Hadith 6337
عَنْ أُسَامَةَ بْنِ زَيْدٍ رَضِيَ اللَّهُ عَنْهُمَا أَنَّهُ قَالَ يَا رَسُولَ اللَّهِ أَيْنَ تَنْزِلُ غَدًا إِنْ شَاءَ اللَّهُ وَذَلِكَ زَمَنَ الْفَتْحِ فَقَالَ هَلْ تَرَكَ لَنَا عَقِيلٌ مِنْ مَنْزِلٍ ثُمَّ قَالَ لَا يَرِثُ الْكَافِرُ الْمُؤْمِنَ وَلَا الْمُؤْمِنُ الْكَافِرَ وَفِي لَفْظٍ الْمُسْلِمُ بَدَلَ الْمُؤْمِنِ
Narrated by Sayyiduna Usama bin Zaid (may Allah be pleased with him), he says: I said, "O Messenger of Allah! If Allah wills, where will you stay in Makkah tomorrow?" This was during the time of the conquest of Makkah. The Prophet (peace and blessings be upon him) said, "Has Aqeel left any place for us?" Then the Prophet (peace and blessings be upon him) said, "A disbeliever cannot inherit from a believer, nor can a believer inherit from a disbeliever."
Hadith 6338
عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ لَا يَتَوَارَثُ أَهْلُ مِلَّتَيْنِ شَتَّى
It is narrated from Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: Those of two different religions will not inherit from each other.
Hadith 6339
عَنْ أَبِي الْأَسْوَدِ الدِّيلِيِّ رَضِيَ اللَّهُ عَنْهُ قَالَ كَانَ مُعَاذٌ بِالْيَمَنِ فَارْتَفَعُوا إِلَيْهِ فِي يَهُودِيٍّ مَاتَ وَتَرَكَ أَخَاهُ مُسْلِمًا فَقَالَ مُعَاذٌ إِنِّي سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ إِنَّ الْإِسْلَامَ يَزِيدُ وَلَا يَنْقُصُ فَوَرَّثَهُ
Abu Aswad Daili says that Sayyiduna Mu'adh (may Allah be pleased with him) was in Yemen. People brought to him the case of a Jew who had died and had left behind a Muslim brother as his heir. Sayyiduna Mu'adh (may Allah be pleased with him) said: I heard the Messenger of Allah (peace and blessings be upon him) say that Islam increases, it does not decrease. Then he made that Muslim the heir of the Jew.
Hadith 6340
عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ رَضِيَ اللَّهُ عَنْهُ قَالَ قَتَلَ رَجُلٌ ابْنَهُ عَمَدًا فَرُفِعَ إِلَى عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ فَجَعَلَ عَلَيْهِ مِنَ الْإِبِلِ ثَلَاثِينَ حِقَّةً وَثَلَاثِينَ جَذَعَةً وَأَرْبَعِينَ ثَنِيَّةً وَقَالَ لَا يَرِثُ الْقَاتِلُ وَلَوْلَا أَنِّي سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ لَا يُقْتَلُ وَالِدٌ بِوَلَدِهِ لَقَتَلْتُكَ
It is narrated from Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with them both) that a man deliberately killed his son. When his case was presented before Sayyiduna Umar bin Khattab (may Allah be pleased with him), he determined as blood money for the killer thirty hiqqahs, thirty jadh’ahs, and forty two-toothed camels, and said: The killer does not become an heir. Then he said: If I had not heard the Messenger of Allah (peace and blessings be upon him) say that a father should not be killed in retaliation for his child, I would have killed you in retribution.
Hadith 6341
وَعَنْهُ أَيْضًا قَالَ قَالَ عُمَرُ لَوْلَا أَنِّي سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ لَيْسَ لِلْقَاتِلِ شَيْءٌ لَوَرَّثْتُكَ قَالَ وَدَعَا أَخَا الْمَقْتُولِ فَأَعْطَاهُ الْإِبِلَ
It is narrated from Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with them both) that Sayyiduna Umar (may Allah be pleased with him) said: If I had not heard the Messenger of Allah (peace and blessings be upon him) say that the killer does not inherit anything, I would have made you the heir of the murdered son. Then he called the brother of the murdered person and gave him camels.
Hadith 6342
وَعَنْهُ أَيْضًا قَالَ أَخَذَ عُمَرُ مِنَ الْإِبِلِ ثَلَاثِينَ حِقَّةً وَثَلَاثِينَ جَذَعَةً وَأَرْبَعِينَ ثَنِيَّةً إِلَى بَازِلِ عَامِهَا كُلُّهَا خَلِفَةٌ قَالَ ثُمَّ دَعَا أَخَا الْمَقْتُولِ فَأَعْطَاهَا إِيَّاهُ دُونَ أَبِيهِ وَقَالَ سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ لَيْسَ لِقَاتِلٍ شَيْءٌ وَفِي لَفْظٍ مِيرَاثٌ
It is narrated from Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with them both) that Sayyiduna Umar (may Allah be pleased with him) took thirty hiqqahs, thirty jadh’ahs, and forty such she-camels which were from two-toothed up to entering the ninth year, and all of them were pregnant. Then he called the brother of the murdered man and gave him all these camels, and gave nothing to the father, and said: I heard the Messenger of Allah (peace and blessings of Allah be upon him) say that the killer has no share in inheritance.
