بَابُ الْجَابِ الْقِصَاصِ بِالْقَتْلِ الْعَمَدِ وَأَنَّ مُسْتَحِقَّهُ بِالْخِيَارِ بَيْنَهُ وَبَينَ الدِّيةِ
Chapter: The obligation of retribution for intentional murder and that the entitled person has the choice between it and blood money
Hadith 6545
عَنْ أَبِي شُرَيْحٍ الْخُزَاعِيِّ رَضِيَ اللَّهُ عَنْهُ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَفِي لَفْظٍ سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ مَنْ أُصِيبَ بِدَمٍ أَوْ خَبْلٍ وَالْخَبْلُ الْجِرَاحُ فَهُوَ بِالْخِيَارِ بَيْنَ إِحْدَى ثَلَاثٍ إِمَّا أَنْ يَقْتَصَّ أَوْ يَأْخُذَ الْعَقْلَ أَوْ يَعْفُوَ فَإِنْ أَرَادَ رَابِعَةً فَخُذُوا عَلَى يَدَيْهِ فَإِنْ فَعَلَ شَيْئًا مِنْ ذَلِكَ ثُمَّ عَدَا بَعْدُ فَلَهُ النَّارُ خَالِدًا فِيهَا مُخَلَّدًا
Sayyiduna Abu Shurayh Khuza'i (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: Whoever is killed or wounded, he has the choice of one of three things: (1) he may take retribution (qisas), or (2) he may accept blood money (diyah), or (3) he may forgive. If he seeks a fourth option, prevent him. If a person chooses one of these three things and then exceeds after that, then for him is Hellfire, he will abide therein forever.
Hadith 6546
عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ مَنْ قَتَلَ مُتَعَمِّدًا دُفِعَ إِلَى أَوْلِيَاءِ الْقَتِيلِ فَإِنْ شَاءُوا قَتَلُوهُ وَإِنْ شَاءُوا أَخَذُوا الدِّيَةَ وَهِيَ ثَلَاثُونَ حِقَّةً وَثَلَاثُونَ جَذَعَةً وَأَرْبَعُونَ خَلِفَةً وَذَلِكَ عَقْلُ الْعَمْدِ وَمَا صَالَحُوا عَلَيْهِ فَهُوَ لَهُمْ وَذَلِكَ تَشْدِيدُ الْعَقْلِ
It is narrated from Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: Whoever commits intentional murder, he shall be handed over to the heirs of the slain; if they wish, they may kill him, or if they wish, they may accept blood money. The details of this are: thirty Hiqqahs, thirty Jadh’ahs, and forty pregnant she-camels; this is the blood money for intentional murder. Also, whatever they agree upon in reconciliation will belong to them; this is the heaviest blood money.
Hadith 6547
عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ لَا أُعْفِي مَنْ قَتَلَ بَعْدَ أَخْذِهِ الدِّيَةَ
Narrated by Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: Whoever kills the murderer after receiving the blood money, I will not forgive him.
