باب مَا جَاءَ فِي التَفَاضُلِ وَالنَّسِيئَةِ فِي غَيْرِ الْمَكِيْلِ والمَوزُون وبيع اللحم بالحيوان
Chapter: What has been reported regarding disparity and delay in non-measured and non-weighed items, and selling meat for live animals
Hadith 5997
عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ الْأَنْصَارِيِّ رَضِيَ اللَّهُ عَنْهُمَا قَالَ نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ عَنْ بَيْعِ الْحَيَوَانِ بِالْحَيَوَانِ نَسِيئَةً اثْنَيْنِ بِوَاحِدٍ وَلَا بَأْسَ بِهِ يَدًا بِيَدٍ
It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them) that the Messenger of Allah (peace and blessings be upon him) forbade selling an animal for another animal on credit, that is, exchanging one animal for two animals on deferred payment. If it is cash for cash, then there is no harm in it.
Hadith 5998
عَنْ جَابِرِ بْنِ سَمُرَةَ رَضِيَ اللَّهُ عَنْهُ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ نَهَى عَنْ بَيْعِ الْحَيَوَانِ بِالْحَيَوَانِ نَسِيئَةً
It is narrated from Sayyiduna Jabir bin Samurah (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) forbade trading one animal for another on credit.
Hadith 5999
عَنْ سَمُرَةَ بْنِ جُنْدُبٍ رَضِيَ اللَّهُ عَنْهُ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مِثْلَهُ
Sayyiduna Samurah bin Jundub (may Allah be pleased with him) has also narrated a similar tradition.
Hadith 6000
عَنْ أَنَسِ بْنِ مَالِكٍ رَضِيَ اللَّهُ عَنْهُ أَنَّ صَفِيَّةَ رَضِيَ اللَّهُ عَنْهَا وَقَعَتْ فِي سَهْمِ دِحْيَةَ الْكَلْبِيِّ فَقِيلَ يَا رَسُولَ اللَّهِ قَدْ وَقَعَتْ فِي سَهْمِ دِحْيَةَ جَارِيَةٌ جَمِيلَةٌ فَاشْتَرَاهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِسَبْعَةِ أَرْؤُسٍ
It is narrated from Sayyiduna Anas (may Allah be pleased with him) that Sayyidah Safiyyah (may Allah be pleased with her) came into the share of Sayyiduna Dihyah Kalbi (may Allah be pleased with him). Someone said: O Messenger of Allah! A beautiful slave girl has come into the share of Sayyiduna Dihyah (may Allah be pleased with him). Then the Messenger of Allah (peace and blessings be upon him) bought her in exchange for seven individuals.
Hadith 6001
عَنْ عُمَرَ بْنِ الْحَرِيشِ قَالَ سَأَلْتُ عَبْدَ اللَّهِ بْنَ عَمْرِو بْنِ الْعَاصِ رَضِيَ اللَّهُ عَنْهُمَا فَقُلْتُ إِنَّا بِأَرْضٍ لَيْسَ فِيهَا دِينَارٌ وَلَا دِرْهَمٌ وَإِنَّمَا نُبَايِعُ بِالْإِبِلِ وَالْغَنَمِ إِلَى أَجَلٍ فَمَا تَرَى فِي ذَلِكَ قَالَ عَلَى الْخَبِيرِ سَقَطْتَ جَهَّزَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ جَيْشًا عَلَى إِبِلٍ مِنْ إِبِلِ الصَّدَقَةِ حَتَّى نَفِدَتْ وَبَقِيَ نَاسٌ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ اشْتَرِ لَنَا إِبِلًا بِقَلَائِصَ مِنْ إِبِلِ الصَّدَقَةِ إِذَا جَاءَتْ حَتَّى نُؤَدِّيهَا إِلَيْهِمْ فَاشْتَرَيْتُ الْبَعِيرَ بِالِاثْنَيْنِ وَالثَّلَاثِ قَلَائِصَ حَتَّى فَرَغْتُ فَأَدَّى ذَلِكَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مِنْ إِبِلِ الصَّدَقَةِ
Umar bin Harish says: I asked Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with them both) that we are in a place where there is neither dinar nor dirham, so we do transactions of camels and goats on credit for a certain period; what is your opinion about this? Sayyiduna Abdullah (may Allah be pleased with him) said: You have asked a knowledgeable person about this issue. The matter is that the Messenger of Allah (peace and blessings be upon him) prepared an army from the camels of charity, but the preparation was not yet complete when the camels ran out, while the people's need still remained. The Messenger of Allah (peace and blessings be upon him) said to me: Buy camels for us in exchange for the charity she-camels; when they become available, we will pay the owners. Then I bought one camel in exchange for two or three she-camels, until the number was completed. Then, when the charity camels arrived, the Messenger of Allah (peace and blessings be upon him) paid them.
