بَاب مَا جَاءَ فِي مِبْرَاتِ الْمَوْلَى مِنْ أَسْفَلِ وَمَنْ أَسْلَمَ عَلَى يَدِهِ رَجُلٌ
Chapter: What has been reported regarding the inheritance of the freed slave from below and one who accepted Islam at his hand
Hadith 6370
عَنِ ابْنِ عَبَّاسٍ رَجُلٌ مَاتَ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَلَمْ يَتْرُكْ وَارِثًا إِلَّا عَبْدًا هُوَ أَعْتَقَهُ، فَأَعْطَاهُ مِيرَاثَهُ
It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that in the time of the Prophet (peace and blessings be upon him), a man passed away and left no heirs, except for a freed slave of his. So the Prophet (peace and blessings be upon him) gave his inheritance to that freed slave.
Hadith 6371
عَنِ ابْنِ بُرَيْدَةَ عَنْ أَبِيهِ قَالَ: تُوُفِّيَ رَجُلٌ مِنَ الْأَزْدِ فَلَمْ يَدَعْ وَارِثًا، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((الْتَمِسُوا لَهُ وَارِثًا، الْتَمِسُوا لَهُ ذَا رَحِمٍ)) قَالَ: فَلَمْ يُوجَدْ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((أَدْفِعُوهُ إِلَى أَكْبَرِ خُزَاعَةَ))
It is narrated from Sayyiduna Buraidah Aslami (may Allah be pleased with him) that a man from the Azd tribe passed away and he had no heirs. The Messenger of Allah (peace and blessings be upon him) said: "Find his heir, find his relative." But no relative could be found. Then the Messenger of Allah (peace and blessings be upon him) said: "Give this inheritance to the eldest of the Khuza'ah tribe."
Hadith 6372
عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا أَنَّ مَوْلًى لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَقَعَ مِنْ نَخْلَةٍ فَمَاتَ وَتَرَكَ شَيْئًا وَلَمْ يَدَعْ وَلَدًا وَلَا حَمِيمًا، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((أَعْطُوا مِيرَاثَهُ رَجُلًا مِنْ أَهْلِ قَرْيَتِهِ))
It is narrated from Sayyida Aisha (may Allah be pleased with her) that a slave of the Noble Prophet (peace and blessings be upon him) fell from a date-palm and died. He had some inheritance, but neither children nor relatives. The Messenger of Allah (peace and blessings be upon him) said regarding his inheritance: "Give it to someone from his settlement."
Hadith 6373
عَنْ تَمِيمٍ الدَّارِيِّ قَالَتْ: سَأَلْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: مَا السُّنَّةُ فِي الرَّجُلِ مِنْ أَهْلِ الْكُفْرِ يُسْلِمُ عَلَى يَدِ الرَّجُلِ مِنَ الْمُسْلِمِينَ؟ قَالَ: ((هُوَ أَوْلَى النَّاسِ بِحَيَاتِهِ وَمَوْتِهِ))
It is narrated from Sayyiduna Tamim Dari (may Allah be pleased with him), he says: I asked the Messenger of Allah (peace and blessings be upon him) that if a man from among the disbelievers accepts Islam at the hand of a Muslim, what will be the procedure regarding him? The Prophet (peace and blessings be upon him) said: This Muslim will have the greatest right over him, in his life and in his death, compared to others.
