بَابُ حُجَّةِ مَنْ رَأَى جَوَازُ التَّفَاضُل فِي الْجِنْسِ إِذَا كَانَ يدا بيد
Chapter: The evidence of those who allow disparity in the same kind if it is hand to hand
Hadith 5981
عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا عَنْ أُسَامَةَ بْنِ زَيْدٍ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ لَا رِبًا فِيمَا كَانَ يَدًا بِيَدٍ قَالَ يَعْنِي إِنَّمَا الرِّبَا فِي النَّسَاءِ وَفِي لَفْظٍ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ الرِّبَا فِي النَّسِيئَةِ
Narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them) that Sayyiduna Usama bin Zaid (may Allah be pleased with them) reports that the Messenger of Allah (peace and blessings be upon him) said: There is no usury in hand-to-hand trade. That is, usury is only in deferred transactions. In another narration, the Messenger of Allah (peace and blessings be upon him) said: Usury is in deferred transactions.
Hadith 5982
عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا عَنْ أُسَامَةَ بْنِ زَيْدٍ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ لَا رِبًا فِيمَا كَانَ يَدًا بِيَدٍ قَالَ يَعْنِي إِنَّمَا الرِّبَا فِي النَّسَاءِ وَفِي لَفْظٍ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ الرِّبَا فِي النَّسِيئَةِ
Narrated by Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that Sayyiduna Usama bin Zaid (may Allah be pleased with them both) reports that the Messenger of Allah (peace and blessings be upon him) said: In a hand-to-hand transaction, there is no usury. That is, usury is only in deferred payment. In another narration, the Messenger of Allah (peace and blessings be upon him) said: Usury is in deferred payment.
Hadith 5983
عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ حَدَّثَنِي أُسَامَةُ بْنُ زَيْدٍ رَضِيَ اللَّهُ عَنْهُ أَنَّهُ سَمِعَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ لَا رِبَا إِلَّا فِي النَّسِيئَةِ
It is narrated from Sayyiduna Usama bin Zaid (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: There is no usury except in credit.
Hadith 5984
عَنْ يَحْيَى بْنِ قَيْسٍ الْمَازَنِيِّ قَالَ سَأَلْتُ عَطَاءً عَنِ الدِّينَارِ بِالدِّينَارِ وَبَيْنَهُمَا فَضْلٌ وَالدِّرْهَمِ بِالدِّرْهَمِ قَالَ كَانَ ابْنُ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا يُحِلُّهُ فَقَالَ ابْنُ الزُّبَيْرِ إِنَّ ابْنَ عَبَّاسٍ يُحَدِّثُ بِمَا لَمْ يَسْمَعْ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَبَلَغَ ابْنَ عَبَّاسٍ فَقَالَ إِنِّي لَمْ أَسْمَعْهُ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَلَكِنْ أُسَامَةُ بْنُ زَيْدٍ رَضِيَ اللَّهُ عَنْهُ حَدَّثَنِي أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ لَيْسَ الرِّبَا إِلَّا فِي النَّسِيئَةِ أَوِ النَّظِرَةِ
Yahya bin Qais Mazni says: I asked Imam Ata whether, when trading dinar for dinar and dirham for dirham, there can be any increase or decrease. He said: Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) considered it permissible. Sayyiduna Ibn Zubair (may Allah be pleased with them both) said: Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates matters which he did not himself hear from the Messenger of Allah (peace and blessings be upon him). When this reached him, he said: Indeed, I did not myself hear this hadith from the Messenger of Allah (peace and blessings be upon him), but Sayyiduna Usama bin Zaid (may Allah be pleased with them both) narrated to me that the Messenger of Allah (peace and blessings be upon him) said that there is no usury except in credit.
