بَابُ الْأمْرِ بِأَبْرَارِ الْمُقْسَمِ وَالرُّحْصَةِ فِي تَرْكِهِ لِلْعُدْرِ وَمَنْ كَذَّبَ بَصَرَهُ وَصَدَّقَ الْحَالِفَ
Chapter on the Command to Fulfill the Request of the One Who Swears, the Concession to Leave It for Excuse, and Whoever Disbelieved His Eyes and Believed the Oath-Taker

Hadith 5332
عَنْ مُجَاهِدٍ قَالَ كَانَ رَجُلٌ مِنَ الْمُهَاجِرِينَ يُقَالُ لَهُ عَبْدُ الرَّحْمَنِ بْنُ صَفْوَانَ وَكَانَ لَهُ بَلَاءٌ فِي الْإِسْلَامِ حَسَنٌ وَكَانَ صَدِيقًا لِلْعَبَّاسِ فَلَمَّا كَانَ يَوْمُ فَتْحِ مَكَّةَ جَاءَ بِأَبِيهِ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ يَا رَسُولَ اللَّهِ بَايِعْهُ عَلَى الْهِجْرَةِ فَأَبَى وَقَالَ إِنَّهَا لَا هِجْرَةَ فَانْطَلَقَ إِلَى الْعَبَّاسِ وَهُوَ فِي السِّقَايَةِ فَقَالَ يَا أَبَا الْفَضْلِ أَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِأَبِي يُبَايِعُهُ عَلَى الْهِجْرَةِ فَأَبَى قَالَ فَقَامَ الْعَبَّاسُ مَعَهُ وَمَا عَلَيْهِ رِدَاءٌ فَقَالَ يَا رَسُولَ اللَّهِ قَدْ عَرَفْتَ مَا بَيْنِي وَبَيْنَ فُلَانٍ وَأَتَاكَ بِأَبِيهِ لِتُبَايِعَهُ عَلَى الْهِجْرَةِ فَأَبَيْتَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِنَّهَا لَا هِجْرَةَ فَقَالَ الْعَبَّاسُ أَقْسَمْتُ عَلَيْكَ لَتُبَايِعَنَّهُ قَالَ فَبَسَطَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَدَهُ قَالَ فَقَالَ هَاتِ أَبَرَّتُ قَسَمَ عَمِّي وَلَا هِجْرَةَ
Mujahid says: There was a Muhajir companion named Abdur Rahman bin Safwan, who fulfilled the trial of Islam in a good manner. He was a friend of Sayyiduna Abbas (may Allah be pleased with him). This companion brought his father to the Messenger of Allah (peace and blessings be upon him) on the day of the conquest of Makkah and said: O Messenger of Allah! Take his pledge of allegiance for migration. The Prophet (peace and blessings be upon him) refused and said: There is no migration now. That man went to Sayyiduna Abbas (may Allah be pleased with him), who was serving Zamzam water, and said to him: O Abu al-Fadl! I brought my father to the Messenger of Allah (peace and blessings be upon him) so that he would take his pledge of allegiance for migration, but the Prophet (peace and blessings be upon him) refused. Sayyiduna Abbas (may Allah be pleased with him) stood up with him, and he was not even wearing a cloak in place of a shirt. Nevertheless, he came and said: O Messenger of Allah! You know how much I am connected with such-and-such a man. He brought his father so that you would take his pledge of allegiance for migration, but you refused. The Messenger of Allah (peace and blessings be upon him) said: The matter is that there is no migration now. Sayyiduna Abbas (may Allah be pleased with him) said: I swear by you that you will certainly take his pledge of allegiance. So the Messenger of Allah (peace and blessings be upon him) extended his hand and said: Come, pledge allegiance; I am fulfilling my uncle’s oath. There is no migration now.
