بَابُ مَا جَاءَ فِي جَوَازِهِمَا
Chapter: What has been reported regarding their permissibility
Hadith 6298
عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مَنْ أَعْمَرَ عُمْرَى فَهِيَ لِمَنْ أَعْمَرَهَا جَائِزَةٌ وَمَنْ أَرْقَبَ رُقْبَى فَهِيَ لِمَنْ أَرْقَبَهَا جَائِزَةٌ وَمَنْ وَهَبَ هِبَةً ثُمَّ عَادَ فِيهَا فَهُوَ كَالْعَائِدِ فِي قَيْئِهِ
Narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: Whoever gives ‘Umra (a gift of property for life), it will be established for the one to whom it is given; likewise, whoever gives Ruqba (a gift of property until the death of either the giver or receiver), it will also be established for the one to whom it is given; and whoever gives something as a gift and then takes it back, he is like a man who eats his own vomit.
Hadith 6299
عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ الْعُمْرَى مِيرَاثٌ لِأَهْلِهَا أَوْ جَائِزَةٌ
Narrated by Sayyiduna Abu Hurairah (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) said: Whoever is given ‘Umra, it will become the inheritance of his family or it will be executed for him.
Hadith 6300
عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ الْعُمْرَى جَائِزَةٌ لِأَهْلِهَا وَالرُّقْبَى جَائِزَةٌ لِأَهْلِهَا
Narrated by Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them) that the Messenger of Allah (peace and blessings be upon him) said: ‘Umra and Ruqba become effective for those to whom they are given.’
Hadith 6301
عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَجُلًا قَالَ يَا رَسُولَ اللَّهِ إِنِّي أَعْطَيْتُ أُمِّي حَدِيقَةً حَيَاتَهَا وَأُمُّهَا مَاتَتْ فَلَمْ تَتْرُكْ وَارِثًا غَيْرِي فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَجَبَتْ صَدَقَتُكَ وَرَجَعَتْ إِلَيْكَ حَدِيقَتُكَ
Narrated from Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with them both) that a man said: O Messenger of Allah! I had given my mother a garden for her lifetime, now she has passed away and has not left any heir except me. The Messenger of Allah (peace and blessings be upon him) said: Your charity is established, and your garden has also returned to you as inheritance.
