بَابُ مَا جَاءَ فِيمَنْ عَضَ يَدَ رَجُلٍ فَانتَزعَهَا فَسَقَطَتْ ثَنِيَّتهُ

Chapter: What has been reported regarding one who bit a man’s hand, he pulled it away and his incisor fell out

Hadith 6570
عَنْ يَعْلَى بْنِ أُمَيَّةَ وَسَلَمَةَ بْنِ أُمَيَّةَ رَضِيَ اللَّهُ عَنْهُمَا قَالَا خَرَجْنَا مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فِي غَزْوَةِ تَبُوكَ مَعَنَا صَاحِبٌ لَنَا فَاقْتَتَلَ هُوَ وَرَجُلٌ مِنَ الْمُسْلِمِينَ فَعَضَّ ذَلِكَ الرَّجُلُ بِذِرَاعِهِ فَاجْتَبَذَ يَدَهُ مِنْ فِيهِ فَطَرَحَ ثَنِيَّتَهُ فَذَهَبَ الرَّجُلُ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَسْأَلُهُ الْعَقْلَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَنْطَلِقُ أَحَدُكُمْ إِلَى أَخِيهِ يَعَضُّهُ عَضِيضَ الْفَحْلِ ثُمَّ يَأْتِي يَلْتَمِسُ الْعَقْلَ لَا دِيَةَ لَكَ فَأَطْلَقَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَعْنِي فَأَبْطَلَهَا
It is narrated from Sayyidna Ali bin Umayyah and Salamah bin Umayyah (may Allah be pleased with them), they say: We set out with the Messenger of Allah (peace and blessings be upon him) in the expedition of Tabuk. There was another companion with us. He and another Muslim got into a fight. That man bit the other's arm, so he pulled his hand out of his mouth and his front tooth fell out. That man went to the Noble Prophet (peace and blessings be upon him) and demanded blood money. The Prophet (peace and blessings be upon him) said: One of you bites his brother like a bull and then comes to demand blood money? There is no blood money for this. The Prophet (peace and blessings be upon him) declared his claim for blood money invalid.

Hadith 6571
وَمِنْ طَرِيقٍ ثَانٍ عَنْ صَفْوَانَ بْنِ يَعْلَى عَنْ يَعْلَى بْنِ أُمَيَّةَ رَضِيَ اللَّهُ عَنْهُ قَالَ غَزَوْتُ مَعَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ جَيْشَ الْعُسْرَةِ وَكَانَ مِنْ أَوْثَقِ أَعْمَالِي فِي نَفْسِي وَكَانَ لِي أَجِيرٌ فَقَاتَلَ إِنْسَانًا فَعَضَّ أَحَدُهُمَا صَاحِبَهُ فَانْتَزَعَ إِصْبَعَهُ فَأَنْدَرَ ثَنِيَّتَهُ وَقَالَ أَفَيَدَعُ يَدَهُ فِي فِيكَ تَقْضَمُهَا قَالَ أَحْسَبُهُ قَالَ كَمَا يَقْضَمُ الْفَحْلُ
(Second chain) It is narrated from Sayyidna Ali bin Umayyah, may Allah be pleased with him, who says: I participated with the Noble Prophet, peace and blessings be upon him, in the army of hardship, that is, the Battle of Tabuk. This battle is among those deeds of mine on which I rely the most. I had a laborer, who got into a fight with another man. One of them bit the other, and the other pulled his finger away, causing his tooth to fall out. He went to the Noble Prophet, peace and blessings be upon him, to complain, but the Prophet, peace and blessings be upon him, said: Would he have kept his hand in your mouth and you kept chewing it like a bull?

Hadith 6572
عَنْ عِمْرَانَ بْنِ حُصَيْنٍ رَضِيَ اللَّهُ عَنْهُ قَالَ قَاتَلَ يَعْلَى بْنُ مُنْيَةَ أَوِ ابْنُ أُمَيَّةَ رَجُلًا فَعَضَّ أَحَدُهُمَا يَدَ صَاحِبِهِ فَانْتَزَعَ يَدَهُ مِنْ فِيهِ فَانْتَزَعَ ثَنِيَّتَهُ وَقَالَ حَجَّاجٌ ثَنِيَّتَيْهِ فَاخْتَصَمَا إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ يَعَضُّ أَحَدُكُمَا أَخَاهُ كَمَا يَعَضُّ الْفَحْلُ لَا دِيَةَ لَهُ وَفِي لَفْظٍ فَأَبْطَلَهَا وَقَالَ أَرَدْتَ أَنْ تَقْضَمَ لَحْمَ أَخِيكَ كَمَا يَقْضَمُ الْفَحْلُ
Narrated from Sayyiduna Imran bin Husain (may Allah be pleased with him) that Ya'la bin Munyah or Ibn Umayyah had a fight with a man. One of them bit the other's hand, and to save himself, he pulled his hand away, causing one or two teeth of the biter to fall out. When both of them brought their dispute to the Prophet Muhammad (peace and blessings be upon him), he said: "Does one of you bite his brother like a bull? There is no blood money for such a person." In another narration, it is stated: The Prophet (peace and blessings be upon him) invalidated his blood money and said: "Did you want to chew your brother's flesh like a bull?"
