Hadith 5855
عَنْ عُبَادَةَ بْنِ الصَّامِتِ رَضِيَ اللَّهُ عَنْهُ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَضَى أَنَّ ثَمَرَ النَّخْلِ لِمَنْ أَبَّرَهَا إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَقَضَى أَنَّ مَالَ الْمَمْلُوكِ لِمَنْ بَاعَهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ
It is narrated from Sayyiduna Ubadah bin Samit (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) decreed that the fruit of the date-palm will belong to the one who performed the grafting, unless the buyer stipulates a condition. Similarly, the wealth of a slave will belong to the seller, unless the buyer stipulates a condition at the time of purchase.