Hadith 5985
عَنْ أَبِي صَالِحٍ قَالَ سَمِعْتُ أَبَا سَعِيدٍ رَضِيَ اللَّهُ عَنْهُ يَقُولُ الذَّهَبُ بِالذَّهَبِ وَزْنًا بِوَزْنٍ قَالَ فَلَقِيتُ ابْنَ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا فَقُلْتُ أَرَأَيْتَ مَا تَقُولُ أَشَيْئًا وَجَدْتَهُ فِي كِتَابِ اللَّهِ أَوْ سَمِعْتَهُ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ لَيْسَ بِشَيْءٍ وَجَدْتُهُ فِي كِتَابِ اللَّهِ أَوْ سَمِعْتُهُ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَلَكِنْ أَخْبَرَنِي أُسَامَةُ بْنُ زَيْدٍ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ الرِّبَا فِي النَّسِيئَةِ
Abu Salih says: When I heard Abu Saeed saying that gold for gold should be equal, I met Sayyiduna Ibn Abbas (may Allah be pleased with them both) and said to him: What is your opinion about what you say, have you found this thing in the Noble Qur'an or heard it from the Messenger of Allah (peace and blessings be upon him)? He said: This is not something that I have found in the Book of Allah or heard from the Messenger of Allah (peace and blessings be upon him), rather Sayyiduna Usamah bin Zaid (may Allah be pleased with them both) informed me that the Messenger of Allah (peace and blessings be upon him) said that usury is in credit.
Hadith 5986
عَنْ ذَكْوَانَ قَالَ أَرْسَلَنِي أَبُو سَعِيدٍ الْخُدْرِيُّ رَضِيَ اللَّهُ عَنْهُ إِلَى ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا قَالَ قُلْ لَهُ فِي الصَّرْفِ أَسَمِعْتَ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مَا لَمْ نَسْمَعْ أَوْ قَرَأْتَ فِي كِتَابِ اللَّهِ عَزَّ وَجَلَّ مَا لَمْ نَقْرَأْ قَالَ بِكُلٍّ لَا أَقُولُ وَلَكِنْ سَمِعْتُ أُسَامَةَ بْنَ زَيْدٍ رَضِيَ اللَّهُ عَنْهُ يُحَدِّثُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ لَا رِبًا إِلَّا فِي الدَّيْنِ أَوْ قَالَ فِي النَّسِيئَةِ
Dhakwan says: Sayyiduna Abu Sa'id Khudri (may Allah be pleased with him) sent me to Sayyiduna Ibn Abbas (may Allah be pleased with them both) and said: Ask him about the transaction of sarf (exchange of gold and silver), whether you have heard any hadith from the Messenger of Allah (peace and blessings be upon him) which we have not heard, or have you read anything in the Book of Allah which we have not read? He replied: I do not narrate any such hadith. The matter is that Sayyiduna Usama bin Zaid (may Allah be pleased with them both) has narrated that the Messenger of Allah (peace and blessings be upon him) said: There is no usury except in credit.
Hadith 5987
عَنْ سُلَيْمَانَ بْنِ عَلِيٍّ الرَّبْعِيِّ حَدَّثَنَا أَبُو الْجَوْزَاءِ غَيْرَ مَرَّةٍ قَالَ سَأَلْتُ ابْنَ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا عَنِ الصَّرْفِ يَدًا بِيَدٍ فَقَالَ لَا بَأْسَ بِذَلِكَ اثْنَيْنِ بِوَاحِدٍ أَكْثَرُ مِنْ ذَلِكَ وَأَقَلُّ قَالَ ثُمَّ حَجَجْتُ مَرَّةً أُخْرَى وَالشَّيْخُ حَيٌّ فَأَتَيْتُهُ فَسَأَلْتُهُ عَنِ الصَّرْفِ فَقَالَ وَزْنًا بِوَزْنٍ قَالَ فَقُلْتُ إِنَّكَ قَدْ أَفْتَيْتَنِي اثْنَيْنِ بِوَاحِدٍ فَلَمْ أَزَلْ أُفْتِي بِهِ مُنْذُ أَفْتَيْتَنِي فَقَالَ إِنَّ ذَلِكَ كَانَ عَنْ رَأْيِي وَهَذَا أَبُو سَعِيدٍ الْخُدْرِيُّ رَضِيَ اللَّهُ عَنْهُ يُحَدِّثُ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَتَرَكْتُ رَأْيِي إِلَى حَدِيثِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ
Sulaiman bin Ali Rabee says: Abu Juza’ has narrated to us many times, he says: I asked Sayyiduna Ibn Abbas (may Allah be pleased with them both) about the exchange sale (bay’ sarf), he said: There is no harm if it is two for one, or more, or less. When I went for Hajj the next time, this elder was still alive, I came to him and asked again about the exchange sale. He said: It should be equal in weight. I said: You gave me the fatwa that it can be two for one, and I have been giving this fatwa since then? He said: That was my opinion, now Sayyiduna Abu Saeed Khudri (may Allah be pleased with him) has narrated to me (that this is usury), so I have abandoned my opinion because of this hadith of the Messenger of Allah (peace and blessings be upon him).
