بَابُ الْحَثِ عَلَى إِقَامَةِ الْحَدِ وَالنَّهْي عَنِ الشَّفَاعَةِ فِيهِ إِذَا بَلَغَ الْإِمَامَ
Chapter: Encouragement to Establish the Prescribed Punishment and Prohibition of Intercession When It Reaches the Ruler
Hadith 6621
عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ حَدٌّ يُعْمَلُ وَفِي لَفْظٍ يُقَامُ فِي الْأَرْضِ خَيْرٌ لِأَهْلِ الْأَرْضِ مِنْ أَنْ يُمْطَرُوا ثَلَاثِينَ وَفِي لَفْظٍ أَوْ أَرْبَعِينَ صَبَاحًا
Narrated by Sayyiduna Abu Hurairah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: Implementing one prescribed punishment on earth is better for the people of the earth than thirty days of rain. In another narration, forty days of rain is mentioned.
Hadith 6622
عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا قَالَ سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ مَنْ حَالَتْ شَفَاعَتُهُ دُونَ حَدٍّ مِنْ حُدُودِ اللَّهِ عَزَّ وَجَلَّ فَقَدْ ضَادَّ اللَّهَ فِي أَمْرِهِ
Narrated by Sayyiduna Abdullah bin Umar, may Allah be pleased with them both, that the Noble Prophet, peace and blessings be upon him, said: Whoever's intercession becomes an obstacle in the enforcement of any of Allah's limits, he has opposed the command of Allah Almighty.
Hadith 6623
عَنْ عُرْوَةَ عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا قَالَتْ كَانَتِ امْرَأَةٌ مَخْزُومِيَّةٌ تَسْتَعِيرُ الْمَتَاعَ وَتَجْحَدُهُ فَأَمَرَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِقَطْعِ يَدِهَا فَأَتَى أَهْلُهَا أُسَامَةَ بْنَ زَيْدٍ فَكَلَّمُوهُ فَكَلَّمَ أُسَامَةُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فِيهَا فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَا أُسَامَةُ لَا أَرَاكَ تُكَلِّمُنِي فِي حَدٍّ مِنْ حُدُودِ اللَّهِ عَزَّ وَجَلَّ ثُمَّ قَامَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ خَطِيبًا فَقَالَ إِنَّمَا هَلَكَ مَنْ كَانَ قَبْلَكُمْ بِأَنَّهُ إِذَا سَرَقَ فِيهِمُ الشَّرِيفُ تَرَكُوهُ وَإِذَا سَرَقَ فِيهِمُ الضَّعِيفُ قَطَعُوهُ وَالَّذِي نَفْسِي بِيَدِهِ لَوْ كَانَتْ فَاطِمَةُ بِنْتُ مُحَمَّدٍ لَقَطَعْتُ يَدَهَا فَقَطَعَ يَدَ الْمَخْزُومِيَّةِ
It is narrated from Sayyida Aisha (may Allah be pleased with her) that a woman from the Makhzum tribe used to borrow goods and then deny it. The Noble Prophet (peace and blessings be upon him) ordered her hand to be cut off. Her family came to Sayyiduna Usama (may Allah be pleased with him) and requested him to intercede on behalf of the woman. When Sayyiduna Usama (may Allah be pleased with him) interceded with the Prophet (peace and blessings be upon him), he addressed him and said: O Usama! I did not expect that you would intercede regarding one of the limits set by Allah Almighty. Then the Noble Prophet (peace and blessings be upon him) stood up to deliver a sermon and said: The people before you were destroyed because when a noble among them committed theft, they would let him go, but when a weak person among them committed theft, they would cut off his hand. By the One in Whose hand is my soul! If Fatima, the daughter of Muhammad, had committed this crime, I would have cut off her hand as well. Then the Prophet (peace and blessings be upon him) had the hand of the Makhzumi woman cut off.
Hadith 6624

It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that a woman from the Makhzum tribe used to borrow goods and then deny it. The Noble Prophet (peace and blessings be upon him) ordered her hand to be cut off.
