باب مَا جَاءَ فِي دِيَةٍ قَتِيلِ شِبْهِ الْعَمْدِ
Chapter: What Has Been Reported Regarding the Blood Money for Semi-Intentional Killing
Hadith 6583
عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ خَطَبَ النَّاسَ يَوْمَ الْفَتْحِ فَقَالَ أَلَا إِنَّ دِيَةَ الْخَطَأِ الْعَمْدِ بِالسَّوْطِ أَوِ الْعَصَا مُغَلَّظَةٌ مِائَةٌ مِنْهَا أَرْبَعُونَ خَلِفَةً فِي بُطُونِهَا أَوْلَادُهَا أَلَا إِنَّ كُلَّ دَمٍ وَمَالٍ وَمَأْثُرَةٍ كَانَتْ فِي الْجَاهِلِيَّةِ تَحْتَ قَدَمَيَّ إِلَّا مَا كَانَ مِنْ سِقَايَةِ الْحَاجِّ وَسِدَانَةِ الْبَيْتِ فَإِنِّي قَدْ أَمْضَيْتُهَا لِأَهْلِهَا
Narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) delivered a sermon to the people on the day of the conquest of Makkah and said: The blood money (diyah) for accidental killing that occurs with a whip or stick, etc., is aggravated; it will be a total of one hundred camels, of which forty will be pregnant she-camels. Beware! Every blood, wealth, and pride of the Age of Ignorance is trampled under my feet. Yes, I entrust the responsibility of providing water to the pilgrims and serving the House of Allah to those who have already been performing this service.
Hadith 6584
عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو رَضِيَ اللَّهُ عَنْهُمَا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ إِنَّ قَتِيلَ الْخَطَأِ شِبْهِ الْعَمْدِ قَتِيلُ السَّوْطِ وَالْعَصَا فِيهِ مِائَةٌ مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلَادُهَا
Narrated by Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Messenger of Allah said: Killing caused by a whip or stick, etc., is considered mistaken killing resembling intentional killing. Its blood money is one hundred camels, among which forty she-camels shall be pregnant.
Hadith 6585
عَنْ عُقْبَةَ بْنِ أَوْسٍ عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ خَطَبَ يَوْمَ فَتْحِ مَكَّةَ فَذَكَرَ حَدِيثًا وَفِيهِ أَلَا وَإِنَّ قَتِيلَ خَطَأِ الْعَمْدِ بِالسَّوْطِ وَالْعَصَا وَالْحَجَرِ دِيَةٌ مُغَلَّظَةٌ مِائَةٌ مِنَ الْإِبِلِ مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلَادُهَا وَفِي لَفْظٍ أَرْبَعُونَ مِنْ ثَنِيَّةٍ إِلَى بَازِلِ عَامِهَا كُلُّهُنَّ خَلِفَةٌ
Sayyiduna Uqbah bin Aws رضي الله عنه narrates from a Companion of the Messenger that the Noble Prophet صلى الله عليه وآله وسلم delivered a sermon on the day of the conquest of Makkah and said: Beware! The blood money (diyah) for a person killed by mistake, but with intention, who is struck with a whip, stick, or stone, is aggravated (strict), which is one hundred camels, of which forty she-camels will be pregnant. In another narration, it is stated: forty she-camels will be between Thaniyyah and Bazil in age, and all of them will be pregnant.
Hadith 6586
عَنْ عُقْبَةَ بْنِ أَوْسٍ عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ خَطَبَ يَوْمَ فَتْحِ مَكَّةَ فَذَكَرَ حَدِيثًا وَفِيهِ أَلَا وَإِنَّ قَتِيلَ خَطَأِ الْعَمْدِ بِالسَّوْطِ وَالْعَصَا وَالْحَجَرِ دِيَةٌ مُغَلَّظَةٌ مِائَةٌ مِنَ الْإِبِلِ مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلَادُهَا وَفِي لَفْظٍ أَرْبَعُونَ مِنْ ثَنِيَّةٍ إِلَى بَازِلِ عَامِهَا كُلُّهُنَّ خَلِفَةٌ
Qasim bin Rabiah narrated this hadith as follows: The Prophet (peace and blessings be upon him) said: The blood money (diyah) for a person killed by mistake with a whip, stick, or stone is one hundred camels, of which forty she-camels will be pregnant. Whoever demands even one camel more is among the people of ignorance (Jahiliyyah).
Hadith 6587
وَعَنْهُ أَيْضًا عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِقَرِيبٍ مِنْ ذَلِكَ إِلَّا أَنَّهُ قَالَ مِائَةٌ مِنَ الْإِبِلِ ثَلَاثُونَ حِقَّةً وَثَلَاثُونَ جَذَعَةً وَثَلَاثُونَ بَنَاتِ لَبُونٍ وَأَرْبَعُونَ ثَنِيَّةً خَلِفَةً إِلَى بَازِلِ عَامِهَا
This is also very similar to the aforementioned hadith, except that in this one it is stated: The Prophet (peace and blessings be upon him) said: There will be a hundred camels in total, of which thirty will be Hiqqah, thirty Jadh’ah, thirty Bint Labun, and forty she-camels from Thaniyyah to Bazil, but they must be pregnant.
Hadith 6588
عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ عَقْلُ شِبْهِ الْعَمْدِ مُغَلَّظٌ مِثْلُ عَقْلِ الْعَمْدِ وَلَا يُقْتَلُ صَاحِبُهُ وَذَلِكَ أَنْ يَنْزُوَ الشَّيْطَانُ بَيْنَ النَّاسِ قَالَ أَبُو النَّضْرِ فَيَكُونُ رِمِّيًا فِي عِمِّيًا فِي غَيْرِ فِتْنَةٍ وَلَا حَمْلِ سَلَاحٍ
It is narrated from Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him and his family) said: The blood money (diyah) for accidental killing resembling intentional murder (shibh al-‘amd) is as severe as that for intentional murder (‘amd), however, in shibh al-‘amd the killer cannot be killed (in retaliation). This occurs when Satan incites discord among people. Abu Nazr says: Then, in blind fighting, things like sticks, whips, and stones are thrown, while there is neither any sedition nor weapons involved.