Hadith 5333
عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا أَنَّهَا قَالَتْ أَهْدَتْ إِلَيْهَا امْرَأَةٌ تَمْرًا فِي طَبَقٍ فَأَكَلَتْ بَعْضًا وَبَقِيَ بَعْضٌ فَقَالَتْ أَقْسَمْتُ عَلَيْكِ إِلَّا أَكَلْتِ بَقِيَّتَهُ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَبِرِّيهَا فَإِنَّ الْإِثْمَ عَلَى الْمُحَنِّثِ
It is narrated from Sayyida Aisha (may Allah be pleased with her), a woman sent some dates to her in a tray. She (Aisha) ate some of the dates and some were left, but that woman said to me: I swear by you that you must eat the remaining dates as well. The Messenger of Allah (peace and blessings be upon him) said: Fulfill her oath, because the sin is upon the one who causes the breaking of the oath.
Hadith 5334
عَنِ الْبَرَاءِ بْنِ عَازِبٍ رَضِيَ اللَّهُ عَنْهُ قَالَ أَمَرَنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِسَبْعٍ وَنَهَانَا عَنْ سَبْعٍ قَالَ فَذَكَرَ مَا أَمَرَهُمْ مِنْ عِيَادَةِ الْمَرِيضِ وَاتِّبَاعِ الْجَنَائِزِ وَتَشْمِيتِ الْعَاطِسِ وَرَدِّ السَّلَامِ وَإِبْرَارِ الْمُقْسِمِ الْحَدِيثَ
It is narrated from Sayyiduna Bara’ bin Azib (may Allah be pleased with him), he says: The Messenger of Allah (peace and blessings be upon him) commanded us regarding seven things and forbade us from seven, then he mentioned those matters which the Prophet (peace and blessings be upon him) commanded, among them were: visiting the sick, following the funeral processions, saying “Yarhamukallah” to one who sneezes, responding to greetings, and fulfilling the oath of one who swears, … .
Hadith 5335
عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا فِي حَدِيثِ رُؤْيَا أَعْبَرَهَا أَيْ فَسَّرَهَا أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ أَمَامَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ ثُمَّ قَالَ بَعْدَ تَعْبِيرِهَا أَصَبْتُ يَا رَسُولَ اللَّهِ قَالَ أَصَبْتَ وَأَخْطَأْتَ قَالَ أَقْسَمْتُ يَا رَسُولَ اللَّهِ لَتُخْبِرَنِّي فَقَالَ لَا تُقْسِمْ
Narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both), this hadith is related to a dream. Sayyiduna Abu Bakr (may Allah be pleased with him) interpreted it before the Noble Prophet (peace and blessings be upon him) and then said: O Messenger of Allah! Did I interpret it correctly? The Prophet (peace and blessings be upon him) said: You have interpreted some aspects correctly and in some you have erred. He said: O Messenger of Allah! I swear that you must surely inform me of my mistake, but the Prophet (peace and blessings be upon him) said: Do not swear.
Hadith 5336
عَنْهُ أَيْضًا أَنَّ أَبَا بَكْرٍ رَضِيَ اللَّهُ عَنْهُ أَقْسَمَ عَلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لَا تُقْسِمْ
It is also narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that Sayyiduna Abu Bakr (may Allah be pleased with him) swore an oath by the Prophet Muhammad (peace and blessings be upon him), but he (peace and blessings be upon him) said to him: Do not swear an oath.
Hadith 5337
عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ رَأَى عِيسَى بْنُ مَرْيَمَ عَلَيْهِ السَّلَامُ رَجُلًا يَسْرِقُ فَقَالَ لَهُ عِيسَى سَرَقْتَ قَالَ كَلَّا وَالَّذِي لَا إِلَهَ إِلَّا هُوَ قَالَ عِيسَى آمَنْتُ بِاللَّهِ وَكَذَّبْتُ عَيْنِي
It is narrated from Sayyiduna Abu Hurairah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: Isa ibn Maryam (peace be upon him) saw a man stealing and then said to him: "You have stolen?" He replied: "By Him besides whom there is no deity! I have not stolen at all." Upon hearing this, Isa (peace be upon him) said: "I believe in Allah and I deny my own eye."
