بَابُ مَا جَاءَ فِي تَفْسِيرِ الْعُمْرَى وَلِمَنْ يَكُونَ الْقَضَاءُ بها
Chapter: What has been reported regarding the interpretation of ‘umra and to whom its judgment belongs
Hadith 6307
عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُمَا قَالَ إِنَّمَا الْعُمْرَى الَّتِي أَجَازَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنْ يَقُولَ هِيَ لَكَ وَلِعَقِبِكَ فَأَمَّا إِذَا قَالَ فَهِيَ لَكَ فَإِنَّمَا تَرْجِعُ إِلَى صَاحِبِهَا
Narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them), he says: The Umra (gift for life) which the Messenger of Allah (peace and blessings of Allah be upon him) enforced, its form is that the giver says: "This thing is for you and for your heirs." When he only says: "This thing is for you," then that thing will return to the original owner.
Hadith 6308
عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ رَجُلًا مِنَ الْأَنْصَارِ أَعْطَى أُمَّهُ حَدِيقَةً مِنْ نَخْلٍ حَيَاتَهَا فَمَاتَتْ فَجَاءَ إِخْوَتُهُ فَقَالُوا نَحْنُ فِيهِ شَرْعٌ سَوَاءٌ فَأَبَى فَاخْتَصَمُوا إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَسَمَهَا بَيْنَهُمْ مِيرَاثًا
It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) that an Ansari gave a date orchard to his mother for her lifetime. When his mother passed away, the other brothers of this Ansari came and said, "We are all equal partners in this orchard." But he refused. So they brought the dispute to the Noble Prophet (peace and blessings be upon him). The Prophet (peace and blessings be upon him) divided the orchard among them as inheritance.
Hadith 6309
عَنْ سُلَيْمَانَ بْنِ يَسَّارٍ رَضِيَ اللَّهُ عَنْهُ أَنَّ أَمِيرًا كَانَ بِالْمَدِينَةِ يُقَالُ لَهُ طَارِقٌ قَضَى بِالْعُمْرَى لِلْوَارِثِ عَلَى قَوْلِ جَابِرِ بْنِ عَبْدِ اللَّهِ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ
Sulaiman bin Yasar (may Allah have mercy on him) says that a nobleman of Madinah named Tariq had given a verdict in favor of the heir regarding something given as 'Umra, and this verdict was in light of the hadith narrated by Sayyiduna Jabir (may Allah be pleased with him) from the Messenger of Allah (peace and blessings of Allah be upon him).
Hadith 6310
عَنْ زَيْدِ بْنِ ثَابِتٍ رَضِيَ اللَّهُ عَنْهُ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ جَعَلَ الْعُمْرَى وَفِي لَفْظٍ قَضَى بِالْعُمْرَى لِلْوَارِثِ
It is narrated from Sayyiduna Zaid bin Thabit (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) ruled that the thing given as 'Umra belongs to the heir.
Hadith 6311
حَدَّثَنَا عَبْدُ الرَّزَّاقِ وَمُحَمَّدُ بْنُ بَكْرٍ قَالَا أَنْبَأَنَا جُرَيْجٌ أَخْبَرَنِي ابْنُ شِهَابٍ الزُّهْرِيُّ عَنْ حَدِيثِ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ الْأَنْصَارِيِّ رَضِيَ اللَّهُ عَنْهُمَا أَخْبَرَنِي أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَضَى أَيُّمَا رَجُلٍ أَعْمَرَ رَجُلًا عُمْرَى لَهُ وَلِعَقِبِهِ فَقَالَ قَدْ أَعْطَيْتُكَهَا وَعَقِبَكَ مَا بَقِيَ مِنْكُمْ أَحَدٌ فَإِنَّمَا هِيَ قَالَ ابْنُ بَكْرٍ لِمَنْ أُعْطَاهَا وَقَالَ عَبْدُ الرَّزَّاقِ لِمَنْ أُعْطِيَهَا وَأَنَّهَا لَا تَرْجِعُ إِلَى صَاحِبِهَا مِنْ أَجْلِ أَنَّهُ أَعْطَاهَا عَطَاءً وَقَعَتْ فِيهِ الْمَوَارِيثُ
Sayyiduna Jabir bin Abdullah Ansari (may Allah be pleased with them both) narrates that the Messenger of Allah (peace and blessings be upon him and his family) gave a ruling regarding ‘Umra, saying: If a person gives something as ‘Umra to another person and his descendants, saying: “I have given this thing to you and your descendants, as long as any of you remain,” then this thing will belong to the one to whom it was given, and it will not return to the original owner, because he has given such a gift in which the laws of inheritance have already come into effect.
