهُوَ الْعَطَّارُ ثَنَا قَتَادَةُ حَدَّثَنِي خَالِدُ بْنُ عُرْفُطَةَ عَنْ حَبِيبِ بْنِ سَالِمٍ عَنِ النُّعْمَانِ بْنِ بَشِيرٍ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَجُلًا يُقَالُ لَهُ عَبْدُ الرَّحْمَنِ بْنُ حُنَيْنٍ وَكَانَ يُنْبَزُ قُرْقُورًا وَقَعَ عَلَى جَارِيَةِ امْرَأَتِهِ قَالَ فَرُفِعَ إِلَى النُّعْمَانِ بْنِ بَشِيرٍ الْأَنْصَارِيِّ رَضِيَ اللَّهُ عَنْهُ فَقَالَ لَأَقْضِيَنَّ فِيكَ بِقَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِنْ كَانَتْ أَحَلَّتْهَا لَكَ جَلَدْتُكَ مِائَةً وَإِنْ لَمْ تَكُنْ أَحَلَّتْهَا لَكَ رَجَمْتُكَ بِالْحِجَارَةِ قَالَ وَكَانَتْ قَدْ أَحَلَّتْهَا لَهُ فَجَلَدَهُ مِائَةً وَقَالَ سَمِعْتُ أَبَانًا يَقُولُ وَأَخْبَرَنَا قَتَادَةُ أَنَّهُ كَتَبَ فِيهِ إِلَى حَبِيبِ بْنِ سَالِمٍ وَكَتَبَ إِلَيْهِ بِهَذَا
It is narrated from Sayyiduna Nu’man bin Bashir (may Allah be pleased with him) that there was a man named Abdur Rahman bin Haneen, who was called by the nickname Qarqoor. He committed adultery with his wife’s slave-girl. When his case was brought before Sayyiduna Nu’man bin Bashir (may Allah be pleased with him), he said: “I will judge between you as the Messenger of Allah (peace and blessings be upon him) judged. If your wife had made this slave-girl lawful for you, then I will give you one hundred lashes, and if she had not made her lawful for you, then I will stone you to death.” Upon investigation, it was found that his wife had indeed made her slave-girl lawful for him, so he gave him one hundred lashes.
Hadith 6727
حَدَّثَنَا هُثَيْمٌ عَنْ أَبِي بِشْرٍ عَنْ حَبِيبِ بْنِ سَالِمٍ عَنِ النُّعْمَانِ بْنِ بَشِيرٍ رَضِيَ اللَّهُ عَنْهُ قَالَ أَتَتْهُ امْرَأَةٌ فَقَالَتْ إِنَّ زَوْجَهَا وَقَعَ عَلَى جَارِيَتِهَا قَالَ أَمَّا إِنَّ عِنْدِي فِي ذَلِكَ خَبَرًا شَافِيًا أَخَذْتُهُ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِنْ كُنْتِ أَذِنْتِ لَهُ ضَرَبْتُهُ مِائَةً وَإِنْ كُنْتِ لَمْ تَأْذَنِي لَهُ رَجَمْتُهُ قَالَ فَأَقْبَلَ النَّاسُ عَلَيْهَا فَقَالُوا زَوْجُكِ يُرْجَمُ قُولِي إِنَّكِ قَدْ كُنْتِ أَذِنْتِ لَهُ فَقَالَتْ قَدْ كُنْتُ أَذِنْتُ لَهُ فَقَدَّمَهُ فَضَرَبَهُ مِائَةً
Narrated from Sayyiduna Nu’man bin Bashir (may Allah be pleased with him) that a woman came to him and said: My husband has committed adultery with my slave-girl. He said: I have a satisfactory hadith about this, which I have obtained from the Noble Prophet (peace and blessings be upon him): If you had given him permission, I will give him a hundred lashes, and if you had not given him permission, I will stone him. Upon hearing this, people went to the woman and said: Your husband is about to be stoned, so you should say that you had given him permission. So she said: I had given my husband permission. Then he brought him forward and gave him a hundred lashes.
Hadith 6728
حَدَّثَنَا عَلِيُّ بْنُ عَاصِمٍ عَنْ خَالِدٍ الْحَذَّاءِ عَنْ حَبِيبِ بْنِ سَالِمٍ عَنِ النُّعْمَانِ بْنِ بَشِيرٍ رَضِيَ اللَّهُ عَنْهُ قَالَ جَاءَتِ امْرَأَةٌ إِلَى النُّعْمَانِ بْنِ بَشِيرٍ رَضِيَ اللَّهُ عَنْهُ فَذَكَرَ نَحْوَهُ
Narrated from Sayyiduna Nu’man bin Bashir (may Allah be pleased with him) that a woman came to him, … … , then he narrated the report similar to the above-mentioned hadith.
Hadith 6729
عَنْ سَلَمَةَ بْنِ الْمُحَبِّقِ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَجُلًا وَقَعَ عَلَى جَارِيَةِ امْرَأَتِهِ وَفِي لَفْظٍ أَنَّ رَجُلًا خَرَجَ فِي غَزَاةٍ وَمَعَهُ جَارِيَةٌ لِامْرَأَتِهِ فَوَقَعَ بِهَا فَرُفِعَ ذَلِكَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ إِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لَهُ وَعَلَيْهِ مِثْلُهَا لَهَا وَإِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ مِثْلُهَا لَهَا
It is narrated from Sayyiduna Salamah bin Muhabbaq (may Allah be pleased with him) that a man committed adultery with his wife's slave-girl. In another narration, it is mentioned: A man went on an expedition, and his wife's slave-girl was with him; he had intercourse with her. When his case was brought before the court of the Noble Prophet (peace and blessings be upon him), he said: If the slave-girl consented with the man, then the slave-girl will belong to him, and he must give a similar slave-girl to his wife. But if he forced the slave-girl, then she will be set free, but he must still give a similar slave-girl to his wife.
Hadith 6730
(وَعَنْهُ مِنْ طَرِيقٍ ثَانٍ) قَالَ قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فِي رَجُلٍ وَطِئَ جَارِيَةَ امْرَأَتِهِ إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا
(Second chain of narration) Regarding the man who committed an immoral act with his wife's slave-girl, the Messenger of Allah, peace and blessings be upon him, gave this ruling: if he forced the slave-girl, then she will be set free, but it is his responsibility to give her master another slave-girl of the same kind.
