Chapter: Retribution for cutting off part of the ear
Hadith 6569
عَنِ الْعَلَاءِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ يَعْقُوبَ عَنْ رَجُلٍ مِنْ قُرَيْشٍ مِنْ بَنِي سَهْمٍ عَنْ رَجُلٍ مِنْهُمْ يُقَالُ لَهُ مَاجِدَةُ قَالَ عَارَمْتُ غُلَامًا بِمَكَّةَ فَعَضَّ أُذُنِي فَقَطَعَ مِنْهَا أَوْ عَضَضْتُ أُذُنَهُ فَقَطَعْتُ مِنْهَا فَلَمَّا قَدِمَ إِلَيْنَا أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ حَاجًّا رُفِعْنَا إِلَيْهِ فَقَالَ انْطَلِقُوا إِلَى عُمَرَ بْنِ الْخَطَّابِ فَإِنْ كَانَ الْجَارِحُ بَلَغَ أَنْ يُقْتَصَّ مِنْهُ فَلْيَقْتَصَّ قَالَ فَلَمَّا انْتَهَى بِنَا إِلَى عُمَرَ نَظَرَ إِلَيْنَا فَقَالَ نَعَمْ قَدْ بَلَغَ هَذَا أَنْ يُقْتَصَّ مِنْهُ ادْعُوا لِي حَجَّامًا فَلَمَّا ذَكَرَ الْحَجَّامَ قَالَ أَمَا إِنِّي قَدْ سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ قَدْ أَعْطَيْتُ خَالَتِي غُلَامًا وَأَنَا أَرْجُو أَنْ يُبَارِكَ اللَّهُ لَهَا فِيهِ وَقَدْ نَهَيْتُهَا أَنْ تَجْعَلَهُ حَجَّامًا أَوْ قَصَّابًا أَوْ صَائِغًا
It is narrated from a man named Majda of Banu Sahm, he says: I had a dispute with a slave in Makkah, now he bit my ear and a part of it was cut off, or I had bitten his ear. When Sayyiduna Abu Bakr (may Allah be pleased with him) came to us for Hajj, our case was presented in his court. He said: Take them to Umar ibn Khattab (may Allah be pleased with him), if the wound is deserving of retaliation, then he will have retaliation carried out. When we were brought to Sayyiduna Umar (may Allah be pleased with him), he saw and said: Yes, this wound has reached the limit for retaliation, call a barber. When they mentioned the barber, he said: I heard the Messenger of Allah (peace and blessings be upon him) say: I gave my maternal aunt a slave and I hope that Allah Almighty will bless her in that slave, and I forbade her from making him a cupper, butcher, or goldsmith.
