Hadith 6356
عَنْ هُزَيْلِ بْنِ شُرَحْبِيلٍ رَضِيَ اللَّهُ عَنْهُ قَالَ سَأَلَ رَجُلٌ أَبَا مُوسَى الْأَشْعَرِيَّ عَنْ امْرَأَةٍ تَرَكَتْ ابْنَتَهَا وَابْنَةَ ابْنِهَا وَأُخْتَهَا فَقَالَ النِّصْفُ لِلْابْنَةِ وَلِلْأُخْتِ النِّصْفُ وَقَالَ ائْتِ ابْنَ مَسْعُودٍ فَإِنَّهُ سَيُتَابِعُنِي قَالَ فَأَتَوْا ابْنَ مَسْعُودٍ فَأَخْبَرُوهُ بِقَوْلِ أَبِي مُوسَى فَقَالَ لَقَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ لَأَقْضِيَنَّ فِيهَا بِقَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ شُعْبَةُ وَجَدْتُ هَذَا الْحَرْفَ مَكْتُوبًا لَأَقْضِيَنَّ فِيهَا بِقَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لِلْابْنَةِ النِّصْفُ وَلِابْنَةِ الْابْنِ السُّدُسُ تَكْمِلَةَ الثُّلُثَيْنِ وَمَا بَقِيَ فَلِلْأُخْتِ فَأَتَوْا أَبَا مُوسَى فَأَخْبَرُوهُ بِقَوْلِ ابْنِ مَسْعُودٍ فَقَالَ أَبُو مُوسَى لَا تَسْأَلُونِي عَنْ شَيْءٍ مَا دَامَ هَذَا الْحِبْرُ بَيْنَ أَظْهُرِكُمْ
Hazil bin Shurahbil says: A man asked Sayyiduna Abu Musa Ash'ari (may Allah be pleased with him) that a woman has passed away and she has left behind among her heirs a daughter, a granddaughter, and a sister. How much share will each of them receive from her inheritance? He replied: Half of the wealth will go to the daughter and half to the sister, and the granddaughter will be deprived. Along with this, he said: Go to Sayyiduna Ibn Mas'ud (may Allah be pleased with him), he will also agree with me. So he went, and when Sayyiduna Ibn Mas'ud (may Allah be pleased with him) was informed of the decision of Sayyiduna Abu Musa (may Allah be pleased with him), he said: If I also give the same decision, then I would go astray and would not remain on the right path. I will decide according to the decision of the Messenger of Allah (peace and blessings be upon him), and that is: the daughter will get half of the property, the granddaughter will get one-sixth, so that two-thirds of the wealth is completed among the children, and whatever remains will be given to the sister. Then the questioner came and informed Sayyiduna Abu Musa (may Allah be pleased with him) of the fatwa of Sayyiduna Ibn Mas'ud (may Allah be pleased with him). Upon this, Abu Musa (may Allah be pleased with him) said: As long as this ocean of knowledge is present among you, do not ask me any questions.
Hadith 6357
وَعَنْهُ أَيْضًا قَالَ جَاءَ رَجُلٌ إِلَى أَبِي مُوسَى وَسَلْمَانَ بْنِ رَبِيعَةَ فَسَأَلَهُمَا عَنْ ابْنَةٍ وَابْنَةِ ابْنٍ وَأُخْتٍ لِأَبٍ فَقَالَا لِلْبِنْتِ النِّصْفُ وَلِلْأُخْتِ النِّصْفُ وَأْتِ ابْنَ مَسْعُودٍ فَإِنَّهُ سَيُتَابِعُنَا قَالَ فَأَتَى ابْنَ مَسْعُودٍ فَسَأَلَهُ وَأَخْبَرَهُ بِمَا قَالَا فَقَالَ ابْنُ مَسْعُودٍ لَقَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ سَأَقْضِي بِمَا قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لِلْابْنَةِ النِّصْفُ وَلِابْنَةِ الْابْنِ السُّدُسُ تَكْمِلَةً لِلثُّلُثَيْنِ وَمَا بَقِيَ فَلِلْأُخْتِ
It is narrated from Huzail bin Shurahbeel that a man came to Sayyiduna Abu Musa Ash’ari (may Allah be pleased with him) and Sayyiduna Salman bin Rabee’ (may Allah be pleased with him) and asked them: Among the heirs are a daughter, a granddaughter (son’s daughter), and a uterine sister. They said: Half of the estate will go to the daughter and half to the sister, and go to Sayyiduna Ibn Mas’ud (may Allah be pleased with him), he will also agree with our verdict. But when the questioner went to Sayyiduna Ibn Mas’ud (may Allah be pleased with him) and informed him of their verdict, Sayyiduna Ibn Mas’ud (may Allah be pleased with him) said: If I also decide in this way, I will have gone astray from the right path; I will give the verdict of the Messenger of Allah (peace and blessings be upon him), and that is: half to the daughter, one-sixth to the granddaughter, so that two-thirds are completed, and whatever remains will go to the sister.