Hadith 6625
عَنْ جَابِرٍ رَضِيَ اللَّهُ عَنْهُ أَنَّ امْرَأَةً مِنْ بَنِي مَخْزُومٍ سَرَقَتْ فَعَاذَتْ بِأُسَامَةَ بْنِ زَيْدٍ حِبِّ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَأُتِيَ بِهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ لَوْ كَانَتْ فَاطِمَةُ لَقَطَعْتُ يَدَهَا فَقَطَعَهَا
It is narrated from Sayyiduna Jabir (may Allah be pleased with him) that a woman from Banu Makhzum committed theft and sought the protection of Sayyiduna Usama bin Zaid (may Allah be pleased with him) for intercession. He was beloved to the Prophet Muhammad (peace and blessings be upon him). Then the woman was brought, and the Prophet (peace and blessings be upon him) said: "If my daughter Fatimah had committed this, I would have cut off her hand as well." Then the hand of the Makhzumi woman was cut off.
Hadith 6626
عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أُتِيَ بِسَارِقٍ فَأَمَرَ بِهِ فَقُطِعَ قَالُوا يَا رَسُولَ اللَّهِ مَا كُنَّا نَرَى أَنْ يَبْلُغَ مِنْهُ هَذَا قَالَ لَوْ كَانَتْ فَاطِمَةُ لَقَطَعْتُهَا ثُمَّ قَالَ سُفْيَانُ لَا أَدْرِي كَيْفَ هُوَ
It is narrated from Sayyida Aisha (may Allah be pleased with her) that a thief was brought to the Noble Prophet (peace and blessings be upon him). The Prophet (peace and blessings be upon him) ordered that his hand be cut off. The people said: We did not know that the matter would reach this extent. The Prophet (peace and blessings be upon him) said: If Fatima (may Allah be pleased with her) were in this position, I would cut off her hand as well. Sufyan bin ‘Uyaynah says: I could not find out the details of the stolen item.
Hadith 6627
عَنْ صَفْوَانَ بْنِ أُمَيَّةَ رَضِيَ اللَّهُ عَنْهُ قَالَ بَيْنَمَا أَنَا رَاقِدٌ إِذْ جَاءَ السَّارِقُ فَأَخَذَ ثَوْبِي مِنْ تَحْتِ رَأْسِي فَأَدْرَكْتُهُ فَأَتَيْتُ بِهِ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقُلْتُ إِنَّ هَذَا سَرَقَ ثَوْبِي فَأَمَرَ بِهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنْ يُقْطَعَ قَالَ قُلْتُ يَا رَسُولَ اللَّهِ لَيْسَ هَذَا أَرَدْتُ هُوَ عَلَيْهِ صَدَقَةٌ قَالَ فَهَلَّا قَبْلَ أَنْ تَأْتِيَنِي بِهِ
Narrated by Sayyiduna Safwan bin Umayyah (may Allah be pleased with him), he says: Once I was asleep, a thief came and stole a cloth from under my head. I caught him and brought him to the Noble Prophet (peace and blessings be upon him) and said: He has stolen my cloth. When the Prophet (peace and blessings be upon him) ordered his hand to be cut off, I said: O Messenger of Allah! That was not my intention; I give this cloth to him as charity. The Prophet (peace and blessings be upon him) said: Why did you not do so before bringing him to me?
Hadith 6628
(وَعَنْهُ مِنْ طَرِيقٍ ثَانٍ) قَالَ كُنْتُ نَائِمًا فِي الْمَسْجِدِ عَلَى خَمِيصَةٍ لِي فَسُرِقَتْ فَأَخَذْنَا السَّارِقَ فَرَفَعْنَاهُ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَأَمَرَ بِقَطْعِهِ فَقُلْتُ يَا رَسُولَ اللَّهِ أَفِي خَمِيصَةٍ ثَمَنُهَا ثَلَاثُونَ دِرْهَمًا أَنَا أَهَبُهَا لَهُ أَوْ أَبِيعُهَا لَهُ قَالَ فَهَلَّا قَبْلَ أَنْ تَأْتِيَنِي بِهِ
(Second chain) Sayyiduna Safwan bin Umayyah (may Allah be pleased with him) says: I was sleeping in the mosque on my cloak, someone stole it, and we caught the thief and brought him to the Noble Prophet (peace and blessings be upon him). When you (peace and blessings be upon him) ordered his hand to be cut off, I said: O Messenger of Allah! Will his hand be cut off in exchange for this cloak, whose price is only thirty dirhams? I gift this cloak to this man or sell it to him. You (peace and blessings be upon him) said: Why did you not do so before bringing him to me?
Hadith 6629
عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ أَقِيلُوا ذَوِي الْهَيْئَاتِ عَثَرَاتِهِمْ إِلَّا الْحُدُودَ
Narrated by Hazrat Aisha (may Allah be pleased with her), the Messenger of Allah (peace and blessings be upon him) said: Forgive the mistakes of people of status, except when they are related to the prescribed limits (hudood).
