It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: There is pre-emption (shuf‘a) in every jointly owned thing, whether it is a house or a garden. It is not permissible for one partner to sell such a thing until he informs his partner about it. If he sells it without informing his partner, then the partner has more right to it, until he is informed.
It is narrated from Sayyiduna Ubadah bin Samit (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) decreed the right of pre-emption among partners in land and houses.
Narrated by Sayyiduna Samurah bin Janab (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: The neighbor of the house has more right to buy the house than others.
Narrated by Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: The neighbor has more right to the pre-emption (the share being sold) of his neighbor; if he is absent, he should be waited for, but this greater right will be when their path is one.
Narrated by Sayyiduna Shureid bin Suwaid Thaqafi (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) said: The neighbor of the house has more right to the house than others.
It is narrated from Sayyiduna Ali and Abdullah bin Mas'ud (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) gave judgment on the basis of the right of the neighbor.
It is narrated from Sayyiduna Shureid bin Suwaid, may Allah be pleased with him, he says: O Messenger of Allah! There is a piece of land in which there is neither any partnership nor any share of anyone, except that there is only a neighbor? You (peace and blessings be upon him) said: The neighbor has more right because of being close, whatever the thing may be.
It is narrated from Sayyiduna Abu Rafi’ (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him and his family) said: The neighbor, due to his closeness, has more right to purchase a thing.
