Hadith 6577
عَنْ بُشَيْرِ بْنِ يَسَارٍ عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ خَرَجَ عَبْدُ اللَّهِ بْنُ سَهْلٍ أَخُو بَنِي حَارِثَةَ يَعْنِي فِي نَفَرٍ مِنْ بَنِي حَارِثَةَ إِلَى خَيْبَرَ يَمْتَارُونَ مِنْهَا تَمَرًا قَالَ فَعُدِيَ عَلَى عَبْدِ اللَّهِ بْنِ سَهْلٍ فَكُسِرَتْ عُنُقُهُ ثُمَّ طُرِحَ فِي مَنْهَرٍ مِنْ مَنَاهِيرِ عُيُونِ خَيْبَرَ وَفَقَدَهُ أَصْحَابُهُ فَالْتَمَسُوهُ حَتَّى وَجَدُوهُ فَغَيَّبُوهُ قَالَ ثُمَّ قَدِمُوا عَلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَأَقْبَلَ أَخُو عَبْدِ الرَّحْمَنِ بْنِ سَهْلٍ وَابْنَا عَمِّهِ حُوَيِّصَةُ وَمُحَيِّصَةُ وَهُمَا كَانَا أَسَنَّ مِنْ عَبْدِ الرَّحْمَنِ وَكَانَ عَبْدُ الرَّحْمَنِ ذَا قَدَمٍ مِنَ الْقَوْمِ وَصَاحِبُ الدَّمِ فَتَقَدَّمَ لِذَلِكَ فَكَلَّمَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَبْلَ ابْنَيْ عَمِّهِ حُوَيِّصَةَ وَمُحَيِّصَةَ قَالَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ الْكُبَرَ الْكُبَرَ فَاسْتَأْخَرَ عَبْدُ الرَّحْمَنِ وَتَكَلَّمَ حُوَيِّصَةُ ثُمَّ تَكَلَّمَ مُحَيِّصَةُ ثُمَّ تَكَلَّمَ عَبْدُ الرَّحْمَنِ فَقَالُوا يَا رَسُولَ اللَّهِ عُدِيَ عَلَى صَاحِبِنَا فَقُتِلَ وَلَيْسَ بِخَيْبَرَ عَدُوٌّ إِلَّا يَهُودَ قَالَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ تُسَمُّونَ قَاتِلَكُمْ تَحْلِفُونَ عَلَيْهِ خَمْسِينَ يَمِينًا ثُمَّ نُسَلِّمُهُ قَالَ فَقَالُوا يَا رَسُولَ اللَّهِ مَا كُنَّا لِنَحْلِفَ عَلَى مَا لَمْ نَشْهَدْ قَالَ فَيَحْلِفُونَ لَكُمْ خَمْسِينَ يَمِينًا وَيَبْرَءُونَ مِنْ دَمِ صَاحِبِكُمْ قَالُوا يَا رَسُولَ اللَّهِ مَا كُنَّا لِنَقْبَلَ إِيمَانَ يَهُودَ مَا هُمْ فِيهِ مِنَ الْكُفْرِ أَعْظَمُ مِنْ أَنْ يَحْلِفُوا عَلَى إِثْمٍ قَالَ فَوَدَاهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مِنْ عِنْدِهِ مِائَةَ نَاقَةٍ قَالَ يَقُولُ سَهْلٌ مَا أَنْسَى بَكَرَةً مِنْهَا حَمْرَاءَ رَكَضَتْنِي وَأَنَا أَحُوزُهَا
Narrated from Sayyiduna Sahl bin Abi Hathmah (may Allah be pleased with him): Abdullah, the brother of Banu Harithah, set out towards Khaybar with some men from Banu Harithah to collect dates. Sayyiduna Abdullah bin Sahl (may Allah be pleased with him) had his neck broken (i.e., he was killed) and was thrown at the place where the water flowed from one of the springs of Khaybar. When they found their companion missing, they went out in search of him until they found him murdered. Then they buried him and later presented themselves before the Noble Prophet (peace and blessings be upon him). Abdullah’s brother, Abdur Rahman bin Sahl, and his two cousins, Huwayyisah and Muhayyisah, who were older than Abdur Rahman, but Abdur Rahman was braver than all of them and was also the heir to the murdered man’s blood, these individuals came to the Messenger of Allah (peace and blessings be upon him), and Abdur Rahman began to speak before his cousins Huwayyisah and Muhayyisah. But the Prophet (peace and blessings be upon him) said: Let the elder speak, let the elder speak. So Abdur Rahman stepped back and Huwayyisah spoke, then Muhayyisah, and finally Abdur Rahman explained the situation and said: O Messenger of Allah! Our brother has been attacked, and in Khaybar our only enemies are the Jews. The Messenger of Allah (peace and blessings be upon him) said: Name your killer in such a way that fifty men from among you swear oaths that we will hand over the killer to you. They said: O Messenger of Allah (peace and blessings be upon him)! How can we swear oaths about an incident at which we were not present? The Prophet (peace and blessings be upon him) said: Then the Jews will swear fifty oaths and will be acquitted of your companion’s blood. They said: O Messenger of Allah! We will not accept the oaths of the Jews; the disbelief in which they are involved is a greater crime than a sinful oath. Then the Messenger of Allah (peace and blessings be upon him) paid the blood money for the murdered man from his own side in the form of one hundred she-camels. Sahl says: I have not forgotten to this day that among them was a red she-camel, which kicked me while I was gently driving it.
Hadith 6578
عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ وَسُلَيْمَانَ بْنِ يَسَارٍ عَنْ إِنْسَانٍ مِنَ الْأَنْصَارِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنَّ الْقَسَامَةَ كَانَتْ فِي الْجَاهِلِيَّةِ قَسَامَةَ الدَّمِ فَأَقَرَّهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ عَلَى مَا كَانَتْ عَلَيْهِ فِي الْجَاهِلِيَّةِ وَقَضَى بِهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بَيْنَ أُنَاسٍ مِنَ الْأَنْصَارِ مِنْ بَنِي حَارِثَةَ فِي قَتِيلٍ ادَّعَوْهُ عَلَى الْيَهُودِ
It is narrated from an Ansari companion that in the time of ignorance (Jahiliyyah), in the case of bloodshed, there was Qasamah. The Messenger of Allah, peace and blessings be upon him, maintained it in the same way as it was in Jahiliyyah. And some Ansari people from Banu Harithah accused the Jews regarding their murdered man, and the Prophet, peace and blessings be upon him, made a decision in the light of Qasamah.
Hadith 6579
عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ رَضِيَ اللَّهُ عَنْهُ قَالَ وَجَدَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَتِيلًا بَيْنَ قَرْيَتَيْنِ فَأَمَرَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَذُرِعَ مَا بَيْنَهُمَا قَالَ وَكَأَنِّي أَنْظُرُ إِلَى شِبْرِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَأَلْقَاهُ عَلَى أَقْرَبِهِمَا
It is narrated from Sayyiduna Abu Sa'id Khudri, may Allah be pleased with him, that the Messenger of Allah, peace and blessings be upon him, found a murdered person between two settlements. The Prophet, peace and blessings be upon him, ordered the distance between the two settlements to be measured. It is as if I can still see the handspan of the Messenger of Allah, peace and blessings be upon him. Then he held the nearer settlement responsible for the murder.
