بَابُ النَّهْي عَنْ قَتْلِ الْحَيَوَانِ أَوِ الْإِنْسَانِ صَبْرًا أَوْ بِشَيْءٍ فِيْهِ تَعْذِيْبٌ وَعَنِ التَّمْثِيْلِ بِهِ
Chapter: Prohibition of killing animals or humans by torture or in a way that causes suffering, and of mutilation
Hadith 6532
عَنْ إِسْحَاقَ بْنِ سَعِيدٍ عَنْ أَبِيهِ قَالَ: دَخَلَ ابْنُ عُمَرَ عَلَى يَحْيَى بْنِ سَعِيدٍ وَغُلَامٌ مِنْ بَنِيهِ رَابِطٌ دَجَاجَةً يَرْمِيهَا، فَمَشَى إِلَى الدَّجَاجَةِ فَحَلَّهَا ثُمَّ أَقْبَلَ بِهَا وَبِالْغُلَامِ وَقَالَ لِيَحْيَى: ازْجُرُوا غُلَامَكُمْ هَذَا مِنْ أَنْ يَصْبِرَ هَذَا الطَّيْرَ عَلَى الْقَتْلِ فَإِنِّي سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَنْهَى أَنْ تُصْبَرَ بَهِيمَةٌ أَوْ غَيْرُهَا لِقَتْلٍ، وَإِذَا أَرَدْتُمْ ذَبْحَهَا فَاذْبَحُوهَا
Saeed bin Amr says: Sayyiduna Abdullah bin Umar (may Allah be pleased with them) went to Yahya bin Saeed, and one of his sons had tied up a chicken and was using it as a target. Sayyiduna Ibn Umar (may Allah be pleased with them) went and untied the chicken, and bringing the chicken and the boy before Yahya, said: Forbid your son from tying up this bird and making it a target for killing, because the Messenger of Allah (peace and blessings be upon him) forbade killing an animal by tying it up. If you want to slaughter it, then slaughter it according to the prescribed method.
Hadith 6533
عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لَعَنَ مَنِ اتَّخَذَ شَيْئًا فِيهِ الرُّوحُ غَرَضًا
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) cursed the person who uses as a target for shooting any living being.
Hadith 6534
عَنِ الشَّرِيدِ بْنِ سُوَيْدٍ الثَّقَفِيِّ قَالَ: سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ: ((مَنْ قَتَلَ عُصْفُورًا عَبَثًا، عَجَّ إِلَى اللَّهِ عَزَّ وَجَلَّ يَوْمَ الْقِيَامَةِ مِنْهُ يَقُولُ: إِنَّ فُلَانًا قَتَلَنِي عَبَثًا وَلَمْ يَقْتُلْنِي لِمَنْفَعَةٍ))
Narrated by Sayyiduna Shuraid bin Suwaid Thaqafi (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: Whoever kills a sparrow without purpose, it will cry out before Allah Almighty on the Day of Resurrection, saying: Surely, so-and-so killed me without any purpose and did not kill me for any benefit.
Hadith 6535
عَنْ عَبْدِ اللَّهِ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنَّهُ قَالَ: ((أَعَفُّ (وَفِي لَفْظٍ: إِنَّ أَعَفَّ) النَّاسِ قِتْلَةً أَهْلُ الْإِيمَانِ))
Narrated by Sayyiduna Abdullah bin Mas’ud (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) said: Among all people, the believers are the most merciful when they kill.
Hadith 6536
عَنِ ابْنِ عُمَرَ قَالَ: سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ: ((مَنْ مَثَّلَ بِذِي رُوحٍ ثُمَّ لَمْ يَتُبْ مَثَّلَ اللَّهُ بِهِ يَوْمَ الْقِيَامَةِ))
Narrated by Sayyiduna Abdullah bin Umar, may Allah be pleased with them both, that the Messenger of Allah, peace and blessings be upon him, said: Whoever mutilates a living being and does not repent, Allah Almighty will mutilate him on the Day of Resurrection.
