مسائل الغصبIssues of Usurpation
بَابُ رَبِّ الْمَعْصُوبِ بِعَيْنِهِ إِنْ كَانَ بَاقِيًا ، وَقِيمَتِهِ إِنْ كَانَ مِنْ ذَوَاتِ الْقِيمِ أَوْ رَدِ مِثْلِهِ إِنْ كَانَ مِنْ ذَوَاتِ الأَمْثَالِ إِذَا أَتْلَفَهُ الْغَاصِبُ أَوْ تَلَفَ فِي يَدِهِ
Chapter: The owner is entitled to the same item if it remains, its value if it is among valuables, or its like if it is among fungibles, if the usurper destroys it or it perishes in his hand
Hadith 6206
عَنْ سَمُرَةَ بْنِ جُنْدُبٍ رَضِيَ اللَّهُ عَنْهُ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ عَلَى الْيَدِ مَا أَخَذَتْ حَتَّى تُؤَدِّيَهُ ثُمَّ نَسِيَ الْحَسَنُ قَالَ لَا يَضْمَنُ
Narrated by Sayyiduna Samurah bin Jundub (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) said: Whatever the hand takes, it remains a responsibility upon him until he pays it back. Then Hasan Basri forgot and said: He is not liable.
Hadith 6207
عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا قَالَتْ مَا رَأَيْتُ صَانِعَةَ طَعَامٍ مِثْلَ صَفِيَّةَ أَهْدَتْ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِنَاءً فِيهِ طَعَامٌ وَهُوَ عِنْدِي فَمَا مَلَكْتُ نَفْسِي أَنْ كَسَرْتُهُ قَالَتْ فَنَظَرَ إِلَيَّ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَعَرَفْتُ الْغَضَبَ فِي وَجْهِهِ فَقُلْتُ أَعُوذُ بِرَسُولِ اللَّهِ أَنْ يَلْعَنَنِي الْيَوْمَ فَقُلْتُ يَا رَسُولَ اللَّهِ مَا كَفَّارَتُهُ فَقَالَ إِنَاءٌ بِإِنَاءٍ وَطَعَامٌ بِطَعَامٍ
Narrated from Sayyidah Aisha (may Allah be pleased with her), she says: I have not seen anyone who could prepare food like Sayyidah Safiyyah (may Allah be pleased with her). Once, she sent food to the Prophet Muhammad (peace and blessings be upon him) in a vessel while he was with me. I could not control myself and (out of jealousy) I broke the vessel. The Prophet (peace and blessings be upon him) was looking at me, and signs of anger appeared on his face. I said: I seek refuge from the Messenger of Allah (peace and blessings be upon him) cursing me today. Then I asked: O Messenger of Allah! What is the expiation for this? He (peace and blessings be upon him) said: A vessel for a vessel and food for food.
