Chapter: One Who Confessed to a Hadd Without Naming It Is Not Punished

Hadith 6709
عَنْ وَاثِلَةَ بْنِ الْأَسْقَعِ رَضِيَ اللَّهُ عَنْهُ قَالَ شَهِدْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ ذَاتَ يَوْمٍ وَأَتَاهُ رَجُلٌ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي أَصَبْتُ حَدًّا مِنْ حُدُودِ اللَّهِ عَزَّ وَجَلَّ فَأَقِمْ فِيَّ حَدَّ اللَّهِ فَأَعْرَضَ عَنْهُ أَتَاهُ الثَّانِيَةَ فَأَعْرَضَ عَنْهُ ثُمَّ قَالَهَا الثَّالِثَةَ فَأَعْرَضَ عَنْهُ ثُمَّ أُقِيمَتِ الصَّلَاةُ فَلَمَّا قَضَى الصَّلَاةَ أَتَاهُ الرَّابِعَةَ فَقَالَ إِنِّي أَصَبْتُ حَدًّا مِنْ حُدُودِ اللَّهِ عَزَّ وَجَلَّ فَأَقِمْ فِيَّ حَدَّ اللَّهِ عَزَّ وَجَلَّ قَالَ فَدَعَاهُ فَقَالَ أَلَمْ تُحْسِنِ الطُّهُورَ أَوِ الْوُضُوءَ ثُمَّ شَهِدْتَ الصَّلَاةَ مَعَنَا آنِفًا قَالَ بَلَى قَالَ فَاذْهَبْ فَهِيَ كَفَّارَتُكَ
Narrated by Sayyiduna Wathilah bin Asqa’ (may Allah be pleased with him), he says: One day I was present with the Noble Prophet (peace and blessings be upon him), when a man came to him and said: I have reached one of the limits set by Allah, so establish Allah’s limit upon me. The Prophet (peace and blessings be upon him) turned away from him. Then he came a second time and confessed, but again the Prophet (peace and blessings be upon him) turned his face away. Then he came a third time and admitted, but again the Prophet (peace and blessings be upon him) turned away from him. Meanwhile, the call for prayer was given. When the prayer was performed, he came to the Prophet (peace and blessings be upon him) a fourth time and said: I have reached one of the limits set by Allah, so establish Allah’s limit upon me. The Prophet (peace and blessings be upon him) called him and said: Did you not just perform ablution well and pray with us? He said: Yes, indeed, I did this. The Prophet (peace and blessings be upon him) said: Then go, for this act is your expiation.

Hadith 6710
عَنْ أَبِي أُمَامَةَ رَضِيَ اللَّهُ عَنْهُ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِنَحْوِهِ وَفِيهِ فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ خَرَجْتَ مِنْ مَنْزِلِكَ تَوَضَّأْتَ فَأَحْسَنْتَ الْوُضُوءَ وَصَلَّيْتَ مَعَنَا قَالَ الرَّجُلُ بَلَى قَالَ فَإِنَّ اللَّهَ عَزَّ وَجَلَّ قَدْ غَفَرَ لَكَ حَدَّكَ أَوْ ذَنْبَكَ
It is narrated from Sayyiduna Abu Umamah (may Allah be pleased with him), then a hadith similar to the previous one was narrated, except that in this one it is stated: Did it happen that you left your house, performed ablution, and performed ablution well, and prayed with us? That man said: Yes, indeed, that is what I did. The Prophet (peace and blessings be upon him) said: Allah Almighty has forgiven your sin or your prescribed punishment.
