Hadith 6359
عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ رَضِيَ اللَّهُ عَنْهُ قَالَ جَاءَتِ الْجَدَّةُ إِلَى أَبِي بَكْرٍ فَسَأَلَتْهُ مِيرَاثَهَا فَقَالَ مَا أَعْلَمُ لَكِ فِي كِتَابِ اللَّهِ شَيْئًا وَلَا أَعْلَمُ لَكِ فِي سُنَّةِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مِنْ شَيْءٍ حَتَّى أَسْأَلَ النَّاسَ فَسَأَلَ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ جَعَلَ لَهَا السُّدُسَ فَقَالَ مَنْ يَشْهَدُ مَعَكَ أَوْ مَنْ يَعْلَمُ مَعَكَ فَقَامَ مُحَمَّدُ بْنُ مَسْلَمَةَ فَقَالَ مِثْلَ ذَلِكَ فَأَنْفَذَهُ لَهَا
It is narrated from Sayyiduna Qabeesah bin Dhu’ayb (may Allah be pleased with him) that a grandmother came to Sayyiduna Abu Bakr (may Allah be pleased with him) and demanded her share of inheritance, but he said: I do not know of any evidence in the Book of Allah or the Sunnah of the Messenger of Allah (peace and blessings be upon him) regarding your right. However, I will inquire about this from the people. Then he (may Allah be pleased with him) asked the people, and Sayyiduna Mugheerah bin Shu’bah (may Allah be pleased with him) said: I heard the Messenger of Allah (peace and blessings be upon him) say that he allotted one-sixth for the grandmother. Sayyiduna Abu Bakr (may Allah be pleased with him) said: Who will testify to this with you? Then Sayyiduna Muhammad bin Maslamah (may Allah be pleased with him) stood up and said the same thing as Sayyiduna Mugheerah (may Allah be pleased with him) had said. Thus, Sayyiduna Abu Bakr (may Allah be pleased with him) allotted this share for her.
Hadith 6360
(وَعَنْهُ مِنْ طَرِيقٍ ثَانٍ) بِنَحْوِهِ وَفِيهِ فَقَامَ مُحَمَّدُ بْنُ مَسْلَمَةَ فَقَالَ شَهِدْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقْضِي لَهَا بِالسُّدُسِ فَأَعْطَاهَا أَبُو بَكْرٍ السُّدُسَ
(Second chain) In this it is: Sayyiduna Muhammad bin Maslamah (may Allah be pleased with him) stood up and said: I was present with the Messenger of Allah (peace and blessings of Allah be upon him), and he (peace be upon him) decreed one-sixth for the grandmother, so Sayyiduna Abu Bakr (may Allah be pleased with him) enforced one-sixth for her.
Hadith 6361
عَنْ عُبَادَةَ بْنِ الصَّامِتِ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَضَى لِلْجَدَّتَيْنِ مِنَ الْمِيرَاثِ بِالسُّدُسِ بَيْنَهُمَا بِالسَّوَاءِ
It is narrated from Sayyiduna Ubadah bin Samit (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) decided to give both the paternal grandmother and the maternal grandmother an equal share of one-sixth each from the inheritance.
