بَابُ سُقُوطِ وَلَدِ الْآبِ بِالْإِخْوَةِ مِنَ الْأَبَوَيْنِ
Chapter: The exclusion of paternal sons by full siblings
Hadith 6358
عَنْ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ قَالَ إِنَّكُمْ تَقْرَءُونَ مِنْ بَعْدِ وَصِيَّةٍ يُوصَى بِهَا أَوْ دَيْنٍ وَأَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَضَى بِالدَّيْنِ قَبْلَ الْوَصِيَّةِ وَأَنَّ أَعْيَانَ بَنِي الْأُمِّ يَتَوَارَثُونَ دُونَ بَنِي الْعَلَّاتِ يَرِثُ الرَّجُلُ أَخَاهُ لِأَبِيهِ وَأُمِّهِ دُونَ أَخِيهِ لِأَبِيهِ
It is narrated from Sayyiduna Ali (may Allah be pleased with him), he says: You people recite this verse that (the inheritance will be distributed) after the bequest made by the deceased or the debt, whereas the Messenger of Allah (peace and blessings be upon him) ordered that the debt be paid before executing the bequest, and he also decided that (when full siblings and maternal siblings are together) the full siblings will be the heirs, not the maternal siblings. A man will inherit from his full brother, not from his maternal brother.
