بَابُ قَتل الرّجُلِ بِالْمَرْأَةِ وَالْمَرْأَةِ بِمِثْلِهَا وَالْقَتْلِ بِالْمِثْقَل وَالْقِصَاصِ مِنَ الْقَاتِلِ بِالصِّفَةِ الَّتِي قَتَلَ بِهَا
Chapter: Killing a man for a woman and a woman for her like, killing with a heavy object, and retribution from the killer in the manner he killed
Hadith 6553
عَنْ أَنَسِ بْنِ مَالِكٍ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَجُلًا مِنَ الْيَهُودِ قَتَلَ جَارِيَةً مِنَ الْأَنْصَارِ عَلَى حُلِيٍّ لَهَا ثُمَّ أَلْقَاهَا فِي قَلِيبٍ وَرَضَخَ رَأْسَهَا بِالْحِجَارَةِ فَأُخِذَ فَأُتِيَ بِهِ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَأَمَرَ بِهِ أَنْ يُرْجَمَ حَتَّى يَمُوتَ فَرُجِمَ حَتَّى مَاتَ
Narrated by Sayyiduna Anas bin Malik (may Allah be pleased with him): A Jew killed a slave girl belonging to an Ansari for her jewelry out of greed, then threw her into a well. He had crushed her head with a stone. That man was then arrested and brought to the Noble Prophet (peace and blessings be upon him). The Prophet (peace and blessings be upon him) ordered him to be stoned to death, so he was stoned until he died.
Hadith 6554
(وَعَنْهُ مِنْ طَرِيقٍ ثَانٍ) أَنَّ جَارِيَةً خَرَجَتْ عَلَيْهَا أَوْضَاحٌ فَأَخَذَهَا يَهُودِيٌّ فَرَضَخَ رَأْسَهَا وَأَخَذَ مَا عَلَيْهَا فَأُتِيَ بِهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَبِهَا رَمَقٌ فَقَالَ لَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مَنْ قَتَلَكِ فُلَانٌ فَقَالَتْ بِرَأْسِهَا لَا فَقَالَ فُلَانٌ فَقَالَتْ بِرَأْسِهَا لَا قَالَ فَفُلَانٌ الْيَهُودِيُّ فَقَالَتْ بِرَأْسِهَا نَعَمْ فَأَخَذَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَرَضَخَ رَأْسَهُ بَيْنَ حَجَرَيْنِ
(A second chain) A slave girl went out, she was wearing jewelry. A Jew seized her, crushed her head, and took her jewelry away. When the slave girl was brought to the Prophet Muhammad (peace and blessings be upon him), she still had some life left in her. The Prophet Muhammad (peace and blessings be upon him) asked her: Who killed you? Did so-and-so kill you? She gestured with her head indicating no. The Prophet (peace and blessings be upon him) asked: Then did so-and-so kill you? She gestured with her head indicating no. Then the Prophet (peace and blessings be upon him) said: Did such-and-such Jew kill you? She gestured with her head indicating yes. So the Prophet Muhammad (peace and blessings be upon him) seized that Jew and crushed his head between two stones.
Hadith 6555
وَمِنْ طَرِيقٍ ثَالِثٍ عَنْ قَتَادَةَ عَنْ أَنَسٍ رَضِيَ اللَّهُ عَنْهُ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِمِثْلِ الطَّرِيقِ الثَّانِيَةِ إِلَّا أَنَّ قَتَادَةَ قَالَ فِي حَدِيثِهِ فَاعْتَرَفَ الْيَهُودِيُّ
(Third chain) It is narrated from Sayyiduna Anas (may Allah be pleased with him) as well; this hadith is similar to the hadith of the second chain, except that in this one Qatadah said: That Jew confessed to the killing.
Hadith 6556
عَنْ حَمْلِ بْنِ النَّابِغَةِ رَضِيَ اللَّهُ عَنْهُ قَالَ كُنْتُ بَيْنَ بَيْتَيْ امْرَأَتَيَّ فَضَرَبَتْ إِحْدَاهُمَا الْأُخْرَى بِمِسْطَحٍ فَقَتَلَتْهَا وَجَنِينَهَا فَقَضَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فِي جَنِينِهَا بِغُرَّةٍ وَأَنْ تُقْتَلَ بِهَا
It is narrated from Sayyiduna Haml bin Nabighah (may Allah be pleased with him), he says: I was between the houses of my two wives, one of them struck the other with a stick, as a result of which that woman died and her unborn child was also lost. The Noble Prophet (peace and blessings be upon him) decided that for the unborn child, a slave man or woman would be given, and the woman (who struck) would be killed in retribution.