Hadith 6537
عَنْ أَبِي الْأَحْوَصِ عَنْ أَبِيهِ قَالَ: أَتَيْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَصَعَّدَ فِيَّ النَّظَرَ وَصَوَّبَ وَقَالَ: ((أَرَبُّ إِبِلٍ أَنْتَ أَوْ رَبُّ غَنَمٍ؟)) قَالَ: مِنْ كُلٍّ قَدْ آتَانِيَ اللَّهُ فَأَكْثَرَ وَأَطْيَبَ، قَالَ: ((فَتُنْتِجُهَا وَافِيَةً أَعْيُنُهَا وَآذَانُهَا فَتَجْدَعُ هَذِهِ فَتَقُولُ صَرْمَاءَ (ثُمَّ تَكَلَّمَ سُفْيَانُ بِكَلِمَةٍ لَمْ أَفْهَمْهَا) وَتَقُولُ بَحِيرَةَ اللَّهِ فَسَاعِدُ اللَّهِ أَشَدُّ، وَمُوسَاهُ أَحَدُّ، وَلَوْ شَاءَ أَنْ يَأْتِيَكَ بِهَا صَرْمَاءَ آتَاكَ)) قُلْتُ: إِلَى مَا تَدْعُو؟ قَالَ: ((إِلَى اللَّهِ وَإِلَى الرَّحِمِ)) الحَدِيثُ
Abu Ahwas narrates from his father Sayyiduna Malik bin Nadlah (may Allah be pleased with him), he says: I came to the Noble Prophet (peace and blessings be upon him), and he looked me up and down attentively and said: Are you the owner of camels or goats? I said: Allah Almighty has blessed me with all kinds of wealth, He has given me abundant and excellent wealth. The Prophet (peace and blessings be upon him) said: These animals give birth to offspring with complete eyes and ears, and you people cut their ears, etc., and then call them by the name of “ear-cut,” and you begin to say that this is Allah’s Bahirah. So, Allah Almighty’s arm is very powerful and His strike is very sharp; if He wills to give you an ear-cut animal, He will give it to you. I said: O Messenger of Allah (peace and blessings be upon him), what do you invite to? He (peace and blessings be upon him) said: To Allah Almighty and to maintaining family ties. Al-Hadith
Hadith 6538
عَنْ عَبْدِ اللَّهِ بْنِ حَفْصٍ عَنْ يَعْلَى بْنِ مُرَّةَ أَنَّهُ كَانَ عِنْدَ زِيَادٍ جَالِسًا فَأُتِيَ بِرَجُلٍ شَهِدَ فَغَيَّرَ شَهَادَتَهُ، فَقَالَ: لَأَقْطَعَنَّ لِسَانَكَ، فَقَالَ لَهُ يَعْلَى: أَلَا أُحَدِّثُكَ حَدِيثًا سَمِعْتُهُ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ؟ سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ: ((قَالَ اللَّهُ عَزَّ وَجَلَّ: لَا تُمَثِّلُوا بِعِبَادِي)) قَالَ: فَتَرَكَهُ
Sayyidna Ali bin Murrah (may Allah be pleased with him) was sitting with Ziyad, when a man was brought in. He gave testimony and then changed his testimony. Ziyad said: "I will cut your tongue," but Sayyidna Ali (may Allah be pleased with him) said: "I will narrate to you a hadith which I myself heard from the Messenger of Allah (peace and blessings be upon him). He (peace and blessings be upon him) said: Allah has said: Do not mutilate My servants." Upon hearing this hadith, Ziyad let him go.
Hadith 6539
عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ قَالَ: نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنْ يُقْتَلَ شَيْءٌ مِنَ الدَّوَابِّ صَبْرًا
It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them) that the Messenger of Allah (peace and blessings be upon him) forbade killing any animal by tying it up.
Hadith 6540
عَنْ عُبَيْدِ بْنِ تِعْلِي قَالَ: غَزَوْنَا مَعَ عَبْدِ الرَّحْمَنِ بْنِ خَالِدِ بْنِ الْوَلِيدِ فَأُتِيَ بِأَرْبَعَةِ أَعْلَاجٍ مِنَ الْعَدُوِّ فَأَمَرَ بِهِمْ فَقُتِلُوا صَبْرًا بِالنَّبْلِ، فَبَلَغَ ذَلِكَ أَبَا أَيُّوبَ فَقَالَ: سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَنْهَى عَنْ قَتْلِ الصَّبْرِ
Ubaid bin Ti'li says: We fought a battle with Abdur Rahman bin Khalid bin Walid. When four non-Arab enemies were brought to him, he ordered that they be tied up and killed with arrows. When this news reached Sayyiduna Abu Ayyub (may Allah be pleased with him), he said that the Messenger of Allah (peace and blessings be upon him) forbade killing by tying up.
Hadith 6541
(وَعَنْهُ مِنْ طَرِيقٍ ثَانٍ) عَنْ أَبِي أَيُّوبَ رَضِيَ اللَّهُ عَنْهُ قَالَ نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ عَنْ صَبْرِ الدَّابَّةِ قَالَ أَبُو أَيُّوبَ لَوْ كَانَتْ لِي دَجَاجَةٌ مَا صَبَرْتُهَا
(Second chain) It is narrated from Sayyiduna Abu Ayyub Ansari (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) forbade killing an animal after tying it up. Then Sayyiduna Abu Ayyub (may Allah be pleased with him) said: Even if I had a chicken, I would not kill it after tying it up.
