باب فِيمَا يُذْكَرُ فِي الرُّجُوعِ عَنِ الْإِقْرَارِ وَمَنْ أَقَرَّ أَنَّهُ زَنٰي بِإِمْرَأَةٍ فَجَحَدَتْ
Chapter: Regarding Retracting a Confession and One Who Confessed to Adultery with a Woman but She Denied
Hadith 6711
عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُمَا قَالَ كُنْتُ فِيمَنْ رَجَمَ الرَّجُلَ يَعْنِي مَاعِزًا إِنَّا لَمَّا رَجَمْنَاهُ وَجَدَ مَسَّ الْحِجَارَةِ فَقَالَ أَيْ قَوْمِ رُدُّونِي إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَإِنَّ قَوْمِي قَتَلُونِي وَغَرُّونِي مِنْ نَفْسِي وَقَالُوا إِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ غَيْرُ قَاتِلِكَ قَالَ فَلَمْ نَنْزَعْ عَنْهُ حَتَّى فَرَغْنَا مِنْهُ قَالَ فَلَمَّا رَجَعْنَا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ ذَكَرْنَا لَهُ قَوْلَهُ فَقَالَ أَلَا تَرَكْتُمُ الرَّجُلَ وَجِئْتُمُونِي بِهِ إِنَّمَا أَرَادَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنْ يَتَثَبَّتَ فِي أَمْرِهِ
Narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them), he says: I was among those people who stoned Ma'iz. When we stoned him and he felt the pain of the stones, he said: O people! Take me back to the Messenger of Allah (peace and blessings be upon him), for my people have killed me, they have deceived me. The people said: Surely, the Messenger of Allah is not one to kill you. So we did not refrain from it until we finished stoning him. Then when we returned to the Messenger of Allah (peace and blessings be upon him) and narrated his words to him, he (peace and blessings be upon him) said: Why did you not leave him and bring him to me? In fact, the Messenger of Allah (peace and blessings be upon him) intended to further investigate his matter.
Hadith 6712
عَنْ أَبِي الْهَيْثَمِ بْنِ نَصْرِ بْنِ دَهْرٍ الْأَسْلَمِيِّ عَنْ أَبِيهِ رَضِيَ اللَّهُ عَنْهُ قَالَ أَتَى مَاعِزُ بْنُ خَالِدِ بْنِ مَالِكٍ رَجُلٌ مِنَّا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَاسْتَوْدَى عَلَى نَفْسِهِ بِالزِّنَا فَأَمَرَنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِرَجْمِهِ فَخَرَجْنَا إِلَى حَرَّةِ بَنِي نِيَارٍ فَرَجَمْنَاهُ فَلَمَّا وَجَدَ مَسَّ الْحِجَارَةِ جَزِعَ جَزَعًا شَدِيدًا فَلَمَّا فَرَغْنَا مِنْهُ وَرَجَعْنَا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ ذَكَرْنَا لَهُ جَزَعَهُ فَقَالَ هَلَّا تَرَكْتُمُوهُ
Narrated from Nasr bin Dahraslami, he says: A man from our tribe, Ma'iz bin Khalid bin Malik, went to the Noble Prophet (peace and blessings be upon him) and confessed to adultery. The Noble Messenger (peace and blessings be upon him) ordered us to stone him. So we took him to Harrah Bani Niyar and stoned him. When he felt the pain of the stones, he became extremely restless. Then, when we finished stoning him and returned to the Noble Prophet (peace and blessings be upon him) and mentioned his restlessness to him, the Noble Prophet (peace and blessings be upon him) said: Why did you not let him go?
Hadith 6713
عَنْ عَبْدِ الْعَزِيزِ بْنِ عَبْدِ اللَّهِ بْنِ عَمْرٍو الْقُرَشِيِّ رَضِيَ اللَّهُ عَنْهُ قَالَ حَدَّثَنِي مَنْ شَهِدَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَأَمَرَ بِرَجْمِ رَجُلٍ بَيْنَ مَكَّةَ وَالْمَدِينَةِ فَلَمَّا أَصَابَتْهُ الْحِجَارَةُ فَرَّ وَفِي لَفْظٍ فَلَمَّا وَجَدَ مَسَّ الْحِجَارَةِ خَرَجَ فَهَرَبَ فَبَلَغَ ذَلِكَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ فَهَلَّا تَرَكْتُمُوهُ
Abdul Aziz bin Abdullah Quraishi says: The person who was present with the Noble Prophet (peace and blessings be upon him) narrated to me, the Prophet (peace and blessings be upon him) was between Makkah and Madinah when he ordered a man to be stoned. When stones struck him, he ran away. In another narration: When he felt the pain of the stones, he got up and ran away. When this matter reached the Noble Prophet (peace and blessings be upon him), he said: Why did you not let him go?
Hadith 6714
عَنْ سَهْلِ بْنِ سَعْدٍ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَجُلًا مِنْ أَسْلَمَ جَاءَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ إِنَّهُ زَنَى بِامْرَأَةٍ سَمَّاهَا فَأَرْسَلَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِلَى الْمَرْأَةِ فَدَعَاهَا فَسَأَلَهَا عَمَّا قَالَ فَأَنْكَرَتْ فَحَدَّهُ وَتَرَكَهَا
It is narrated from Sayyiduna Sahl bin Sa’d (may Allah be pleased with him) that a man from the tribe of Banu Aslam came to the Noble Prophet (peace and blessings be upon him) and confessed that he had committed adultery with a woman, and he also mentioned the name of that woman. The Prophet (peace and blessings be upon him) sent for that woman and asked her about this wrongdoing; she denied it. So the Prophet (peace and blessings be upon him) imposed the prescribed punishment (hadd) on that man and let the woman go.
