بَابُ كَرَاهَةِ الْحِرْصِ عَلَى الْقَضَاءِ وَالْوِلَايَةِ وَنَحْوِهَا بَابُ التَّشْدِيدِ عَلَى الْحُكّامِ الْجَائِرِينَ وَفَضْل الْمُقْسِطِينَ
Chapter: Dislike of eagerness for judiciary and leadership, and strictness regarding unjust judges, and the virtue of the just
Hadith 6392
عَنْ يَزِيدَ بْنِ مَوْهَبٍ أَنَّ عُثْمَانَ قَالَ لِابْنِ عُمَرَ: اقْضِ بَيْنَ النَّاسِ، فَقَالَ لَهُ: لَا أَقْضِي بَيْنَ اثْنَيْنِ وَلَا أَؤُمُّ رَجُلَيْنِ، أَمَا سَمِعْتَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ: ((مَنْ عَاذَ بِاللَّهِ فَقَدْ عَاذَ بِمَعَاذٍ)) قَالَ عُثْمَانُ: بَلَى، قَالَ: فَإِنِّي أَعُوذُ بِاللَّهِ أَنْ تَسْتَعْمِلَنِي، فَأَعْفَاهُ وَقَالَ: لَا تُخْبِرْ بِهَذَا أَحَدًا
It is narrated from Yazid bin Moheb that Sayyiduna Uthman (may Allah be pleased with him) said to Sayyiduna Abdullah bin Umar (may Allah be pleased with them both): Decide among the people. He replied: I will neither be a judge between two men nor an imam of two men. O Uthman! Did you not hear the Messenger of Allah (peace and blessings be upon him) say that whoever seeks refuge with Allah Almighty, he has sought a great refuge? Sayyiduna Uthman (may Allah be pleased with him) said: Yes, of course. He said: Then I seek refuge with Allah Almighty from you appointing me as an official. So Sayyiduna Uthman (may Allah be pleased with him) excused him, but said: Do not narrate this hadith to anyone else.
Hadith 6393
عَنْ بِلَالِ بْنِ أَبِي مُوسَى عَنْ أَنَسِ بْنِ مَالِكٍ قَالَ: أَرَادَ الْحَجَّاجُ أَنْ يَجْعَلَ ابْنَهُ عَلَى قَضَاءِ الْبَصْرَةِ، قَالَ: فَقَالَ أَنَسٌ: سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ: ((مَنْ طَلَبَ الْقَضَاءَ وَاسْتَعَانَ عَلَيْهِ وُكِّلَ إِلَيْهِ، وَمَنْ لَمْ يَطْلُبْهُ وَلَمْ يَسْتَعِنْ عَلَيْهِ أَنْزَلَ اللَّهُ مَلَكًا يُسَدِّدُهُ))
It is narrated from Sayyiduna Anas bin Malik (may Allah be pleased with him) that when Hajjaj wanted to appoint his son as the judge of Basra, he said that the Messenger of Allah (peace and blessings be upon him) said: Whoever seeks the office of judge and tries to obtain it with the help of others, he will be entrusted with that office; and the person who neither seeks it nor takes the help of others to obtain it, Allah Almighty will send an angel for him who will guide him towards correctness.
Hadith 6394
(وَعَنْهُ مِنْ طَرِيقٍ ثَانٍ) عَنْ أَنَسٍ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((مَنْ سَأَلَ الْقَضَاءَ وُكِّلَ إِلَيْهِ، وَمَنْ أُجْبِرَ عَلَيْهِ نَزَلَ عَلَيْهِ مَلَكٌ فَيُسَدِّدُهُ))
(Second chain) It is narrated from Sayyiduna Anas (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: Whoever seeks the position of judge for himself, it will be entrusted to him; and whoever is given it forcefully, an angel will descend upon him who will guide him towards what is better.
Hadith 6395
عَنْ عِمْرَانَ بْنِ حِطَّانَ قَالَ: دَخَلْتُ عَلَى عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا فَذَاكَرْتُهَا حَتَّى ذَكَرْنَا الْقَاضِيَ، فَقَالَتْ عَائِشَةُ: سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ: ((لَيَأْتِيَنَّ عَلَى الْقَاضِي الْعَدْلِ يَوْمَ الْقِيَامَةِ سَاعَةٌ يَتَمَنَّى أَنَّهُ لَمْ يَقْضِ بَيْنَ اثْنَيْنِ فِي تَمْرَةٍ قَطُّ))
Imran bin Hattan says: I went to Lady Aisha (may Allah be pleased with her) and began to discuss with her, until the topic of the position of judge was mentioned. At that point, Lady Aisha (may Allah be pleased with her) said that the Messenger of Allah (peace and blessings be upon him) said: There will come a moment on the Day of Resurrection upon the judge when he will wish that he had not decided even about a single date between two men.
Hadith 6396
عَنْ أَبِي هُرَيْرَةَ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((مَنْ جُعِلَ قَاضِيًا بَيْنَ النَّاسِ فَقَدْ ذُبِحَ بِغَيْرِ سِكِّينٍ))
Narrated by Sayyiduna Abu Huraira (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: Whoever is appointed as a judge over the people, it is as if he has been slaughtered without a knife.
