Hadith 6352
عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ الْحِقُوا الْفَرَائِضَ بِأَهْلِهَا فَمَا بَقِيَ فَهُوَ لِأَوْلَى رَجُلٍ ذَكَرٍ
Narrated by Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him) said: "Give the prescribed shares to those who are entitled to them, then whatever remains, it is for the nearest male relative."
Hadith 6353
وَعَنْهُ أَيْضًا قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ اقْسِمُوا الْمَالَ بَيْنَ أَهْلِ الْفَرَائِضِ عَلَى كِتَابِ اللَّهِ تَبَارَكَ وَتَعَالَى فَمَا تَرَكَتِ الْفَرَائِضُ فَلِأَوْلَى ذَكَرٍ
Narrated by Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both): The Messenger of Allah said: Distribute the wealth among the rightful heirs (Ashab al-Furud) according to the Book of Allah; whatever remains after the prescribed shares, it will be for the closest male relative.
Hadith 6354
عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُمَا قَالَ جَاءَتِ امْرَأَةُ سَعْدِ بْنِ الرَّبِيعِ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِابْنَتَيْهَا مِنْ سَعْدٍ فَقَالَتْ يَا رَسُولَ اللَّهِ هَاتَانِ ابْنَتَا سَعْدِ بْنِ الرَّبِيعِ قُتِلَ أَبُوهُمَا مَعَكَ فِي أُحُدٍ شَهِيدًا وَإِنَّ عَمَّهُمَا أَخَذَ مَالَهُمَا فَلَمْ يَدَعْ لَهُمَا مَالًا وَلَا يُنْكَحَانِ إِلَّا وَلَهُمَا مَالٌ قَالَ فَقَالَ يَقْضِي اللَّهُ فِي ذَلِكَ فَنَزَلَتْ آيَةُ الْمِيرَاثِ فَأَرْسَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِلَى عَمِّهِمَا فَقَالَ أَعْطِ ابْنَتَيْ سَعْدٍ الثُّلُثَيْنِ وَأُمَّهُمَا الثُّمُنَ وَمَا بَقِيَ فَهُوَ لَكَ
Narrated by Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) that the wife of Sayyiduna Sa’d bin Rabi’ (may Allah be pleased with him) came to the Messenger of Allah (peace and blessings be upon him) with her two daughters and said: O Messenger of Allah! These are the two daughters of Sa’d (may Allah be pleased with him); their father was martyred in the Battle of Uhud with you (peace and blessings be upon him), and now their uncle has taken all the wealth. Obviously, if these daughters have no wealth, no man will be willing to marry them. The Prophet (peace and blessings be upon him) said: Allah Almighty will decide about this matter. Then the verse of inheritance was revealed, and the Messenger of Allah (peace and blessings be upon him) called the uncle of the girls and said: Give two-thirds to Sa’d’s daughters and one-eighth to their mother, and whatever remains is yours.
Hadith 6355
عَنْ زَيْدِ بْنِ ثَابِتٍ رَضِيَ اللَّهُ عَنْهُ أَنَّهُ سُئِلَ عَنْ زَوْجٍ وَأُخْتٍ لِأُمٍّ وَأَبٍ فَأَعْطَى الزَّوْجَ النِّصْفَ وَالْأُخْتَ النِّصْفَ فَكُلِّمَ فِي ذَلِكَ فَقَالَ سَيِّدُنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَضَى بِذَلِكَ
Sayyiduna Zaid bin Thabit (may Allah be pleased with him) was asked about the inheritance of a deceased woman’s husband and her full sister. So he gave half to the husband and half to the sister. And when he was spoken to about this, he said: Our leader, the Messenger of Allah (peace and blessings be upon him), made this very decision.
