Hadith 5914
عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُمَا قَالَ كُنْتُ أَسِيرُ عَلَى جَمَلٍ لِي فَأَعْيَا فَأَرَدْتُ أَنْ أُسَيِّبَهُ قَالَ فَلَحِقَنِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَضَرَبَهُ بِرِجْلِهِ وَدَعَا لَهُ فَسَارَ سَيْرًا لَمْ يَسِرْ مِثْلَهُ وَقَالَ بِعْنِيهِ بِوُقِيَّةٍ فَكَرِهْتُ أَنْ أَبِيعَهُ قَالَ بِعْنِيهِ فَبِعْتُهُ مِنْهُ وَاشْتَرَطْتُ حُمْلَانَهُ إِلَى أَهْلِي فَلَمَّا قَدِمْنَا أَتَيْتُهُ بِالْجَمَلِ فَقَالَ ظَنَنْتَ حِينَ مَاكَسْتَكَ أَنْ أَذْهَبَ بِجَمَلِكَ خُذْ جَمَلَكَ وَثَمَنَهُ هُمَا لَكَ
It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both), he says: I was traveling while riding on a camel, suddenly it became exhausted, and I was about to abandon it when the Messenger of Allah (peace and blessings be upon him) met me. He (peace and blessings be upon him) struck it with his foot and prayed for it, then it walked in such a manner as it had never walked before. Then the Prophet (peace and blessings be upon him) said: Sell me this camel for one uqiyah. But I was reluctant to make the deal, yet the Prophet (peace and blessings be upon him) said: Sell it to me. So I sold it, but on the condition that I could ride it until I reached my family. When we reached Madinah, I brought the camel to the Prophet (peace and blessings be upon him). He (peace and blessings be upon him) said: Do you think I wanted to take your camel by offering a low price? Here, take your camel and take its price; both are yours.
Hadith 5915
فِيهِ حَدِيثُ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا حِينَمَا اشْتَرَتْ بَرِيرَةَ لِتُعْتِقَهَا وَاشْتَرَطَ أَهْلُهَا أَنْ يَكُونَ وَلَاؤُهَا لَهُمْ فَقَالَ لَهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ اشْتَرِيهَا فَأَعْتِقِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ انظر فتح الربانی: 2/2300
It is the hadith of Sayyida Aisha (may Allah be pleased with her), when she wanted to free Sayyida Barirah (may Allah be pleased with her), but her owners set the condition that the wala’ (right of inheritance/loyalty) would remain with them. But the Noble Prophet (peace and blessings be upon him) said: Buy her and set her free; the wala’ belongs only to the one who sets free.
وَعَنْهُ أَيْضًا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَلَهُ مَالُهُ وَعَلَيْهِ دَيْنُهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ
It is also narrated from Sayyiduna Jabir bin Abdullah, may Allah be pleased with him, that the Messenger of Allah, peace and blessings be upon him, said: Whoever sells a slave and the slave possesses some wealth, then that wealth will belong to the seller, and any debt of the slave will also be the responsibility of the seller, unless the buyer stipulates otherwise.
